HomeMy WebLinkAbout990984.tiff RESOLUTION 306 RE: ACTION OF THE BOARD CONCERNING CHANGE OF ZONE FROM A (AGRICULTURAL) ZONE DISTRICT TO PUD (PLANNED UNIT DEVELOPMENT) DISTRICT TO CREATE FOUR (4) E (ESTATE) ZONED LOTS AND ONE (1) R-4 (MULTI-FAMILY) ZONED LOT - WILLIAM HARPER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 28th day of April, 1999, at 10:00 a.m. for the purpose of hearing the application of William Harper 6237 Nottinghill Gate, Boulder, Colorado 80301, requesting a Change of Zone from the A (Agricultural) Zone District to a PUD (Planned Unit Development) District for a parcel of land located on the following described real estate, to-wit: Part of the SW% of Section 13, Township 3 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, the applicant was present, and WHEREAS, Section 6.4 of the Weld County Planned Unit Development Plan Ordinance provides standards for review of such a Change of Zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and, having been fully informed, finds that this request shall be denied due to lack of compliance with the following sections: 1. 6.4.4.6.1 - The proposed is not consistent with the Weld County Comprehensive Plan. 2. 6.4.4.6.2 - The proposed uses which would be allowed on the subject property will not conform to the Performance Standards of the Weld County Planned Unit Development Plan Ordinance, specifically Sections 2.6 and 2.20. 3. 6.4.4.6.3 - The application is for an urban-scale development in an agricultural area and is not compatible with the existing or future development of the surrounding area as permitted by the existing zoning. 4. 6.4.4.6.4 - There is not evidence that adequate public water and sewer service exists, considering the previous history of the sewer treatment facility and the proposed maintenance by the Homeowners Association. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of William Harper for a Change of Zone from A (Agricultural) to a PUD (Planned Unit Development) District on the above referenced parcel of land be, and hereby is, denied. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 28th day of April, A.D., 1999.
