Thursday, March 19, 1996
A regular meeting of the Weld County Board of Adjustment was held on Thursday, March 19, 1996, in the
Commissioners' Hearing Room(#101), 915 10th Street, Greeley, Colorado. The meeting was called to order
by Chairman John Windsor.

The summary of the last regular meeting of the Board of Adjustment held on March 14, 1996, was approved
as read.
1. CASE NUMBER: BOA-987
PLANNER: Gloria Dunn
APPLICANT: Charles M. & Esther L. Pittock
REQUEST: Variance from public sewer requirements in the R-5 (Mobile Home
Residential)zone district.
LEGAL DESCRIPTION: Located in Part of the NW4 of Section 17, T7N, R67W of the 6th
P.M., Weld County, Colorado.
LOCATION: East of Weld County Road 15 and south of and adjacent to State
Highway 14.
Gloria Dunn stated this property is 35 acres and was created by deed in 1983. A portion of this property was
rezoned from A (Agricultural) to R-5 (Mobile home residential) in 1985. The Pine Lake Village Sanitation
District was constructed in 1987 and provides a community sewer system for the 34 unit mobile home park.
The applicants wish to relocate their residence from the Denver area to this property to effectively manage
the mobile home park.
Gloria stated the greatest constraint is not the distance between the proposed structure and the sewer line,
but in the soil and topographical conditions that must be overcome. Gloria explained lowlying wetlands occupy
an area of the site between the sewer line and the residential site. To meet R-5 (Mobile home residential)
zone district requirements, the applicants will have to extend the sewer line through the wetland area and
possibly construct a lift station to provide sewer service to the residence.
The Weld County Health Department had no problems with this site. Staff has received no objections form
surrounding property owners.

Concerns from the Fort Collins Soil Conservation District have been incorporated and if the variance is
approved, the type of septic system will be determined by results of a percolation test.
The Department of Planning Services is requesting approval with the following condition: A Weld County
Septic permit is required for the proposed home septic system and shall be installed to all Weld County
Individual Sewage Disposal System regulations.
Charles Pittock, applicant explained that this property was the highest spot for a residence. He has scheduled
a soil report, if this application, is approved to determine if he will be able to have a basement. Mr. Pittock
is in agreement to staffs recommendation with the condition.
Concerns from the Board of Adjustment on septic systems were discussed. Jeff Stoll, Weld County Health
Department explained if applicants have unsuitable soil or ground water conditions the Health Department
would then specify dimensions to install a standard system. Another option would be an Evapotranspiration
system. This is a lined system that relies on evaporation by transpiring through the soils and grasses and
then into the air. Jeff Stoll stated that if soils were too course or there was to much gravel or sand and they
peroculate too fast to get adequate treatment, the applicants could over excavate with suitable soil which will
provide adequate filtration.
Art Partridge motioned to approve Case BOA-987. Robert Akin seconded the motion.
The Chairman asked the secretary to poll the members of the Board of Adjustment for their decision. Robert
Akin -yes; Timothy Losh -yes; Gary Stewart-yes; MaryAnn DePinto-yes; Anne White-yes; Arthur Partridge-
yes; John Windsor-yes. Motion carried unanimously.
