All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. All exploration and production waste shall be disposed at an approved facility. 2. No permanent disposal of wastes shall be permitted at this site. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. Fugitive dust shall be controlled on this site. 5. The maximum permissible noise level shall not exceed the residential limit of 55 db(A) as measured accordit.g to 25-12-102, Colorado Revised Statutes. 6. Port -a -potty facilities shall be provided during drilling and construction of the well. 7. All phases of the operation shall comply with the Rules and Regulations of the Oil and Gas Conservation Commission. The primary environmental concern is the possible contamination of groundwater from spilled or leaked petroleum during the drilling and storage operations. These issues are particularly sensitive due to the shallow water table and proximity to the Poudre River. The proposed facilities are far enough north of the actual river channel these concerns should be -manageable. Care should be taken during drilling to avoid any petroleum or saline discharges and the storage facilities should have some type -of spill preventi-on. This type of land use sloes not seem to be incompatible with surrounding land uses and there is no 'proposed loss of prime agricultural lands. I recommend the West Greeley Soil Conservation District emphasize the importance of care during drilling operations and to recommend impervious spill containment for the storage facilities. Both items may already be required under other development criteria. I would also ask that adequate reclamation, topsoil and seeding, be done to any areas 'disturbed during the drilling operations. The Greeley Planning Commission recommended approval of the request only if the City oil and gas production standards are complied with. A copy of the City's oil and gas production standards were mailed to you about a week ago. The Planning Commission's recommendation is based upon the following: The City's Comprehensive Plan does not directly address the issue of oil and gas production, but does instruct the City to develop a plan ensuring consideration and balance of the quality of life of the residents in and around areas which contain commercial mineral resources. The plan also states the City should take measures to mitigate adverse environmental impacts through encouraging compatible land uses and development and design standards if environmentally sensitive areas are included within the City's long-range expected growth area. Although this area contains a variety of zoning, including commercial and industrial, it also contains residential properties, some of which may be nonconforming. This area is also well within the City's Long -Range Expected Growth Area which, by definition, includes those lands expected to accommodate the City of Greeley's urban development over the next two to three decades. Since this area is expected to be within the City of Greeley within twenty to thirty years, the development should conform to City standards, including, but not limited to: - the location of -the wellheads at least three hundred fifty (350) feet from any occupied building, any proposed building for which a building permit has been issued where the primary use includes regular occupancy, or any building for which a certificate of occupancy has been issued. 951.773 - production tanks and/or associated on -site production equipment located at least three hundred fifty (35_0) -feet from any building or building permitted for construction. - wellheads, tank batteries and associated on -site production equipment located not less than 100 feet from the edge of any public right-of-way. Because part of the 80 -acre site is in the County R-1 (Low Density Residential) zone district and is likely to be similarly zoned when annexed to the City, and because there are existing residential structures in the area, visual concerns exist as well as safety concerns. A plan for screening the production facilities should be included in the application and should be required by Weld County. The impact of the proposed use could be somewhat mitigated by the applicant's agreement to comply with Section 18.17.165 of the Zoning Code relating to operations within one Calf mile of existing or platted _development. By agreeing to comply with this section, -the applicant would agree to: A. Restrict tank batteries to one site per 160 acres wherever practicable. B. -Equip drilling rigs with blowout preventers. C. Equip production wells with automatic control valves on the wellhead which will close in the well with a sudden change in pressure. D. Fence all production wellheads and tank batteries with a fence sufficient for safety and aesthetics. E. Forbid the insertion of the bit and drilling pipe into or from the hole for routine operations such as for bit change or logging between the hours of 11:00 p:m. and 6:00 a.m., except for electrically operated drilling rigs or drilling rigs equipped with enhanced efficiency mufflers, on any drilling or workover rig operating within one-half mile of an occupied residential building. This requirement does not apply in emergencies. F. Construct wellhead access roads in compliance with Section 18.17.125(a) of the Zoning Code which requires a 20 -foot graded gravel roadway built to specified standards. The proposed wells and production facilities will be located in an area which is somewhat visible from East 8th Street and from Highway 85, both entryways to -the City An effort should be made to mitigate any visual impacts to the surrounding 9511773 area. The location of the production facilities in relation to surrounding structures requires mitigation of negative visual impacts. Because of -the large number of existing structures surrounding the proposed drilling and -production sites, and because of the potential for development and redevelopment in -the area, directional drilling for one of the wells may -be appropriate. Directional drilling would allow consolidation of the two wellheads in one general location, thereby limiting the potential safety hazards _to one general area for the wellheads and one area for the production facilities. During the past year, we have worked with Prima on several drilling sites and they are aware of -the City's _requirements for oil and gas _drilling and production.
