HomeMy WebLinkAbout980478.tiff HEARING CERTIFICATION DOCKET NO. 98-15 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1178 FOR A KENNEL FOR RAISING AND TRAINING OF TOY BREED DOGS (30 MAXIMUM) IN THE A (AGRICULTURAL) ZONE DISTRICT - RUSSELL AND PATRICIA MARTINSON A public hearing was conducted on March 25, 1998, at 10:00 a.m., with the following present: Commissioner Constance L. Harbert, Chair Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer- TARDY Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Todd Hodges Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated March 5, 1998, and duly published March 11, 1998, in the Platteville Herald, a public hearing was conducted to consider the request of Russell and Patricia Martinson for a Site Specific Development Plan and Special Review Permit #1178 for a kennel for raising and training of toy breed dogs (30 maximum) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Todd Hodges, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Hodges explained the applicant is limited to 30 dogs including puppies, and added only dogs owned by the applicant and family are raised. Mr. Hodges explained the case was originally heard by the Planning Commission February 3, 1998; however, numerous letters of concern were submitted, and the case was continued to February 17, 1998. Mr. Hodges stated he and Sheble McConnellogue conducted a noise reading at the site and have worked with the applicant to resolve concerns regarding compliance with the Airport and Flood Hazard Overlay Districts. Mr. Hodges stated since the Planning Commission Hearing, new letters of concern have been submitted and added to the Commissioners' packets. In response to Commissioner Baxter, Mr. Hodges stated the surrounding area is zoned agricultural, and uses consist of a horse boarding operation to the west, the Poudre River to the north, pasture land to the east, and residences on the south. Sheble McConnellogue, Health Department representative, stated a decibel reading was conducted February 11, 1998, at which time the site had a fence bordering the south and west sides of the property. Ms. McConnellogue stated the readings were 55 decibels on the west and 54 decibels on the south; and added the statutes allow up to 55 decibels, therefore, the applicant is in compliance. In response to Commissioner Baxter, Mr. Hodges stated Condition of Approval 3.c., addresses a buffering/noise mitigation plan. In response to Chair Harbert, Mr. Morrison stated the applicant is limited to 30 toy breeds dogs. Responding to Commissioner Hall, Mr. Hodges /� 980478 tic'. Pt PL1243 HEARING CERTIFICATION - RUSSELL AND PATRICIA MARTINSON (USR #1178) PAGE 2 stated a specific definition of "toy breed dog" can be added as a note on the plat. Mr. Hodges added the City of Greeley requested a time limit be set on this permit; however, after discussion, it was decided this permit be designated non-transferrable since the dogs are owned solely by the applicant. Patricia Martinson, applicant, stated all of her dogs are AKC toy breeds which is defined as no taller than 13 inches and weigh 10 pounds or less. Ms. Martinson explained she uses the dogs for showing, as well as therapy in senior citizen and mental homes. (Clerk's note: Commissioner Kirkmeyer is now present.) Ms. Martinson stated the fence has been extended to the east and south sides of the property where neighbors might be effected; however, there is no fence on the east portion adjacent to the neighbor's corral, nor on the east which is adjacent to farmland. She added the applicant plans to plant trees as part of the noise buffering plan. In response to Commissioner Baxter, Ms. Martinson stated the neighbor's house on the east is located approximately 500-700 feet southeast of the corral. Commissioner Hall recommended additional verbiage be added after, "Toy Breed Dogs" in Development Standard #1 to read, "as defined by AKC." No public testimony was offered concerning this matter. Commissioner Hall moved to approve the request of Russell and Patricia Martinson for a Site Specific Development Plan and Special Review Permit#1178 for a kennel for raising and training of toy breed dogs (30 maximum) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record as well as the discussed change to Development Standard#1. The motion was seconded by Commissioner Webster, and it carried unanimously. This Certification was approved on the 30th day of March, 1998.
