A copy of the amendment can be found on the Colorado State Government website at www.state.co.us, under 1998 Ballot Analysis. Amendment 14 requires that the Air Quality Control Commission (AQCC) promulgate air quality regulations concerning the control of odorous emissions from these operations by March 1, 1999. The AQCC has scheduled a rulemaking hearing for February 18, 1999. Amendment 14 also requires that the Water Quality Control Commission (WQCC) promulgate water quality regulations concerning individual discharge permits for housed commercial swine feeding operations by March 31, 1999. The WQCC has scheduled a rulemaking hearing for February 8, 1999. The Department's goal is to develop air quality and water quality requirements that are coordinated to the greatest extent possible, so that the oversight system will be efficient and practical for all concerned. The Colorado Department of Public Health and Environment (Department) is scheduling several work group meetings to solicit comments from interested persons to facilitate a full consideration of options for implementing Amendment 14. The work group is open to the public and all interested parties are invited to attend and participate in this process. It is intended that the work group will discuss the implementation issues and options, and provide advice to the Department regarding how best to implement the requirements of Amendment 14 and how to design regulatory language for consideration by the AQCC and WQCC. The initial work group meeting will be held on Wednesday, December 2, 1998 from 11:00 a.m. to 4:00 p.m. at the Landmark Best Western Inn, 455 S. Colorado Blvd., Denver, Colorado. Additional work group meetings have tentatively been scheduled for: • Wednesday, December 9, 1998 from 11:00 a.m. to 4:00 p.m. at the Landmark Best Western Inn, 455 S. Colorado Blvd., Denver, Colorado. 140 cc : eA Pt, N.1. 982344 • Tuesday, December 15, 1998 from 11:00 a.m. to 4:00 p.m. in the Sabin Conference Room at the Department, 4300 Cherry Creek Drive South, Denver, Colorado. Please plan to bring a sack lunch and drink to each meeting, as we will work through the noon hour. The current plan is that additional work group meetings will be scheduled for January. Rulemaking hearing notices and initial proposals for both the AQCC and WQCC hearings are required to be filed by November 30, 1998. Copies of the notices and proposals will be available at the December 2 work group meeting, and will be mailed to all persons on the mailing list described below who do not attend that meeting. Because of the deadlines established in Amendment 14 to complete rulemaking, the initial draft proposals included with the hearing notices have been prepared without the benefit of significant external review and comment. These initial proposals are not intended to limit the range of options considered by the work group. PLEASE NOTE that to facilitate public participation in the Amendment 14 implementation rulemaking processes for both air quality and water quality, we plan to use the following procedure: 1. CDPHE already has an extensive Confined Animal Feeding Operations (CAFO) Mailing List, from the 1997 water quality CAFO work group process, to which we have added those additional persons who have expressed specific interest in the Amendment 14 rulemaking hearings. If you are on this CAFO Mailing List, you should' receive a separate pink sheet of paper enclosed with this memorandum, confirming that fact. 2. This memorandum regarding the Amendment 14 implementation work group process is also being sent to persons on broader mailing lists maintained by the Water Quality Control Commission and the Air Quality Control Commission. If you have received this memorandum and have not received a separate enclosed pink sheet of paper, confirming that you are on the CAFO Mailing List, and you would like to be added to that list or have changes, please call or e-mail either Diana Glaser at 303-692-3469 (diana.glaser@state.co.us) or Jenifer Gurr at 303-692-3476 (jenifer.gurr@state.co.us). 3. Future major documents developed by CDPHE relating to the Amendment 14 rulemaking processes (e.g., the formal hearing notices and initial rulemaking proposals, prehearing statements, written testimony, formal alternative proposals, prehearing orders) will be sent to all persons on the CAFO Mailing List. Please note that some interim drafts of the rulemaking proposals may be distributed only at the work group meetings described in this letter, since the work group process will be rapidly evolving. 4. Persons who wish to receive copies of documents generated by other parties participating in the rulemaking processes will need to follow the procedures described in the rulemaking hearing notices. 99gS4' Hello
