RE: ACTION OF BOARD CONCERNING PETITION FOR LOCAL IMPROVEMENT DISTRICT
- MARTIN BROTHERS PUD
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, a Petition for a Local Improvement District was submitted to the Board by
owners of property which is more particularly described in said petition, marked as Exhibit "A", a
copy of which is attached hereto and incorporated herein by reference, and
WHEREAS,after review, the Board deems it advisable to schedule a hearing to determine
the intent to create the Weld County Martin Brothers PUD Local Improvement District #1997-1 for
October 15, 1997, at 9:00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that a hearing to consider the aforementioned Petition for a Local Improvement
District be, and hereby is, scheduled for October 15, 1997, at 9:00 a.m.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 8th day of September, A.D., 1997.

PETITION FOR LOCAL IMPROVEMENT DISTRICT
TO: Board of County Commissioners
Weld County, Colorado

We, the undersigned citizens of Weld County, who are owners of record of real property, propose to be
assessed the costs of paving, and which property will benefit from improvement of:
Clara Lee Street and
Elizabeth Street from Clara Lee Street to the
Southern end of the Martin Brothers Planned Unit
Development - Amended Plat
situated in Weld County, Colorado, do hereby petition the Board of County Commissioners of the County of
Weld, State of Colorado, for the formation of a local improvement district pursuant to the CRS, 30-20-601, et
seq. We represent that the real property listed in this petition will be assessed more than one-half of the
estimated $45,860* in costs proposed to be assessed to the local improvement district. Such improvement
district is for the purpose of paving the above described streets and avenues.
The specific improvements we wish to have constructed are as follows:
Shape, grade, pave and shoulder the above -described streets.
We request that the following materials be used:
Two inches of asphalt pavement, 20 ft. wide, and 4 inches of aggregate base
course; and 2 ft. wide aggregate shoulders.
The specific manner of assessments we recommend is as follows:
The property owners be assessed equally per each of the 18 lots described as follows:
Lots 2, 5-18, 20 and 22 of Martin Brothers Planned Unit Development - Amended
Plat, as recorded at Book Number 1228, Reception Number 02175539, Film
Number 1779, File Number 5025 in the Weld County Clerk and Recorder's
records and the property identified as Parcel Number 147112400008 on the Weld
County Assessor's Map, described as Part of the SE'/a of Sec. 12, TIN, R66W,
beginning N89°58'W 1170' and N0°27'E 950' from the SE corner of Sec. 12,
then continuing N0°27'E 180', N89°58'W 500', S0°27'W 360', S89°58'E 250',
N0°27'E 180', S89°58'E 250' to the point of beginning.
We estimate the cost to be $2,547.78 per lot.

The specific manner of payment we recommend is as follows:
The estimated $2,547.78 per lot be paid in full without interest, or over a 10 -year
period, at an interest rate of 7.75% with the principal being divided into 10 equal
annual payments, and the interest computed to the unpaid balance.
We further understand and acknowledge that we are to be responsible, individually, for any grading or other
adjustments to our driveways and culverts necessitated by such project.
Do not sign this petition unless you are an "owner" of real property benefitting from the project and
request to be assessed costs of the improvements. An owner is a person holding fee title to real property. You
are an "owner" if you hold a contract to purchase real property, which obligates you to pay general taxes on
that property. In that instance, the seller may NOT sign this petition. CRS 30-20-602(3) and 603(3).

is a contribution from Martin Brothers LLC for the formation of such Local Improvement District. See
