RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION #1840 -WAGNER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption#1840, does not come within the purview of the definition of the terms,
"subdivision" and"subdivided land", and
WHEREAS, the request for Recorded Exemption #1840 was submitted by Christopher
Wagner, 4652 Weld County Road 28, Longmont, Colorado 80504, for property which is located
in part of the S%of the NEY4 of Section 25, Township 3 North, Range 68 West of the 6th P.M.,
Weld County, Colorado, being more particularly described in the plat which shall be provided by
the applicant and known as Exhibit"A", said plat to be recorded, and
WHEREAS,this request is to divide the property into parcels estimated to be approximately
25 acres and 55 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption#1840 submitted by
Christopher Wagner be, and hereby is, approved conditional upon the following:
1. The Environmental Protection Services Division of the Weld County Health
Department was unable to locate a septic permit for the septic system located on
the smaller parcel of this application. Any existing septic system(s) which is not
currently permitted through the Weld County Health Department will require an
ISDS evaluation prior to the issuance of the required septic permit(s). In the event
the system(s) is found to be inadequate, the system(s) must be brought into
compliance with current ISDS regulations.
2. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.

3. Prior to recording the plat, the applicant shall submit to the Department of Planning
Services, evidence of a seven-year lease agreement for irrigation water for Lot A.
Said water shall be sufficient in quantity to irrigate all of Lot A for a full season.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 14th day of February, A.D., 1996_

A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the
Weld County Individual Sewage Disposal System (ISDS) regulations.

The Department of Planning Services' staff recommends denial of this request
for a recorded exemption for the following reasons:
1 . The proposal does not comply with the intent of the A (Agricultural) zone
district as set forth in the Weld County Comprehensive Plan, specifically A.
Goal 1 and A. Policy 1 which promote the preservation of prime farmland
for agricultural purposes which foster the economic health and continuance
of agriculture. This proposal also evades the purpose of A.Goal 4 and A.
Policies 4, 4.1 , 4.1 .2 and 4.1 .6 which states that the division of land in the
agricultural zone should be maintained to enhance the highest level of
agricultural productivity.
2. The proposal is not consistent with the Weld County Subdivision Ordinance
Section 1 .3 which states the criteria for achieving orderly and efficient
development. More specifically this request does not comply with the
following:
1 .3.1 Assisting orderly and integrated development;
1 .3.10 Preserving agricultural land and promoting its most productive
agrarian use.

Dear Mr. Wagner:
Your recorded exemption application will be processed on or before January 15, 1996. If it is
determined that the application meets the approval criteria of the Weld County Subdivision
Ordinance, you will be notified that the recorded exemption is approved. If the staff determines
that the application does not meet the approval criteria, you will be notified and asked to appear
before the Board of County Commissioners at a public hearing. You will be informed of the
hearing date prior to the hearing. The Board of County Commissioners will then consider your
application and make a final decision on the recorded exemption.
It is the policy of Weld County to refer an application of this nature to any town or municipality
lying within three miles of the property in question or if the property under consideration is
located within the comprehensive planning area of a town or municipality. Therefore, our office
has forwarded a copy of the submitted materials to the Town of Mead's Planning Commission for
its review and comments. It is recommended that you and/or a representative be in attendance
at the Town of Mead's Planning Commission meeting to answer any questions the Commission

The house , outbuildings and surrounding ground is currently own -
ed by Mike Wagner , Chris Wagner , and Lynn Wagner -Knight . We
inherited the family home and farm in 1991 from our parents when
they passed away . Because we all live elsewhere , we have no need
for the house and the adjacent 25 acres of non -prime farm land ;
however , we desire to see it remain as a working farm . Byron and
Shirley Ford are purchasing the home to live in and raise their
family . They have plans to use the outbuilding and corrals for a
horse operation . They have also contracted with the current ten -
ant farmer to continue to farm this acreage . We are very pleased
with this arrangement because the land will continue to be farmed ,
which is very compatible with the surrounding land uses . In
essence , the only things changeing are the occupants of the home .
Our future plans for Lot A are to continue to farm just like it ' s
been done for generations . We have no plans to sub-divide or
develop the area in any manner . To the best of our knowledge , the
Ford ' s future plans are those previously stated (i . e . contracted
current tenant farm) . Their long term future plans are to eventually
take over the farming operation as a primary retirement occupation
and to continue their horse operation .
As indicated on the attached map , there are four (4) natural
boundry lines we have used to establish Lot B: gas well access
road (north ) , Weld County Road 13 Ceast ) , property fence line
(_south ) , and an irrigation ditch (west ) . This small 25 acre
parcel is non -prime farm ground ; the remaining 55 acres is
highly productive farm ground requiring irrigation . Also
indicated on the map are several ditches . These are dirt ditches
which have been surveyed and created in order to aid in the re-
moval and dispersal of tail water so that it can be reused in a
productive manner .

system(s) which is not currently permitted through the Weld County Health
Department will require an I.S.D.S. Evaluation prior to the issuance of

This letter is written to follow up our conversation of Thursday, January 19, 1996,
regarding the Wagner exemption. Byron and Shirley Ford (who are purchasing the home)
arc needing 25 acres for the following reasons:
1. They want to cross fence the acreage in order to rotate their horses from pasture to
pasture.
2. They want to raise feed for the horses, i.e. grass hay or alfalfa.
Splitting off 15 acres will not be sufficient to do either of the above items.
Exempting off the 25 acre piece also makes sense because of the road which is currently
installed. Wayne has been row farming everything to the north of the road(last year in
I corn). The property south of the mad has not fit into Mr. Wagner's farming of which
comprises the 25 acres.
Now Mr. Ford, with the tail water from Mr. Wagner's farm operation,will cultivate and
make the acreage south of the road productive. Mr. Wagner has agreed to assist in this
process since it will now be in both parties best interest to keep the property productive.

TOPIC: Business Plan for Longmont Horse Ranch

INTRODUCTION
The reason for purchasing at least 25 acre for a ranch near Mead in Weld County is 1)to provide
my family with a residence with a good quality of life, and 2)to prepare to supplement my
retirement income by raising and training horses.
TIME FRAME
I plan to continue working at my profession as a software engineer for the next 2-4 years until I
can afford to retire. During that time we have arranged with the current owner to continue
farming the land on a tenent basis. After that time I plan to convert these acres to irrigated
pasture. I have already spoken to the Weld County Agriculture Service agent for the University
of Colorado, Jerry Alldredege, regarding this plan. He agreed that the land was excellent crop
land and was well suited for the purpose which I propose. Jerry suggested that under a three
pasture rotation plan the land would support approximately one horse for every 2 - 2 1/2 acres.
In fact this process of converting to pasture will not be an aburpt conversion but rather it will
occur gradually over the next 4 years as I get a chance to build fences and outbuildings
appropriate for horses. A small pasture, a corral, and a grainary exist now so we will begin to
operate on a limited basis this up coming spring and summer with a few horses.
SCALE OF OPERATION
I plan to do most of the work myself with help from my grandchildren and my wife. I expect
to hire temporary help from time to time on an ad hoc basis and I will need to employ the
services of a veterinarian and a farrier as required. I do not plan to hire any full time
employees. I estimate that on the average each horse will require about 1 hour of care per
day for the type of operation I envision. Since my grandchildren will be attending school and my
wife's time will be largely employed caring for the house and the children, I estimate that about
12 hours will be available to devote to the ranching operation per day, mostly of my time.
Twelve (12) hours of time eqates to 12 horses and 12 horses equates to 24-30 acres. Thus the
requirement for 25-30 acres.
The reason for the particular 25-30 acres which we have requested is to guarantee the
preservation of our view of Longs Peak, the Indian Peaks, and the Never Summer Range. My
wife and I look forward to looking out our back window at the moutnain view with horses grazing
in the foreground. We wish to avoid the possibility of additional houses in these fields.
ECONOMIC ANALYSIS
I plan to purchase horses from owners who have lost interest in their horses. These horses tend
to need physical care in the form of grooming, less feed for overweight animals, more feed for
under fed animals, worming and other minor verterinary needs, hoof trimming, etc. I plan to
provide most of this care myself. I will avoid really lame or infirm aniimals. These neglected
animals also need mental attention in the form of training them to have better manners. Good
manners are an absolute requirement for the young and/or inexperienced riders who I expect to
be my customers.

By providing care for this type of horse I can add value to each horse and sell them at a profit.
My experience is that in three to six months the appearance and manners of this type of horse
can be improved by almost a factor of two. I plan to buy horses at a price as near to $1,000 as I
can and sell them at a price as near to $2,000 as I can. Allowing for expenses I can make $500-
1000 per horse with a average of$750 per horse. Allowing 3-6 months for turnaround I can clear
about $2,250 per year per herd animal maintained. With a herd size of 12 horses I can make
$27,000 per year. This amount will supplement my retirement income to the extent which I will
need.
This$27,000 annual income from 25-30 acres will provide approximately $1,000 annual income
per acre which I feel is a reasonable number.
As a secondary source of horses, I have a cousin in Colby Kansas, and a nephew in Binkleman
Nebraska both of whom are involved in a limited way with buying and selling horses. Horses in
these areas tend to cost less than horses in the Boulder/Weld/Larimer county area. Buying
horses from Kansas and Nebraska and reselling them in Colorado is an alternate modus
operendi. The profit per horse will be less but the turnaround time will also be less so the profit
per year per herd animal maintained should be comparable to my primary operations.
I have identified yet a third source of income from buying and selling horses. The demand for
trail horses is very high is this area in the spring and early summer because of the numerous
guest ranches in the Estes Park area. This provides a market for well mannered horses. In the
fall these same horses become surplus because the guest ranches can not, or do not wish to,
winter all of the horses they need for the peak season. These horses can be purchased and held
over the winter for resale in the spring. Or they can be trucked to Arizona where the fall and
early winter is the peak season for guest ranches and hence horses. In the spring the Arizona
guest ranches provide a source of relatively inexpensive horses to meet the demand for horses
in the Colorado area.
