HomeMy WebLinkAbout981127.tiff SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING Tuesday, May 19, 1998 A regular meeting of the Weld County Planning Commission was held May 19, 1998, in the County Commissioners' Hearing Room (Room#101), Weld County Centennial Building, 915 10th Street, Greeley, Colorado. The summary of the last regular meeting of the Weld County Planning Commission held on May 5, 1998,was approved as read. CASE NUMBER: USR-1184 APPLICANT: J. Frank and Marian Hobbs PLANNER: Scott Ballstadt REQUEST: Site Specific Development Plan and Special Review Permit for an Agricultural Service Establishment (an Equine Breeding, Breeding, Boarding and Training Facility) in the A (Agricultural)zone district LEGAL DESCRIPTION: Lot B of RE-584, being part of the S2S2NW4 of Section 23, T2N, R67W of the 6th P.M., Weld County, Colorado LOCATION: Approximately 1/4 mile east of Weld County Road 21 and approximately 1/4 mile south of Weld County Road 20 Scott Ballstadt, Department of Planning Services, gave an overview of Case USR-1184. Scott read the recommendation into the record. The Department of Planning is recommending approval of the application, along with the Conditions of Approval and Development Standards. Frank and Marion Hobbs, applicants, explained that they would like to breed and train horses, and are not trying to expand in acres, but expand to where they can be profitable and legal. Arlan Man's, asked about the arena and if they had plans to have any type of roping events or lighting for the arena. Mr. Hobbs stated that they have no plans to do so at this time. The Vice-Chair asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. The Vice-Chair asked the Hobbs if they were and in agreement with the Conditions of Approval and Development Standards. The Hobbs were in agreement. Bruce Fitzgerald asked Don Carroll about the road way into the property not being maintained. Don stated that the main access off of Weld County Road 21, is a privately maintained access or easement, and Weld County does not maintain private lanes or easements. )0 noun -"g-"'"`' 981127 vG/o Yip? Marie Koolstra seconded the motion. The Vice-Chair asked the secretary to poll the members of the Planning Commission for their decision. CASE NUMBER: USR-1185 APPLICANT: Dana and DeeAnn Patten PLANNER: Julie A. Chester REQUEST: A Site Specific Development Plan and Special Review Permit for a Commercial Mechanic's Repair Shop LEGAL DESCRIPTION: Part of the NW4SW4 of Section 21, T4N, R66W of the 6th P.M., Weld County, Colorado LOCATION: East of Weld County Road 29 and south of State Highway 256 Julie Chester, Department of Planning Services, gave an overview of application. Julie stated there have been changes made to Development Standard#9, on the wording of light industrial to residential. Julie than read the recommendation into the record. The Department of Planning of Services is recommending approval of the application. Christie Nicklas noted there are two number nine Development Standards. The change will be made with subsequent renumbering. Dana and DeeAnn Patten, applicants, had a question on reference to the driveways. Mr. Patten would like to keep the business access separate from the residential access, because of concerns with children playing in the area. They are willing to close one of the accesses. Don Carroll, stated that after visiting the site, there is an existing circle drive in place, and the applicants are asking for an additional access north of the circle drive. Pubic Works was asking that the new access not be granted, and to try to utilize the north end of the circle drive to minimize access points. After speaking with Julie Chester, the applicants had indicated that they are willing to close the north portion of the circle drive. They would swap out the north access for a new proposed access to be used for the business and residential parcels. Christie asked Don what their recommendation would be. Don stated that he is agreeable to minimize the circle drive. The applicants stated they would prefer to close the south access. Changes to Conditions of Approval#2 and Development Standard#17 were made, along with the addition of Condition of Approval#3C. Arlan Marrs commented that he has seen repair type shops, and they are a valued addition to the agricultural area, but that sometimes they get a junky appearance. He asked Mr. Patten what type of plan they have to eliminate this. Mr. Patten explained that they are planning on placing a privacy fence on the backside of the building to store any used parts, and most vehicles will be left inside of the garage. The Vice-Chair asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. The Vice-Chair asked the applicants if they were in agreement with the Conditions of Approval and Development Standards, along with the changes. The Pattens were in agreement. SUMMARY OF THE WELD COUNTY PLANNING COMMISSION May 19, 1998 Page 3 Arlan Marrs asked Julie if she was comfortable with the wording of the Development Standards in regards to fencing. Julie explained that there is a Condition of Approval that the applicants submit a landscape and screening plan prior to recording the plat, which the applicants are agreeable to. Arlan Marrs moved that Case USR-1185, be forwarded to the Board of County Commissioners along with the Conditions of Approval and Development Standards along with the following changes to Condition of Approval #2 from one access per residential lot with an additional access be allowed for the USR permit, the addition of Condition of Approval#3C that the plat is amended to show the closing of the south existing circle drive and the addition of the new access, and the change to Development Standard #17, along with the Planning Commissions recommendation of approval. Stephan Mokray seconded the motion. The Vice-Chair asked the secretary to poll the members of the Planning Commission for their decision. CASE NUMBER: USR-1186 APPLICANT: Tri-State Generation and Transmission Association, Inc. PLANNER: Gloria Dunn REQUEST: A Site Specific Development Plan and Special Review Permit for a Major Facility of a Public Utility for a 7-mile 115 kV overhead transmission line (72-foot height) in the A(Agricultural) zone district. LEGAL DESCRIPTION: Various legals, see application materials for more specific information. LOCATION: Preferred route begins at Prospect Valley Subdivision, running south along Weld County Road 69 to Weld County Road 14, then east to Weld County Road 71, and south approximately 4-'% miles to connection with Hoyt-Terry Street transmission line. Gloria Dunn, Department of Planning Services, gave an overview of the application, and read the recommendation into the record. Gloria stated the Department of Planning Services is recommending approval of the application. Bobby Bond, representative of the application, gave a brief summary of the project. Mr. Bond explained that in the case of an outage, Morgan County REA would no longer be able to provide service to the area. The project is for a seven-mile transmission line going south of Prospect Valley, which would then connect with another 115 transmission line that Western owns. This would allow Western to eventually repair their line and provide new service into the Prospect Valley area. Mr. Bond stated that the project is for the Prospect Valley area only. They have met with the community and land owners, and there was a consensus for the need of the project. Mr. Bond than explained the different routes that were talked about, and the willingness to work with the people. Stephan Mokray asked about the span between the poles that will be set. Mr. Bond stated it would be approximately 600 feet at the most. Arlan Marrs asked if there was any service along the Sand Creek stretch currently. Steve Sundant, of Morgan County REA,explained there is service along the existing line,which serves some irrigation wells and houses. Mr. Sundant also explained that the first mile and half of the route will go in the existing alignment where the line is currently located. There are currently no existing lines directly in the route of Sand Creek for approximately 4 miles in the middle of the route. The 115 voltage line will not provide service for houses or irrigation, but for the substation. The Vice-Chair asked if there was anyone in the audience who wished to speak for or against this application. Gene Andrews, property owner,wanted to know which side of the sand bar the line will run. Mr. Bond stated that it will be on the west side. SUMMARY OF THE WELD COUNTY PLANNING COMMISSION May 19, 1998 Page 4 Vernon Cooksey, property owner, spoke against the application. Mr. Cooksey has concerns with the line disrupting their irrigated land out of production. Mr. Cooksey than read a letter into the record which was submitted into evidence. Arlan Marrs asked Mr. Cooksey to show them on the overhead map, where his property is located. Mr. Cooksey pointed out his land and the proposed line route, stating a concern of the placement of the route and his proposed pivot sprinkler. Arlan stated he understood the route would be in the tow of the Sand Creek Canal, and the area could not be farmed. Mr. Cooksey stated that yes it could be farmed, and on the other side of the berm road is dryland. Bruce Fitzgerald asked if the pole placement changed to suit his farming operation, would that work for Mr. Cooksey. Mr. Cooksey stated it would, and have spoke to the applicants regarding this, who are willing to place the poles further apart, and would still have to shorten the pivot sprinkler some, but feels it would be better on the other side of the sand creek. Arlan asked how many acres he would lose by shortening the center pivot, or how much an extra pivot would cost, and had this been negotiated. Mr. Cooksey stated he had not had this discussion. Gene Andrews asked about part of the line being buried, and feels that this would help everyone along the 4.5 miles. Arlan asked Mr. Cooksey if the proposed line provided closer service for his center pivots and pumps, would this be any benefit to him. Mr. Cooksey stated that he had not given it much thought, and that it could be a possibility, but not a big advantage. Bobby Bond, responded to the concerns addressed. Mr. Bond explained that they have had several conversations with Mr. Cooksey, and understood that he was not happy with the line alignment, but was willing to accept the line if compensation was adequate, and does feel they will reach an agreement. Mr. Bond feels that the route of the line will have the least impact on the area and greatest acceptance. Marie Koolstra asked Mr. Bond what the possibility was to bury the line. Mr. Bond explained that a distribution line can be buried, but a 115 line would be about one to one and a half million dollars a mile to do so. Jack Epple asked about the poles. Mr. Bond stated that the same wood poles will be used, with metal turning structures on the corner. Stephan Mokray asked if the conflict of interest with Mr. Cooksey is the pole location of his pivot. Mr. Bond stated that Mr. Cooksey does not have a pivot at this time, but if they had a plan they would try to work around it. Mr. Cooksey commented off the record from the audience that HS Irrigation has laid out a plan as to where the pivot would go, but does not have it in yet. This prompted the response from Mr. Bond that if he has a plan, they can try their best to place the structures to accommodate the pivots. Arlan asked what the potential of moving the power line from the west side of the ditch road to the east of the road. Pat Dilly, a representative of the application, explained that by moving a line to the east side of the access road, it would run interference with several gas pipe lines in the area. The Vice-Chair asked Mr. Bond if they were in agreement with the Conditions of Approval and Development Standards. Mr. Bond stated that yes they are. 9i/02 '7 SUMMARY OF THE WELD COUNTY PLANNING COMMISSION May 19, 1998 Page 5 Stephan Mokray moved that Case USR-1186, be approved along with the Conditions of Approval and Development Standards. Arlan Marrs seconded the motion. Arlan Marrs stated that he would expect Tri-State to work as diligently with the Cookseys to minimize any adverse impacts to their property. Jack Epple also stated he hopes Tri-State will work with the Cookseys land owners since the project will lead to a majority of the people in the Prospect Valley area. The Vice-Chair asked the secretary to poll the members of the Planning Commission for their decision.
