RE: APPROVE RESUBDIVISION (LOT LINE ADJUSTMENT ONLY) OF NORTHWEST
ESTATES PUD, 2ND FILING -ALEXANDER AND BRENDA RICKETSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 29th day
of April, 1998, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing
the application of Alexander and Brenda Ricketson, 7191 Lake View Court, Windsor,
Colorado 80550, for a Resubdivision (lot line adjustment only) of the Northwest Estates PUD,
2nd filing on the following described real estate, to-wit:
Lots 16 and 17 of the Northwest Estates PUD, 2nd
Filing, being part of the SW% and part of the
SW%NW% of Section 4, Township 5 North, Range
65 West of the 6th P.M., Weld County, Colorado
WHEREAS, Section 8.3 of the Weld County Subdivision Ordinance provides standards
for review of said Resubdivision (lot line adjustment only) of the Northwest Estates PUD, 2nd
filing, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Weld County Planning Commission and all of the exhibits and evidence presented in this
matter and, having been fully informed, finds that this request shall be approved for the
following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 8.3.1 of the Weld County Subdivision Ordinance.
2. It is the opinion of the Board of County Commissioners that the applicant has
shown compliance with Section 8.3.2 of the Weld County Subdivision Ordinance
including specifically:
a. Section 8.3.2.3.1 -- How the lot line revision complies with the approved
recorded final plat. The proposed lot line revision is consistent with the
previously approved Minor Subdivision. The proposed new lot line
between Lots 16 and 17 will result in an acreage transfer of 0.62 acre
from Lot 16 to Lot 17. Lot 17 will consist of 2.55 acres and Lot 16 will
consist of 1.19 acres. These lot sizes are consistent with other lot sizes
approved in Northwest Estates, 2nd Filing, which range from 0.94 acre to
3.48 acres.

b. Section 8.3.2.3.2-- How the application complies with the adopted rules,
regulations, and ordinances currently in force and affecting the subdivision. The
conditions of approval address the issues concerning the regulations and
ordinances that affect this proposal. The proposed lot line adjustment will not
create any problems with the existing circulation on the site and the existing
structures will comply with all setback and offset requirements of the Weld
County Zoning Ordinance. The Weld County Building Inspection Department,
Public Works Department, and Health Department reviewed this request and find
no conflicts.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of Alexander and Brenda Ricketson for a
Resubdivision (lot line adjustment only) of the Northwest Estates PUD, 2nd filing on the
hereinabove described parcel of land be, and hereby is, granted subject to the following
conditions:
1. The Resubdivision plat shall be submitted to the Weld County Department of
Planning Services for recording within 30 days of approval by the Weld County
Board of County Commissioners.
2. Prior to recording the plat:
a. The Resubdivision plat shall meet all requirements of Section 4.5.21 of
the Weld County Subdivision Ordinance, as amended.
b. The following notes and information shall be delineated on the plat:
(1) The lots shall maintain compliance, at all times, with the
requirements of the Weld County Building Inspection, Public
Works and Health Departments, and the Windsor/Severance Fire
District.
(2) Installation of utilities shall comply with Section 12 of the Weld
County Subdivision Ordinance, as amended.
(3) A 15-foot utility easement shall be delineated on Lots 16 and 17
adjacent to Lee Lake Avenue and Lakeview Court, as well as a
10-foot easement along the interior lot line between Lots 16 and
17.
(4) A standard utility provider sign-off list shall be delineated on the
plat and shall be signed by each utility provider for the vacation of
the portion of the existing 10-foot utility easement between Lots
16 and 17, as approved by the Weld County Utility Advisory
Committee.

Dear Mr. and Mrs. Ricketson:
Your application and related materials for the request described above are complete and in order at the present
time. I will be contacting you in the near future for a hearing date with the Board of County Commissioners. I
have scheduled a meeting with the Weld County Utilities Advisory Committee for Thursday, March 26, 1998, at
10:00 a.m. This meeting will take place in the Weld County Administrative Offices, 1400 N. 17th Avenue,
Greeley, Colorado.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within three
miles of the property in question or if the property under consideration is located within the comprehensive
planning area of a town or municipality. Therefore, our office has forwarded a copy of the submitted materials to
the Windsor Planning Commission for its review and comments. Please call Town of Windsor at 970-686-7476,
for information regarding the date, time and place of the meeting and the review process.
It is recommended that you and/or a representative be in attendance at each of the meetings described above in
order to answer any questions that might arise with respect to your application.
A representative from the Department of Planning Services will be out to the property to post a sign adjacent to
and visible from a publicly maintained road right-of-way which identifies the hearing time, date, and location. In
the event the property under consideration is not adjacent to a publicly maintained road right-of-way, one sign will
be posted in the most prominent place on the property and post a second sign at the point at which the driveway
(access drive) intersects a publicly maintained road right-of-way.
The Department of Planning Services' staff will make a recommendation concerning this application to the Weld
County Planning Commission. It is the responsibility of the applicant to contact the Department of Planning
Services office a few days before the date of the hearing to obtain that recommendation.

To Whom it may concern,
Our reasons for requesting this lot line adjustment are as follows:
♦ Due to the proximity of an irrigation pond we were forced to build our home thirty feet from our
west property line, which borders the subject property. This was due to the requirement that the
septic system be more than 100'from any water and in order for our home to be up-hill from the
septic system we ended up being at the thirty foot set back.
• We purchased our 1.9 acre lot with the intentions of having a big open backyard, and now all of a
sudden we have a thirty foot narrow rear yard, which at any time if someone else owned the subject
property could erect a shop or horse-barn etc.
• So we purchased the subject property in order to protect our view and privacy and after some
considerations we decided we really don't need 4 acres and 2 build able lots. Many of the other lots
in this filing are less than 1 acre and several are in the 1 to 1.5 acre size so we felt that if we could
take just a pie out of Lot 16 this would give us a big back yard and protect our views and privacy
and at the same time allow Lot 16 to have a residence built upon it and be used as it was intended.
The proposed lot line change will affect lots 16 and 17 as follows:
• Lot 16 will loose"a pie shaped"area of approximately .62 acres and become a 1.19 acre lot. No
utilities cross though this area and new utility and drainage easements will follow the new lot lines.
• Lot 17 will gain approximately .62 acres and will become a 2.55 acre lot. No utility or drainage
easements will be cut-off and all easements will follow new lot line.

COMMENTS:
The Northwest Estates second filing has been accepted by Weld County for maintenance. This is a paved
subdivision.
RECOMMENDATIONS:
In accordance with Weld County Public Works Ordinance#180 which grants one access per legal lot and no circle
drives, no additional accesses will be granted to these lots. Access will be from an internal road system.
If a culvert is required at either lot, a 15-inch CMP is the county minimum. If the applicant chooses to place a
larger culvert, please contact our office.
I have no conflict with the lot line adjustment for Lots 16 and 17.
