HomeMy WebLinkAbout961692.tiff RESOLUTION RE: APPROVE APPOINTMENT OF KENT DONAHUE AS WELD COUNTY REGIONAL COMMUNICATIONS CENTER DIRECTOR WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners agreed to combine communications centers with the City of Greeley, and WHEREAS, the joint communications center, known as the Weld County Regional Communications Center, is operated by the City of Greeley under contract with Weld County, and WHEREAS, the City of Greeley has assigned Kent Donahue to be the Director of the Weld County Regional Communications Center, effective September 26, 1996. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Kent Donahue be, and hereby is, appointed as the Weld County Regional Communications Center Director, effective September 26, 1996. BE IT FURTHER RESOLVED by the Board that Captain Donahue will not be compensated by Weld County directly, and that Captain Donahue has signed the attached waiver of all employment rights under the Weld County Personnel system and any employment rights which may be afforded him pursuant to the Weld County Home Rule Charter in accordance with his appointment as Director of the Weld County Regional Communications Center. Webster 961692 CM0003 WAIVER OF EMPLOYMENT RIGHTS AND BENEFITS I, Kent Donahue, being duly appointed by the Board of County Commissioners of Weld County, Colorado on September 24, 1996 to be "Director of the Department of Communication Services" at Weld County, Colorado,pursuant to § 4-6O) of the Weld County Home Rule Charter, hereby waive any and all rights and benefits which may be afforded to me by the Weld County Home Rule Charter, and/or Weld County Ordinance 118, as amended, by virtue of my appointment as said Director and, as grounds therefor, state and acknowledge the following: 1. That I am currently a full-time employee of the City of Greeley, Colorado. As an employee of the City of Greeley, I receive salary, insurance, and other benefits afforded to City employees generally. 2. That I understand that the "Director of the Department of Communication Services" may be considered to be an "employee" pursuant to the definition found at § 16- 10(18) of the Weld County Home Rule Charter, by virtue of the fact that said Director is "in County service." I also understand that employees as defined by the Weld County Home Rule Charter have certain rights and benefits afforded to them by said Charter and by Weld County Ordinance 118, as amended, including, but not limited to, dismissal, disciplinary, and employee grievance procedures, pursuant to § 4-2(B)(2)(d) of said Charter, and pursuant to the section entitled "Employee Grievances" of said Ordinance, as amended. 3. That I understand and acknowledge that by appointing me as the "Director of the Department of Communication Services" at Weld County, the Board of County Commissioners did not and does not intend for me to be considered as an"employee" of Weld County who is subject to and is afforded rights and benefits pursuant to the Weld County Home Rule Charter and/or pursuant to Weld County Ordinance 118, as amended. 4. That I understand and acknowledge that by signing this Waiver I will forego the receipt of any such rights and benefits pursuant to the Weld County Home Rule Charter and I further acknowledge that I am signing this Waiver with full knowledge of those rights and benefits and without duress. rr Signed this day of D(" & tr , 1996. This transfer of administrative personnel is a routine matter in accordance with our rotation of assignment policy. Captain Statler has worked closely with you and the Weld County Commissioners since 1993, and I am sure he will be missed since he has performed his duties in such an exemplary manner; but I am also confident that in a relatively short time you will learn to appreciate the administrative abilities and the personal commitment that Captain Donahue will bring to his new assignment.
