RE: APPROVE VACATION OF SPECIAL REVIEW PERMIT #551 -WESTERN PAVING

WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated May 25, 1983, the Board did approve Use by Special
Review Permit#551 for an Open Cut Gravel Mining Operation (wet-pit) for Western Paving
Construction on the following described real estate, to-wit:
Part of the N1/2 NE1/4 of Section 16, Township 2
North, Range 68 West of the 6th P.M., Weld
County, Colorado
WHEREAS, the Board has received a request from Donald LaFaver and Charles Miles,
Jr., current owners, to vacate said Special Review Permit#551, to satisfy Condition of
Approval #2.E of Change of Zone #522, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Use by Special Review Permit#551 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 20th day of October, A.D.,, 1999.

SUBJECT: USR-551, Open Cut Gravel Mining Operation (Wet Pit)
September 1, 1999
USR-551 is located north of and adjacent to WCR 20 Y and west of and adjacent to WCR 7.
The legal description is as follows: Part of the N2, NE4, Section 16, Township 2 North, Range 68
West of the 6th PM, Weld County, Colorado.
Tuttle Applegate, Inc., on behalf of their client, Don La Faver, has requested, in writing, that
USR-551 for an open cut gravel mining operation (Wet Pit), be vacated. USR-551 was
approved by the Board of County Commissioners on May 25, 1983.
This request for vacation of USR-551 is intended to satisfy Condition of Approval # 2.e. as
outlined in Change of Zone (Z-522) for Light House Cove. Z-522 was approved by the Board of
County Commissioners on May 19, 1999.
The Department of Planning Services requests that the Board of County Commissioners
consider Tuttle Applegate's request to vacate USR-551.

Geology for the termination of the mining permit on the Lighthouse Cove property.

RE : Groom Addition, Permit No. M-83-099
Dear Ms. Eastin:
Per your request, this letter is to inform you that Permit No. M-83-099 was terminated on July 7,
1993. Either the site had not been disturbed or all aspects of the reclamation plan had been
successfully completed to the satisfaction of the Division. The "Groom Addition" permit was
issued to Western Paving Construction on June 23, 1983. The permit specified extraction of
sand and gravel over an area of 80 acres located in the northeast quarter of Section 16, T2N,
R68W of the 6th P.M., Weld County.

Dear Eric:
Please accept this letter as a formal request to vacate USR-551;approved:by,the Board of
County Commissioners on May 25; 1983, for an open-cut gravel mining-operation. The
mining has been completed and the property'reclaimed according'to the State Division of
Minerals and Geology Permit.
This request will also satisfy Condition of Approval 2e as outlined in Change of Zone (Z-
522) for Light house Cove approved by the Board of County Commissioners on May 19,
1999.
