HomeMy WebLinkAbout992538.tiff RESOLUTION RE: APPROVE VACATION OF SPECIAL REVIEW PERMIT #551 -WESTERN PAVING d� ( CONSTRUCTION COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated May 25, 1983, the Board did approve Use by Special Review Permit#551 for an Open Cut Gravel Mining Operation (wet-pit) for Western Paving Construction on the following described real estate, to-wit: Part of the N1/2 NE1/4 of Section 16, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has received a request from Donald LaFaver and Charles Miles, Jr., current owners, to vacate said Special Review Permit#551, to satisfy Condition of Approval #2.E of Change of Zone #522, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Use by Special Review Permit#551 be, and hereby is, vacated. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 20th day of October, A.D.,, 1999. The legal description is as follows: Part of the N2, NE4, Section 16, Township 2 North, Range 68 West of the 6th PM, Weld County, Colorado. Tuttle Applegate, Inc., on behalf of their client, Don La Faver, has requested, in writing, that USR-551 for an open cut gravel mining operation (Wet Pit), be vacated. USR-551 was approved by the Board of County Commissioners on May 25, 1983. This request for vacation of USR-551 is intended to satisfy Condition of Approval # 2.e. as outlined in Change of Zone (Z-522) for Light House Cove. Z-522 was approved by the Board of County Commissioners on May 19, 1999.
