AUTHORIZING CHAIRMAN OF THE BOARD TO SIGN QUIT CLAIM DEED CONVEYINGrA PARCEL OF
LAND IN SECTION 17, TCWNSHIP 6 NORTH, RANGE 67 WEST TO HENRY KRAUSE:
/
BE IT RESOLVED, that the Chairman of the Board be and he is hereby
authorized to sign Quit Claim Deed conveying to Henry Krause a parcel of land in
Section 17, Township 6 North, Range 67 West, more particularly described as,
follows, to -wit:
A certain tract of land in the SWI SE—*' of Section 17, Township 6 N.,
Range 67 W., designating the same as "Ault's Addition to the Town of
Windsor", was heretofore and on or about the tenth day of May, 1904,
filed in the office of the Clerk and Recorder of said County of Weld,
containing or purporting to contain a dedication to the public use of
certain so called streets and alleys in said land as set forth in said
plat.
Reference is hereby made to the Weld County Clerk and Recorder's records,
Book 1619 at Page 1.
The above and foregoing resolution was, on motion duly made and seconded
adopted by the following vote:

Mr. Samuel S. Telep, County Attorney, telephoned Mr. J. W. Vaughn 7/1862 and
as a result the following was agreed!
Weld County could not and should not participate in a joint resolution with
Town of Windsor. The County has no interest whatsoever left regarding the
property. Weld County has Quit Claimed all their interest that they may
have had at any time Recorded at Weld County Records Book 1619, Page 1
on a certain tract of land to Henry Krause.

Gentlemen:
I enclose herewith a joint resolution vacating a six
foot strip in a public roadway adjacent to the Windsor School
property on the west, about which I have consulted with Mr.
Shultz. The School wants to use this strip to enlarge the present
football field cand proposes to puohasa.the strip and land to the
north of it from the Krause estate which owns adjoining property
on the west and north. The strip to be vacated is only 210' long
as the portion north of that has already been withdrawn as a public
street by an Agreement back in 1905.
As the street forms the west boundary line of the Town of
Windsor it has been necessary for the Town of sign the joint
resolution and as the strip is actually in Weld County it will be
necessary for the Commissioners to pass and sign the resolution also.
If you wish, you may draft your own form of resolution and I am sure
the Town will sign also.
The school is anxious to build some bleachers on the strip
in time for the football season this fall so hope that it will be
convenient for you to pass and sign the resolution and return to me,
keeping one copy for your files. You have in yourfiles ilea the Petition
for vacating this strip signed by the Krause estate and the School
District.

THIS DEED, Made this Third day of July, in the year of our Lord
one thousand nine hundred and sixty-two, between ;VELD COUNTY, a municipal
corporation and a political subdivision of the State of Colorado, by the
BOARD CF COUNTY COMMISSIONERS, for its respective interests, of the COUNTY
OF WELD and the STATE OF COLORADO, of the first part, and Henry Krause of
the COUNTY OF WELD and STATE OF COLORADO, of the second part;
WITNESsETH, That the said party of the first part, and in considera-
tion of the sum of other valuable considerations and ten dollars, to the
said party of the first part in hand paid by the said party of the second
part, the receipt whereof is hereby confessed and acknowledged, has remised,
released, sold, conveyed and QUIT CLAIMED, and by these presents does re-
mise, release, sell, convey and QUIT CLAIM unto the said party of the second
part, all the right, title, interest, claim and demand which the said party
of the first part has in and to the following described real estate situate,
lying and being in the County of Weld and State of Colorado, under that
certain agreement entered into and between William 0. Darnell, party of the
first part and Wm. T. Porter, Charles Closter, Sarah A Lewis, parties of
the second part, recorded on June 9, 1905, in Book 228 at Page 176 and 177,
to -wit:
A certain tract of land in the Southwest Quarter of the
Southeast Quarter of Section 17, Township 6 North, Range
67 West, designating the same as "Ault's Addition to the
Town of Windsor", was heretofore and on or about the tenth
day of May, 1904, filed in the office of the Clerk and Re-
corder of the said County of Weld, containing or purporting
to contain a dedication to the public use of certain so
allied streets and alleys in said land as set forth in said
plat.
To have and to Hold the same, together with all and singular
the appurtenances and privileges thereunto belonging or in anywise there-
unto appertaining and all the estate, right, title, interest and claim
whatsoever, of the said party of the first part, either in law or equity
to the only proper use, benefit and behalf of the said party of the second
part, his heirs and assigns forever.

Greeley, Caolorado.
Gentlemen:
We, the undersigned abutting property owners do
hereby Petition the Board of County Commissioners of Weld County,
Colorado, for an order vacating the east six (6) feet of First
Street of Ault's Addition to the Town of Windsor, Colorado.
We further show that the Henry Krause estate owns the
abutting property on west being Lots 1, 3, 5, 7, and 9, in Block
One of said Ault's Addition, while Weld County Reorganized School
District No. RE 4, is the owner of property adjoining on the east
of said street. That the School District needs said six foot
strip in order to move back its bleachers on the athletic field
which adjoins said street on the east.
We further show that said street is laid out 40 feet
in width and that if said six foot strip is vacated, the street
will still be wide enough for ordinary traffic. That the strip
to be vacated is 630' measured northward from the center of the
highway running east and west, which strip will be co -extensive
with the property of the adjoining school land.
That the tenants on the farm of the Krause estate are
the only persons who use the present road and they use it to
drive into the yard and to drive northward to the Cache la Poudre
Irrigating Ditch. As said strip is also the west boundary of the
Town of Windsor, the Board of Trustees has agree o act jointly on
the vacation of the strip.

THIS AGREEMENT,made and entered into this twenty-sixth day of May,1905 by and between.Wil

WITNESSETH: THAT WHEREAS,a plat of a certain t/vdet of land in the South West quarter of the
south east quarter of section seventeen (17) Township six (6) north,range sixty—seven west,in the
County of held and State of Colorado,designating the same as°AULT'S ADDITION to the Town of WIND-
IOR",was heretofore and on or about the tenth day of May,1904,filed in the office of the Clerk
and P.ecorder of the said County of Weld,containingor purporting to contain a dedication to the
public use,of certain so called streets and alleys in said land,as set forth in said plat,and
WHENEAS,the party of the first part is now the owner and in the possession of the land co=-

The following portions of the said land according to the said plat, shall be kept open for Ilse
as a public highway,to-wit:
A Strip of land adjoining Lot Fifteen,block one,on the west side of said lot,said stri.c a
land commencing at the south line of said Lot Fifteen,as extended,and continuing to the south line
of Lot Sixteen in said Block,as extended,being a strip of land on Second Street,according to sa.ta
plat,forty feet in width by 'Lilo hundred and ten feet in length;
Also the alley in said Block one,according, to said plat.
Also all that portion of First street,according to said plat,commencing at the south line c"
Lot one,Block One as extended and continuing to the south line of Lot Two,Block one as extended,
being a strip of land on said first street,about Thirty—six feet in width by two hundred and ten
feet in length,and the party of the first part hereby remises,releases and quit —claims unto the
parties of the second part,a right of way over said strips of 'and last above described,together
with the alley in said Block No. One for the purposes of obtaining ingress and regress to and
from their said lots.
And the parties of the second part and each of them,hereby release and waive any and all
claim and interest of any and all kinds whatsoever in and to each and every portion of the said
Ault's Addition to the Town Hf Windsor,so called,inoludinp the streets and alleys therein and the
use thereof for any and all purposes,to the party of the party of the first part,except their re—
spective lots therein and the strip of land herein granted by the party of the first part for
highway and other purposes.
This agreement shall be binding on the parties hereto,their heirs,executors,administrators,
executors and assigns.
IN WITNESS WHEEEOF,the parties hereto have hereunto set their hands and seals the day and
year first above written.
