At the regular meeting of the Board of Trustees on February 11, 1998, the Petition for Annexation for Saddle Horn Rock Ranch, was submitted to the Milliken Board of Trustees by the Town Clerk as a communication pursuant to Section 31-12-107(1)(f), C.R.S. The location of the property described in the petition is set forth on Exhibit "A" and Exhibit "B" attached hereto and incorporated herein by reference. 2. The Board of Trustees has reviewed the petition and finds that the requirements set forth in Section 31-12-107(1)(f), C.R.S. have been substantially complied with. 3. Pursuant to Section 31-12-108(1), C.R.S, the Board of Trustees hereby sets the date for the hearing on the annexation petition for March 25, 1998 at 7:00 P.M. at the Milliken Community Complex in the Board Room located at 1101 Broad Street, Milliken, Colorado. Notice of this hearing is to be published in accordance with Section 31-12-108(2), C.R.S. 4. Armstea , Town Clerk qy/939 PETITION FOR ANNEXATION LUCKY THIRTEEN FIRST ANNEXATION TO THE BOARD OF TRUSTEES OF THE TOWN OF MILLIKEN, COLORADO: The undersigned, in accordance with Article 12, Chapter 31, CRS, as amended, hereby petition the Board of Trustees of the Town of Milliken, Colorado, for annexation to the Town of Milliken the unincorporated territiory more particularly described below (Annexation Property), and in support of this Petition, petitioner(s) agree that: (1) It is desireable and necessary that the Annexation Property be annexed to the Town of Milliken, Colorado; (2) Not less than one-sixth (1/6) of the perimeter of the area proposed to be annexed is contiguous with the Town of Milliken, Colorado; (3) A community of interest exists between the Annexation Property and the Town of Milliken, Colorado; (4) The Annexation Property is urban or will be urbanized in the near future; (5) The Annexation Property is integrated or is capable of being integrated with the Town of Milliken, Colorado; (6) The signatures of the Petition comprise one hundred percent (100%) of the landowners of the territory to be included in the area proposed to be annexed and said landowners attesting to the facts and agreeing to the conditions herein contained will negate the necessity of any annexation election; (7) No land held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate: (a) Is divided into serarate parts or parcels without the written consent of the landowner or landowners thereof, unless such tracts or parcels are separated by a dedicated street, road or other public way; (b) Comprising twenty(20) acres or more and which, together with the buildings and improvements situated thereon has an assessed value in excess of Two Hundred Thousand Dollars($200,000) for ad valorem tax purposes for the year preceding the annexation, is included within the territory proposed to be annexed without the written consent of the landowner or landowners. Said tract of land contains 124.23 Acres, more or less, and is subject to any easements or rights of way as granted or reserved by instruments or recorder as now existing on said tract of land. tY/931 STATEMENT OF COMMUNITY NEED FOR THE PROPOSED SADDLE ROCK RANCH ANNEXATION Saddle Rock Ranch Annexation is a 260 acre parcel of land owned by Mr. Franklin Green and is a two phase proposal proposed by the applicant's daughter, Geri Baker. Ms. Baker is a resident of the property proposed for annexation and look forward to enhancing the Town of Milliken with their project. The first phase of this proposal is for approval and zoning of the property. The second phase of this proposal is for a thirty-five (35) to forty (40) rural, large lot (2. 5 acres to 3 . 0 acres) , single family residential subdivision to be developed on the site. The proposed zoning district for the site shall be Agriculture (A) for the lower portion of the property and the single family residential subdivision will be Agricultural Estate (AE) on the bluffs. As Milliken continues to grow, the addition of large, rural type lots with abounding open space could very well make Milliken home for many people seeking that 'hometown' atmosphere. The development of the single family residential lots will not create additional burden upon the current Town of Milliken services. The lots shall utilize on-lot septic systems and the Town of Milliken is preparing to make improvements to the area domestic water system which will enhance the service to this area and also the Town. The addition of this project to the Town of Milliken is anticipated to benefit current and future residents to the area. ANNEXATION IMPACT REPORT NAME OF ADDITION/ANNEXATION: SADDLE HORN ROCK RANCH ANNEXATION, located in Section 2, Township 4 North, Range 67 West of the 6th P.M. , County of Weld, State of Colorado The purpose of this report is to satisfy the requirements of C.R.S. 31-12-108.5, which indicates that a municipality shall prepare an Annexation Impact Report and file a copy of the report with the Board of County Commissioners governing the area proposed to be annexed. Attached to this report are the following: (al) A Map showing the present and proposed boundaries of the Town of Milliken, Colorado in the vicinity of the proposed annexation is attached. (a2) A Map showing present and proposed streets. (a3) The area of the proposed annexation is presently being used for a single family residence, agricultural uses and a majority of the site in vacant land. The petitioner of the proposed annexation intends to develop the property into a single family residential subdivision. (b) There is no pre-annexation agreement between the petitioner and the Town of Milliken at this time. (c) The Town of Milliken plans to extend municipal services into the area of the above referenced annexation. The developer will be responsible for the needed utility extensions and street widening required to serve this development. Currently, the site has Little Thompson Water District water service, Poudre Valley Rural Electric Association electric service and is served by an on-lot septic system. Utility extensions will be required at the developers' expense to serve this site. The area proposed for annexation is served by publicly dedicated streets from the Southern boundary (Ethel Avenue) and an access easement from the Western boundary. Street widening will be required at the developers' expense. Additional utility extensions (natural gas, telephone, cable television, etc. ) will be provided at the developers' expense. -1- 98/ 93 / (d) The Town of Milliken plans to finance municipal services extended to the area will be based upon existing policy which involves Town and developer contribution for street, water, drainage and sewer improvements which are off-site and developer responsibility for all on-site improvements. The developer's plans to finance municipal services extended to the area proposed for annexation will be based upon existing Town of Milliken policy for such matters. The developer will be responsible for all on-site improvements.
