RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION #2524 - CHARLES AND TROY AUER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat
known as Recorded Exemption #2524, does not come within the purview of the definition of the
terms, "subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #2524 was submitted by Charles and
Troy Auer, 9984 East 158th, Brighton, Colorado 80601, for property which is located in part of
the NE% of Section 7, Township 1 North, Range 63 West of the 6th P.M., Weld County,
Colorado, being more particularly described in the plat which shall be provided by the applicant
and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be
approximately 96.56 acres and 34.9 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is,
exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #2524 by Charles
and Troy Auer is approved, conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic
system shall be installed according to the Weld County Individual Sewage
Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. Due to the prime agricultural soils on Lots A and B, the applicant shall
submit a proposed building envelope to the Department of Planning
Services for review. Upon approval by the Department of Planning
Services, the building envelope shall be delineated on the plat.
B. In accordance with Weld County Public Works Ordinance#180, Lots A
and B shall each be granted one residential/agricultural access from
Weld County Road 61. No circle drives or additional accesses shall be
granted. The accesses will be placed in such a location as to have
adequate sight distance in both directions and shall not be placed below
the crest of a hill or where physical obstructions are present. These roads
will be graded and drained to provide all weather access.

C. All approved accesses shall be clearly shown on the plat. The applicant
shall contact the Weld County Public Works Department to determine if a
culvert is necessary at any approved access point. If a drainage culvert
is required, a 15-inch CMP is the County minimum size. If the applicant
chooses to place a larger culvert, please contact the Public Works
Department to adequately size your culvert.
D. Weld County Road 61 is designated on the Transportation Plan Map as a
local gravel road, which requires 60 feet of right-of-way at full build out.
There is presently 60 feet of right-of-way. This road is maintained by
Weld County. The plat shall delineate a total of 30 feet of right-of-way
from the center line of Weld County Road 61.
E. Lot A shall comply with the less than thirty-five (35) acre maximum lot
size required by Section 11.1.2 of the Weld County Subdivision
Ordinance.
F. The following notes shall be placed on the plat:
1) All proposed or existing structures will meet the minimum setback
and offset requirements for the Zone District in which the property
is located. Pursuant to the definition of setback in the Weld
County Zoning Ordinance (Ordinance 89), the required setback is
measured from the future right-of-way line.
2) Should noxious weeds exist on the property or become
established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Ordinance#169-A.
3) Any future structures or uses on site must obtain the appropriate
zoning and building permits.
4) Prior to the issuance of building permits on Lots A and B of the
Recorded Exemption, the applicant for the building permit shall be
required to submit to the Department of Planning Services
evidence that the lots have an adequate water supply of sufficient
quality, quantity, and dependability.
5) Prior to the release of building permits on Lots A or B, the
applicant will be required to submit a recorded deed describing
the lot upon which the building permit is requested with the
building permit application. The legal description on such deed
shall include the lot and Recorded Exemption number.

3. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall
be prepared in accordance with the requirements of Section 11.7 of the Weld
County Subdivision Ordinance. The plat shall be submitted within sixty (60) days
from the date of approval by the Weld County Board of Commissioners. The
applicant shall be responsible for paying the recording fees.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 16th day of August, A.D., 1999.

The Department of Planning Services'staff has reviewed this request and has concerns for the following reasons:
1. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with
Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance, as follows
a. Section 11.4.2.4- Consistency with the purpose of efficient and orderly development as expressed in Section
1.3 of the Weld County Subdivision Ordinance.
1) Section 1.3.1 -Assisting orderly and integrated development The proposed recorded exemption is not
consistent with Weld County's policy of preserving and protecting "Prime" agricultural farmground.
2) Section 1.3.2-Promoting the health, safety, and general welfare of the residents of the County. This
application does not support the general welfare of the County with regard to preservation of viable
agricultural land.
3) Section 1.3.10-Preserving agricultural land and promoting its most productive agrarian use. The most
productive agrarian use on this parcel, crop production, is diminished through the potential loss of prime
farmground.
b. Section 11.4.2.5- Compliance with the recorded exemption standards set forth in Section 11.8 of the Weld
County Subdivision Ordinance.
1) Section 11.8.10- The proposed recorded exemption does evade the statement of purpose as set forth
in Section 1.3 of this Ordinance. As described above, three of the items listed under this provision are
directly challenged by this application.
c. Section 11.4.2.6-Adequate provision for the protection of the health, safety, and welfare of the inhabitants
of the neighborhood and the County.

Should the Board of County Commissioners approve this request, the Department of Planning Services' staff
recommends the following conditions be attached:

SUBJECT: Troy Auer Building Perm
Troy Auer is requesting that the building permit for Lot A of Recorded Exemption-2524 be released.
He contends that the Board of County Commissioners indicated at the hearing for the Recorded
Exemption, that when he submitted the mylar plat that his building permit would be released. RE-
2524 was approved by the Board on August 16, 1999. Mr.Auer submitted the mylar plat on Friday,
August 20, 1999. Generally, a building cannot be released until the mylar is recorded and a
warranty deed is submitted with the correct legal description for the lot of the recorded exemption.
However, the Board of County Commissioners may waive this requirement and the building permit
can be released prior to the recording of the plat and deed. Mr. Auer will still need to submit a copy
of the warranty deed, as soon as it is recorded.

Subject: Recorded Exemption 2524
Dear Commissioners:
Charles and Troy Auer have requested a Recorded Exemption to occur in Part of the Northeast 1/4 of Section
7,Township 1 North, Range 63 West of the 6th P.M. The 130 acre parcel is located South of and adjacent
to State Highway 52,and East of and adjacent to WCR 61. The parcel of land under consideration is the total
contiguous land holdings of the applicant, and is identified as "Prime" agricultural land, according to the
United States Department of Agriculture soils map, and does have an adequate supply of irrigation water.
Based upon submitted information,referral agency responses,and the governing mechanism of the County,
the Department of Planning Services' staff has concerns with this application and requests that the Board of
County Commissioners review the proposed recorded exemption to determine its adequacy with the adopted
governing regulations for Weld County.
Specifically,the applicant is requesting that the County approve a 2-lot recorded exemption which proposes
a Lot A of approximately 35 acres. The site is located within an area designated as"Prime"agricultural land
by the United States Department of Agriculture. Planning staff believes the applicant is compromising the
character of the Agricultural zone through the proposed Recorded Exemption request by separating a large
parcel of viable agricultural ground from an agricultural operation.
Staff has the following concerns:
1. The applicant has not demonstrated that this application is consistent with efficient and orderly
development. Specifically, this application challenges the following standards, goals, and policies:
• Weld County Prime Farmland Definition
"The availability of a consistent supply of clean water must exist in order to have prime farmland. Prime and
prime if irrigated lands fall into upper capability classes as defined by the Soil Conservation Service and
Colorado State University Cooperative Extension Service and should be protected equally if irrigation water
is available and they are located within a reasonable distance of water delivery structures." The subject parcel
does lie within a"Prime"farmground area,as delineated on the United States Department of Agriculture soils
map, and is irrigated.

1. Weld County Comprehensive Plan
A. A. Goal 1. Preserve prime farmland for agricultural purposes which foster the economic
health and continuance of agriculture.
B. A.Policy 1. Agricultural zoning will be established and maintained to protect and promote
the County's agricultural industry. Agricultural zoning is intended to preserve prime
agricultural land and to provide areas for agricultural activities and uses dependent upon
agriculture without the interference of incompatible residential, commercial, and industrial
land uses.
C. A.Goal 4. Provide a mechanism for the division of land which is agriculturally zoned. The
intent of this goal should be to maintain and enhance the highest level of agricultural
productivity in Weld County.
D. A.Policy 4. Applications for the division of land which is zoned agricultural shall be
reviewed in accordance with all potential impacts of the division on the agricultural
community. The criterion shall include but not be limited to:
A.Policy 4.1 Soil Classifications; and
A.Policy 4.1.2 Agricultural productiveness of the site;
E. A.Goal 9. "The minimum lot size of parcels in the Agricultural zone district should remain
at 80 acres to encourage parcels large enough to retain viable farming operations or to
accommodate modern agricultural equipment and irrigation practices. Lots of lesser size are
not generally practical to farm due to large scale management practices existing today."
2. The Weld County Subdivision Ordinance
A. 1.3 Statement of Purpose: The purpose of this Ordinance is to achieve orderly and
efficient development by:
1. Section 1.3.10 The purpose of this Ordinance is to achieve orderly and efficient
development by, "Preserving agricultural land and promoting its most productive
agrarian use."
The Department of Planning Services' staff requests that the Board of County Commissioners consider the
application and determine if the standards of Sections 11.2 through 11.8 of the Weld County Subdivision
Ordinance have been met and adhere to the goals and policies of the Weld County Comprehensive Plan.

Per our visit with you on Friday, July 23, 1999, I am writing this letter to ask for the early
release of our Building Permit. We have filed for our Recorded Exemption and the Planning
Office should have all the appropriate completed forms, along with all applicable fees.
Through careful planning and advice from the farmer who has been farming this land for
close to 10 years, Rich Baumgardner,the both of us decided that the spot chosen on our map
(attached to our Recorded Exemption) would be the best spot to build our house and barn. The
area chosen is what the farmer calls"seep ground"and does not produce the best crop. Mr.
Baumgardner also advised us that this particular area would take the least amount of farmable
acres away from our land.
Hopefully this letter will help clear up a little bit of the confusion and questions that have
arose due to our Recorded Exemption and thus, you will be able to now release the Building

Dear Ms. Daniels:
The purpose of this letter is to request that Weld County to grant an early release of our
building permit.
My father and I recently purchased 130 acres of vacant land in Weld County. We have,
since the purchase of that land, applied for 2 well permits, 2 septic permits and 2 building
permits. Currently, we are in the process of filing for a recorded exemption of 34 acres. We
believe that all of the requirements that Weld County requires have been met. Enclosed please
find a copy of our plot plan showing the reason for our requested 34 acre recorded exemption. I
will try my best to explain our plans as well.
Thirty-four acres will be divided on the west by Weld County Road 61. On the south,
there is a cement ditch that runs direct1_. east. This ditch prohibits any irrigation water that flows
from the far south boundary (which is the 1/4 section line) from reaching the north area of our
property. The east boundary is simply a north\south line that the surveyor provided to be able to
show the 34 acres. We chose the 34 acre area because it is the most logical area to exempt, due
to the 35 acres that was divided prior to 1976, located on the far northwest corner of this 1/4
section. Our plans are to continue to keep this ground in total agriculture, except for a 3 acre
corner in"Lot A" and "Lot B," which will be my primary, as well as my father's permanent
residence.
We have spoke with numerous farmers in the surrounding area about the water situation
with Henrylynn Ditch Water Supply and have concluded that together, my father and I can pool
our shares of the water together, to benefit the areas in which the water is needed most. The 34
acres will be planted in an Alfalfa\Grass mix for harvest. The remaining ground will be in more
productive prime crop.

1) A. The two proposed lots that are being created by this Recorded Exemption are to
be serviced by domestic water wells. Well permits have been applied for, but will
not be approved until the approval of this application. The State of Colorado
Water Resource Department will not issue well permits for a parcel of land until a
legal parcel is created.
B. All irrigation water rights will stay with the land, to continue the agricultural
harvest of this ground. One hundred thirty shares of Henrylynn ditch water are
attached to this ground. Ninety-five shares will remain with Lot"A" and 35
shares of Henrylynn ditch water will go with the 34.90 acres of Lot"B".
2) Sanitary sewer service for both Lots "A" and "B" will be provided by an individual septic
system, which will be constructed in conformance and approved by the Weld County
Health Department.
3) This 130 acre parcel is currently being used for agriculture. Our intentions are to keep the
land this way and that is why we have decided to move to Weld County. The proposed
residential sites are planned out on non-farmable ground. The residential sites, plus two
barns will not take up more than three acres of non-prime farm ground, on each proposed
site.
4) This recorded exemption is being proposed by Chuck and Troy Auer for the sole purpose
of Weld County permits and financial split of purchase of ground.
5) The 130 acre parcel is a part of the north west quarter section of township 1 north, range
63 west. This will be used for agriculture\residential.
6) The proposed Lot "B" is divided on the south end by a cement irrigation ditch which runs
east\west. This cement ditch currently divides the two parcels from irrigation flow.
7) All future buildings will meet setback requirements proposed by Weld County.
8) At this time, the Applicant does not wish to place a conservation easement on the
property.
9) There will be no designated building envelopes on either parcel.
10) This Recorded Exemption is consistent with the Weld County Comprehensive Plan, as no
major changes are being proposed, other than dividing the parcel into two parcels. This
Recorded Exemption is not part of another Recorded Exemption in the past 10 years.

Weld County Zoning Ordinances, as no major changes are being proposed other than

Weld County Public Works Department has reviewed this proposal; the following requirements are recommended
to be a part of any approval:
COMMENTS:
WCR 61 is designated on the Transportation Plan Map as a local gravel road which requires 60 feet of right-of-way
at full build out. There is presently 60 feet of right-of-way This road is maintained by Weld County for
approximately one-half mile north of WCR 76. Pursuant to the definition of SETBACK in the Weld County Zoning
Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-of-way line.
REQUIREMENTS:
The access shall be placed in such a location to have adequate sight distance in both directions and not below the
crest of a hill or where physical obstructions are present. (Lot A, 34 acres)
If a drainage culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a
larger culvert, please contact the Public Works Department to adequately size your culvert.
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the State Highways.
Please contact Gloria Hice-Idler or Tess Jones at the Greeley office to verify the access permit or for any additional
requirements that may be needed to obtain or upgrade the permit. (Lot B, 96 acres)
A building enveloper needs to be identified on the plat for Lot B (96 acres) to provide a residential access to the
parcel.
Direct access from a public road shall be limited to one access per legal parcel for residential, no circle drives. This
policy shall apply to all new and existing accesses within the unincorporated areas of Weld County. Properties
within municipalities or other counties which access Weld County roads are also subject to this policy. (Lot A)

Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation. No
additional accesses shall be granted. (Lot B, 96 acres)
Pursuant to Ordinance 169A, if noxious weeds exist on the property or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds.
