Dear: Mrs. Roberts
We have reviewed your request for a recycling facility. The following items should be noted on
the blueprints at the time building permits are applied for.
1. Floor plans.
2. Engineered structural and engineered foundation design.
I have attempted to reach you at 303-364-0104 and 719-274-4222 to discus the following
concerns. The Uniform Building Code requires that the buildings be at least 20 feet from
property lines or fire -resistive construction is required. 60 feet of clear space must also be
maintained on 3 sides of the buildings to allow 16,000 square feet of floor area. When the
blueprints are reviewed there may be additional requirements. Please call or write our office if
you have any questions.

Dear Mr. Patton:
I have received a copy of the proposed recycling facility plan to be located approximately at US
Highway 85 and WCR 2. A recycling facility is exempt from a certificate of designation under
the solid waste act, C.R.S. 30-20-102(5). The Department will be writing rules during 1999
under the statutory authority to govern certain aspects of recycling. A copy of the draft rule will
be sent to Weld County when it becomes available.
When the Weld County Commissioners make their final determination concerning this USR
please forward a copy of the decision to me at the above address. The Department does not
object to the plan as submitted.

Dear Sir;
The following comments are made in response to the above noted referral review. These comments are
governed by the application of the Uniform Fire Code, and other codes or standards referenced within the
Fire Code, as approved by the Board of Commissioners, Weld County.
1. Type of Storage: As impacting fire potential and development
- The type of materials stored, because of the arrangement and formation, tend to accumulate
large amounts of debris; debris lost from the actual bale itself and debris brought in by
wind and other weather phenomena.
A significant amount of attention, including appropriate fencing and debris protection will
be required to prevent such accumulation.
- Based on the only possible means of storage arrangements, a significant potential for weed
growth exists in and around stored materials.
A significant weed control program will be required to prevent such accumulation and
growth.
- The term length for storage of any one item stored will be important in the ability of the baled
or stored material to survive deterioration due to weather and other handling conditions.
Inventory control and rotation of materials stored will be an important issue in control of
deterioration and accumulation.
- Barrel storage, because of its open void nature in the stored position, will allow significant
accumulation of weeds, trash., and other debris.
Control measures for the development of each of these accumulations as well as rotation
of storage will be significant in the minimization of accumulation.
2. Accessability: As pertaining to emergency vehicle response
- Within the storage area and at a time in which buildings are constructed, fire apparatus must be
able to be located within 150 feet of any materials stored or any point arou
perimeter of any building constructed, moved into, or otherwise located in EXHIBIT
District. I

- The access point for this location, due to the lack of a service road on the west side of
Highway 85, is only accessible from the south bound lanes of the highway and is located
quite close to the intersection of the highway and WCR 2.
Because of this situation, consideration must be given to the limits possibly created and a
second entrance point further north, allowing two entry options.
- The type of materials stored, baled cardboard, plastics, etc., pose a significant fire load (large
and significant combat time requirements for fire control or extinguishment).
Because of the fire load conditions, accessability and the ability to maneuver fire apparatus
once on the property must be readily accomplishable.
3. Water Supply: For fire protection
- This site does not have a water supply provided which will be capable of providing water for
fire protection.
The lack of water supply, water for fire protection, will need to be brought in by tanker
truck. As previously noted, the significance of the fire load potentially will require large
quantities of water to suppress a fire should it grow to any size.
Careful and controlled separation of stored materials will provide means assisting in
limiting the potential growth or size of fires. This is an on-going, and significant
management condition.
4. Potential Hazards: For emergency response and fire protection
- Again as previously noted, the type of materials stored in the baled condition present a
significant fire load potential and because of the open nature of the storage, the potential
for natural and man-created ignition is a high potential.
Significant control of storage, debris accumulation, and man-created ignition sources will
provide assistance in limiting the hazard but the potential for naturally caused ignitions
cannot be readily prevented.
- Storage of barrels, with truly unknown previous contents - non-toxic, toxic, flammable, non-
flammable, continue to present concerns as noted previously but also due to heat
expansion and expanding vapor explosion due to products as benign as water.
Limiting the term of storage, strict control of storage methods, strict acceptance policies
(pertaining to previous contents), and proper venting of the barrels provide some
reduction of potential hazard but again are a significant on-going control and management
condition. Previous content record keeping and separation of storage based on previous
contents will provide some reduction in hazard for emergency responders.
5. Present Status:
- This party has been previously contacted by the Fire District providing storage guidelines and
requirements during the process of seeking permanent authorization of this property for
this type usage. Those recommendations have been carried out on a very limited scale
and total compliance with those guidelines is not nearly complete.
- The Fire District has been contacted on three occasions by neighbors to this site and each
indicated additional accumulation of storage has occurred in the last two months.
Control of the material received and storage of material received does not appear to be
meeting the above noted guidelines or other provisions of the Fire Codes previously noted
to the occupant.
- It appears that a significant increase in the number of barrels and containers of that type has
grow appreciable over the last two month period.

6. Considerations and Recommendations:
- Should this storage be allowed, strict compliance with appropriate Fire Code provisions and
storage guidelines will be essential to maintaining this property within acceptable fire
prevention and control conditions. It is management and enforcement of this strict
compliance condition which may impose a large burden on the Fire District. Without the
compliance and control, out break of fire in this type storage area, with the magnitude and
fire load potential, will present a far greater burden on the suppression forces of the
District. Not to imply that it would have the potential of a"tire mountain" fire, it would
be a difficult and resource consuming fire to control and extinguish.
- Should this storage be allowed, the Fire District recommends this installation exist only
through continuous joint monitoring and management by County and Fire District
functions with revocation of the permit for such usage at the potential recommendation of
those functions. It is further recommended that continuation of the permitted usage be
reviewed on a period of no more than one year basis.

Dear Ben:
Recently the City of Brighton received a referral from Weld County regarding a proposed
recycling facility near Brighton adjacent to Highway 85 (case #USR-1211). The City of
Brighton Planning Department is generally not in favor of this type of operation in this location
and urges you to consider recommending denial of the application.
This area is a highly visible area that functions as the northern "gateway" to Brighton.
There are already some undesirable land uses within the area, and we would not want to see the
continuation or expansion of any land uses that are detrimental to the area. We would suggest
that this type of operation be located away from the Highway 85 corridor. In addition, I do not
believe that there is adequate access to the property and adequate water for fire suppression
would be difficult to provide without connection to a municipal water supply.
If this project is approved, please provide assurances of enforceable conditions that will
assure that the operation has adequate access and fire protection, as well as screening the view
from Highway 85 and providing ample landscaping.
We appreciate the opportunity to comment on this development proposal. We look
forward to working with you on future projects.
