I represent Douglas B. Carter, M.D. concerning the possible
location of the Poudre River Trail along a partial road bed
located between 59th Avenue and 71st Avenue. This roadway has
sometimes been referred to as "Road 62" or "F Street". Other
landowners in the neighborhood which are affected with this issue
include Isabel Silva, Gilbert Boos, Larry Peterson, Harold M.
Russell and Shirley M. Russell, Windon H. Davis and Betsy L.
Davis, William Jeff O'Dell and Stephanie Davis O'Dell, and Gary
J. Miller and Leona M. Miller.
I had Stewart Title Guaranty Company check the real property
records of Weld County to determine what interest, if any, Weld
County may have in the partial roadway which formerly existed
between 59th Avenue and 71st Avenue. The title company was not
able to locate any record interest in the roadway in the clerk's
real property records. However, Bruce Barker, Weld County
Attorney, has furnished me evidence of the County's claim to a
right-of-way for the roadway.
The Weld County Board of County Commissioners ordered that part
of Road 62 ("F Street") between 59th Avenue and 71st Avenue
closed to all traffic and authorized its use only through a
controlled gate for the purpose of maintaining the Number Three
Ditch. The Commissioner's resolution was dated 30 September
1981. The roadway has been closed since that time except for the
maintenance requirements of the Number Three Ditch.

The purpose of this letter is to voice a strong objection to the
location of the Poudre River Trail between 59th Avenue and 71st
Avenue along "F Street". The location of the trail in this area
would be inconsistent with the utilization of the property by the
affected adjacent property owners. The trail, if constructed in
the described area, would pass through the "shooting range" of
the Doug Carter and would virtually pass through the front yard
of Isabel Silva.
The affected local resident owners believe other "natural" areas
are available along the Poudre River which would not interfere
with property owners' use of their land upon which the proposed
Poudre River Trail would be located. A different location would
avoid possible litigation concerning the propriety of the
county's interest in what was formerly a partially developed
roadway between 59th Avenue and 71st Avenue.
A copy of this letter is being sent to the Board of County
Commissioners of Weld County and to the city of Greeley. If the
city of Greeley and/or Weld County are seriously intending to
permit the location of the Poudre River Trail along the area
described in this letter, I would appreciate being given notice
of this intent immediately. The neighborhood residents will
request a hearing before the Board of County Commissioners and
ask that the roadway remain closed except for the maintenance
requirement of the Number Three Ditch.
Your consideration of this strong objection by the local property
owners will be greatly appreciated.
