RESOLUTION
RE: APPROVE VACATION OF SPECIAL REVIEW PERMIT #408 - WALTER AND
VIRGINIA BAILEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated February 27, 1980, the Board did approve Special
Review Permit#408 for a dairy operation for Walter and Virginia Bailey on the following
described real estate, to-wit:
SW% of Section 34, Township 5 North, Range 64
West of the 6th P.M., Weld County, Colorado
WHEREAS, the Board has received a request from Walter and Virginia Bailey, 24482
Weld County Road 55, Kersey, Colorado 80644, to vacate said Special Review Permit#408,
and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Special Review Permit#408 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 11th day of March, A.D., 1998.

SUBJECT: Vacation of SUP-408
The Department of Planning Services has received the attached letter dated February 19, 1998
from Walter and Virginia Bailey. The Baileys are requesting that SUP-408 be vacated since the
dairy is no longer active.
Background Information:
Legal Description: SW1/4 of Section 34, T5N, R64W
Location: East of and adjacent to Weld County Road 55 & north of and adjacent to
Weld County Road 50 - 2 miles southeast of Kersey
SUP-408: Located on 10 acres in the northwest corner of the Baileys property,
SUP-408 was approved by the BOCC on February 27, 1980, for a dairy
operation including a total of 138 milking cows.
The Baileys recently applied for a recorded exemption. Since the dairy is no longer active, one
of the Department of Planning Services' conditions of approval for RE-2156 required the
applicant to vacate SUP-408. This request for vacation of SUP-408 is to satisfy the Department
of Planning Services' condition.
