RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION #1814 - WALTER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1814, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1814 was submitted by Ronald L.
Walter, 20548 Weld County Road 17, Johnstown, Colorado 80534, for property which is described
as Lot B of RE #1168, located in the W'% of the SW'/ of Section 21, Township 4 North, Range 67
West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which
shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
73.5 acres and 1.5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1814 submitted by
Ronald L. Walter be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
2. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
3. Prior to recording the plat, the applicant shall show Lot A on the plat as being
located adjacent to and directly south of the southern boundary of Lot A of
RE #1168.
4. No new accesses shall be allowed to either Lot A or Lot B.

Dear Commissioners:
This application for a recorded exemption in the A (Agricultural) zone district was submitted by
Ronald L. Walter. The parcel of land under consideration is described as Lot B of RE -1168, located
in the W2 of the SW4 of Section 21, T4N, R67W of the 6th P.M., Weld County, Colorado. The
property is located north of and adjacent to Weld County Road 42 and east of and adjacent to 'Weld
County Road 17. This request is to further subdived Lot B of RE -1168 into two lots of 73.5 acres
and 1.5 acres, more or less.
RE -1168 was approved by the Department of Planning Services' staff on April 28, 1989. RE -1168
created two lots of 75 acres and 5 acres, more or less. The applicant is now requesting to divided
the 75 acre parcel into 73.5 acres and 1.5 acres, more or less. The applicant stated in the
application that the reason for the recorded exemption is to allow his father to live on the property
and help farm. Currently, the applicant lives on Lot B. Proposed Lot A was in farm production.
Little Thompson Water District is the current water source for proposed Lot B and is proposed for
Lot A. Access to both proposed lots is existing onto Weld County Road 17. Septic systems sewage
disposal is proposed for Lot A and is existing on Lot B. The property is located in the Urban Growth
Boundary Area of the Towns of Johnstown and Milliken. Both Towns have reviewed this request and
have no conflict of interest. The Weld County Health Department and Public Works Department
have both reviewed this request and have no conflict of interest.
The Department of Planning Services' staff realizes the intent of the Weld County Comprensive Plan
has been met which states that a lot in the A (Agricultural) zone district may be created to allow for
a home for a direct farm family member. The applicants father is wishing to live near his son and

help the applicant farm. Staff does have concerns that the applicants choice in placing the lot is not
manageble or efficient for farming practice. The creation of proposed Lot A will leave a narrow strip
of land between proposed Lot A of RE -1814 and the established Lot A of the orginal recorded
exemption, RE -1168. Staff would encourage the Board of County Commissioners to consider this
request and find an alternative location for Lot A.
The Department of Planning Services' staff requests that the Board of County Commissioners
consider this proposal and determine if the standards of Sections 11.5.1 through 11.5.7 of the Weld
County Subdivsion Ordinance have been met.

does have concerns about the location of the lot with regards to farming
practice. The creation of this lot will leave a narrow strip of farm ground

potential for another recorded exemption.

1. The Environmental Protection Services Division of the Weld County Health
Department was unable to locate a septic permit for the dwelling located
on the larger parcel. Any existing septic system(s) which is not currently
permitted through the Weld County Health Department will require an
I.S.D.S. Evaluation prior to the issuance of the required septic
permit(s). In the event the system(s) is found to be inadequate, the
system(s) must be brought into compliance with current I.S.D.S.
regulations.

This letter is in response to your request for a water service
commitment for 1 residential lot,in the proposed recorded exemption
described as follows:
A PORTIONS OF SEC. 21, T4N, R67W -- Weld County, CO
We currently have a 3" Dia. water line located along the East
side of WCR 17 with additional capacity available Therefore, we
will commit to provide service to this residential lot via one
standard residential 5/8" X 3/4" water tap, with the following
conditions:
1. In August of 1993 the Little Thompson Board implemented a
"system impact" fee of $1000 per lot for all lots to be added
to the system.This is due upon application for the tap.
2. All improvements to District facilities required to
provide service will be the financial responsibility of the
developer in accordance with the District Rules and
Regulations. All improvements must conform to District
Specifications.
This commitment will expire one year from the date of this
letter if the tap has not been purchased and installed by that
date. The current fee for the domestic 5/8" X 3/4" tap is $4,600.00
These fees area subject to change without notice.

Dear Sirs:
Enclosed please find a packet of information for a recopied exemption on
a portion of lard in Section 21, T4N, R67W. This portion of lard being
80 acres.
You will find in this packet a copy of a Power of Attorney authorizing
me to apply for and gain acceptance fromWeld County for a Recopied
Exemption on our family farm. This faro has been in continuous ownership
of the McCarty Family for over 50 years.
My requestmeets the standards set by the Weld County Subdivision
Regulations and complies Weld County Carprelrensive Plan. This lard will
remain agriculture and probably becane more productive than it presently
is which will keep our county the great agricultural county it is.
I propose to split this 80 acres into two lots. Lot A being 5 acres
with the hones+, and outbuildings, and lot B being 75 acres which is
irrigated by the Highland Ditch aid Ish Reservoir.
The purpose of this recorded exemption will serve two purposes:
1.) It will allow us to sell the separated improvements to a
lifetime resident hired employee of our farm who wishes
to retire and live on the farm.
2.) It will allow us to sell a portion of our farm to our
long time tenant farms.
The division lines were chosen in regards to best use and most logical
because of natural lay of land, building locations and irrigation uses.
In regard to utilities, all are in place on lot A. Lot B if developed
mild use Little Thompson Water District with enlargement of the exist-
ing main or drill a well which is permitted by Colorado because it's
over 35 acres. A septic system would have to be used if lot B were to
be developed. This produces no problem because of the size of parcel and
type of soils. It would certainly meet all standards for County Health
requirements. Electric is provided by Union REA and services are at the
road. There is no natural gas presently available so propane would be
used if desired.

As you can see on the enclosed map both lots have road frontage and access
to weld county Road 17. The added traffic would present no problems or
affects to present traffic.
Both lots are in the Johnstown Rural Fire District and should present no
problems to then.
This division would be very compatible with existing properties for several
miles around which consist of many smaller tracts from 2 acres up to 160
plus acre farms, most of the properties all being agricultural minded.
The uses for these lots would remain the same and have no impact on any
existing or future property.
This property is not in any flood plan or any other overlay which Mould
be harmful to the property owner or violate any zoning ordinances.

The Department of Planning Services has determined through the review that

The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and Recorder.
The plat shall be prepared in accordance with the requirements of Section
9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall be
submitted within sixty (60) days from the date of approval by the Department
of Planning Services. The applicant shall be responsible for paying the
recording fees.
