Subject: S -363 -Request for approval of a Site Specific Development Plan and a Amended Minor
Subdivision Final Plat on a parcel of land described as Lot B RE -691, located in the

Dear Sirs:
Your application and related materials for the request described above are complete and in order at
the present time. I have scheduled a meeting with the Weld County Planning Commission for
Thursday, November 3, at 1:30 p.m. This meeting will take place in the Weld County Centennial
Center, 915 Tenth Street, Greeley, Colorado.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying
within three miles of the property in question or if the property under consideration is located within the
comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of
the submitted materials to the City of Greeley, and Towns of Evans and LaSalle Planning
Commissions for their review and comments. Please call the Greeley Planning Department, at 350-
9780, Ken Hammer, in Evans, at 339-5344, and Kathy Ells, in LaSalle, at 284-6931, for information
regarding the date, time and place of these meetings and the review process.
It is recommended that you and/or a representative be in attendance at each of the meetings
described above in order to answer any questions that might arise with respect to your application.
Sometime prior to October 21, 1994 , a representative from the Department of Planning Services will
be out to the property to post a sign adjacent to and visible from a publicly maintained road right-of-
way which identifies the hearing time, date, and location. In the event the property under
consideration is not adjacent to a publicly maintained road right-of-way, one sign will be posted in the
most prominent place on the property and post a second sign at the point at which the driveway
(access drive) intersects a publicly maintained road right-of-way.

The Department of Planning Services' staff will make a recommendation concerning this application to
the Weld County Planning Commission. It is the responsibility of the applicant to contact the
Department of Planning Services office a few days before the date of the hearing to obtain that
recommendation.

LEGAL DESCRIPTION: Part of the SE% NE% of Section 32, T5N, R65W of the 6th P.M.,
Weld County, Colorado.
LOCATION: Northwest of and adjacent to the intersection of Weld County Road 41 and Weld
County Road 50%.
The Department of Planning Services' Staff Recommends that this request be approved for the
following reasons:
1. The submitted materials are in compliance with the application requirements of Section
4.4 of the Weld County Subdivision Ordinance.
2. It is the opinion of the Department of Planning Services' staff that the applicant has
shown compliance with Section 4.5.9 of the Weld County Subdivision Ordinance as
follows:
The proposed Minor Subdivision Final Plat is consistent with the Weld County
Comprehensive Plan.
The proposed minor subdivision will be located in an Urban Growth Boundary
area. The proposal is located within the Urban Growth Boundary area of the City
of Greeley, Town of Evans and the Town of LaSalle.
Definite provision has been made for a public water supply that is sufficient in
terms of quality, quantity, and dependability to the minor subdivision. This includes
fire protection. North Weld County Water District conditionally agrees to provide
service to the proposed development. 950359

Provision has been made for Individual Septic Disposal Systems which will comply
with the State and local laws and regulations in effect. Weld County Health
Department has no conflicts with the request.
No soil or topographical conditions have been identified that present hazards or
require special precautions.
Streets within the minor subdivision as proposed are adequate in functional
classification, width, and structural capacity to meet the traffic requirements of the
minor subdivision.
Off -site streets providing access to the proposed minor subdivision are adequate
in functional classification, width, and structural capacity to meet the traffic
requirements of the minor subdivision.
Construction, maintenance, snow removal, and other matters pertaining to or
affecting the road and rights -of -way for the minor subdivision are the sole
responsibility of the land owners within the minor subdivision.
- The minor subdivision is not part of a minor subdivision previously approved by
Weld County.
- That ingress and egress to all lots within the minor subdivision will be to the
internal road circulation system.
- The facilities providing drainage and storm water management are adequate.
Each lot proposed within the minor subdivision will be at least two and one half
(2%) acres in size.
- The maximum number of lots proposed with the minor subdivision will not exceed
six (6) lots.
- The minor subdivision will not cause an unreasonable burden on the ability of local
governments or districts to provide police and fire protection, or other services.

This recommendation is based, in part , upon a review of the application materials submitted by
the applicant, other relevant information regarding the request, and responses form referral
entities.
The Department of Planning Services' staff recommendation for approval is conditional upon
the following:
1. The following notes shall be placed on the minor subdivision plat prior to recording of the
plat:
The permitted uses within the minor subdivision consist of the E (Estate) uses as
identified in the Weld County Zoning Ordinance and described in the application
materials.
- All lots shall be maintained in compliance with the requirements of the LaSalle fire
protection district.
- Typical road cross section shall be a minimum of two 10 -foot drive lanes with a
minimum of three-foot shoulders on each side with no less than four inches of
gravel surface, adequate barrow ditches on both sides, and 20 -foot radiuses at the
intersections.
- Prior to the issuance of building permits within the minor subdivision for residential
structures:
a. A minimum of one speed limit signs shall be posted on Scotch Pine Drive.
The sign shall be posted for traffic entering the subdivision, no more than
200 feet from the intersection with the county road. The sign shall limit the
speed to no more than 25 miles per hour.
b. Stop sign shall be placed at the access point to control traffic prior to
entering upon Weld County Road 50%.
c. A soils and foundation investigation report prepared by a qualified soils and
foundation engineer shall be submitted with each building permit
application.
- Central Weld County Water District shall provide water to the proposed subdivision
Sewer service shall be provided by individual septic disposal systems approved by
the Weld County Health Department.
The Subdivision shall be served by no less than two Fire Hydranfslnstalled within
the subdivision.

Lots 1,5, and 6 shall not access directly onto Weld County Road 50% and
Weld County Road 41.
All lots shall use only Scotch Pine Court for access. No other access shall
be allowed.
2. Prior to recording the final plat, the location of all fire hydrarsiapproved by the
LaSalle Fire Protection District shall be shown on the plat.
3. Prior to recording the final plat, an improvements agreement shall be approved by
the Board of County Commissioners for all on site improvements. The on site
improvements include, but not be limited to, road improvements, water line
improvements, fire hydrant installation, irrigation ditches, street name signs, traffic
control signs, gas lines, electric service, and "T" post and wire fence.

Thank you for the opportunity to comment on the Jerke minor subdivision final plat.
The City of Greeley Planning Commission reviewed this case at today's meeting and
recommended no objection to the request, noting that 50 feet from the centerline of
both Weld County Road 41 and Weld County Road 501/2 should be reserved for
future arterial roadway use if the proposal is approved by the Board of County
Commissioners.

We have reviewed the above referenced proposal to create 6 single family residential lots
on a 30.78 acre parcel. The domestic water supply is to be from the Central Weld County Water
District and a letter of commitment for service was included. Irrigation water will be supplied from
a well, permit No. 15095-R, decreed in Division 1 Water Court case number W-1563. The well
operates under a contract with the Central Colorado Water Conservancy District, which must remain
in force in order for the well to operate. The current well owner should submit a change of
ownership form to this office. The Union Ditch passes adjacent to the northern boundary of the
property. The ditch company has effected an easement agreement with the applicant to assure the
continued operation of the ditch. We have no objection to the proposal.

After reviewing the proposal submitted by William H. and Charles W. Jerke
for Scotch Pine Estates minor subdivision I have the following
recommendations.
First of all there needs to be at least two fire hydrants installed in
the subdivision. In addition to the hydrant indicated on the plot plan on
Lot #5 an additional hydrant should be placed on Lot 44. This additional
hydrant should be located 500 feet North of the 1/2" rebar at the corner
of Scotch Pine Court and Weld County Road 50 1/2. Hydrants shall be per
La Salle Fire Protection District specs, see attached specifications. All
hydrants shall be free from obstructions a minimum of five feet in all
directions. In the event a driveway is placed near a hydrant it may be
necessary to place protective posts to prevent any vehicle damage to the
hydrant. Parking shall not be permitted within a fifteen foot radius of a
fire hydrant. Hydrants shall be located so that Fire Apparatus can drive
broadside or directly forward to within a distance of not less than six
feet from the pumper outlet of the hydrant. Hydrants shall flow 500
gallons per minute at 20 p.a.i. for 30 minutes to provide minimum fire
protection.
Another item which I feel needs to be addressed is the security of the
existing gas well and tank battery. To prevent vandals from having easy
access to the valves at these locations and to keep small children from
having access to these hazardous areas it may be necessary to place an
eight foot chain link fence around the well head and tank battery.

LA SALLE FIRE PROTECTION DISTRICT
FIRE HYDRANT SPECIFICATIONS
Fire Hydrants shall be installed and maintained so that the center of the
lowest water outlet shall not be less than twelve inches, nor more than
thirty inches from the ground. All hydrants existing and future shall be
free from obstructions a minimum of five feet in all direction°. All
hydrants shall be red in color. All curbing in front of each fire hydrant
shall be painted yellow for a distance of fifteen feat from the center of
the hydrant in both directions. All hydrants shall have three outlets
consisting of two - - two and one-half inch hose outlets and ono - - four
and one-half inch pumper outlet. All threads shall be American National
Fire Hose connection Screw Thread, abbreviated as NH, NST or NS. All
hydrants shall have a one and three -eighth inch pentagon on the stem and
on all caps. All hydrants shall have a shut-off valve located In front of
the hydrant on the water line. Nothing less than a six inch water line
shall be attached to a fire hydrant. Minimum residual pressure of 20
p.s.i. at the fire hydrants shall be required to provide minimum fire
protection.
