RE: ACTION OF BOARD CONCERNING ON-SITE IMPROVEMENTS AGREEMENT
ACCORDING TO POLICY REGARDING COLLATERAL FOR IMPROVEMENTS (PUBLICLY
MAINTAINED ROADS)WITH WEST HILL-N-PARK, INC., FOURTH FILING
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated August 30, 1995, the Board approved a Site Specific
Development Plan and Final Plat Subdivision, S #381, for West Hill-N-Park, Inc., Fourth Filing, on
the following described real estate, to-wit:
Part of the SW% of Section 26,
Township 5 North, Range 66 West of
the 6th P.M., Weld County, Colorado
WHEREAS, pursuant to certain Conditions of Approval in said Resolution, the Board has
been presented with an On-Site Improvements Agreement According to Policy Regarding Collateral
for Improvements (Publicly Maintained Roads) between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, and West Hill-N-Park, Inc., Fourth
Filing, with terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve certain provisions of said
agreement namely, "Evergreen Landscape Buffer", "Parks in 3rd and 4th Filings", and "Playground
Equipment,"as detailed in Comments#1, #2, and#2a in the attached memorandum dated February
27, 1996, to the Board from Todd Hodges, Weld County Department of Planning Services, a copy
of said memorandum being attached hereto and incorporated herein by reference as Exhibit A, and
WHEREAS, certain issues remain to be resolved namely, the "Planting Plan" as detailed in
Comment#2b in the attached memorandum referenced as Exhibit A.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that consideration of the On-Site Improvements Agreement According to Policy
Regarding Collateral for Improvements (Publicly Maintained Roads) between the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, and West
Hill-N-Park, Inc., Fourth Filing, be, and hereby is, continued for consideration of the above mentioned
"Planting Plan" in the attached Exhibit A.

The above and foregoing Resolution was, on motion duly made and seconded, adopted by

MEMORANDUM
WC TO: Board of County Commissioners February 27, 1996

SUBJECT: Letter of Credit, on-site/off-site improvements agreements, submitted by Roy
Lundvall for the Hill-n-Park Fourth Filing (case S-381)
Department of Planning Services, Public Works, and the Attorneys office have reviewed the
submitted items concerning the surety bond, on-site improvements agreement and off-site
improvements agreement for the Hill-n-Park Fourth Filing along with previously submitted
packets. The applicant is indicating that arrangements have been made for a surety bond to be
issued as collateral pursuant to the Improvements agreement. The off-site improvements have
been completed, therefor the improvements agreement for the on-site improvements will be the
focus of Department of Planning Services' comments.
Staff reviewed the most recent submittal of the improvements agreement, submitted on
February 26, 1996 and have the following comments:
1. Evergreen Landscape Buffer- The proposal, dated February 26, 1996, has increased the
number of trees in the buffer from sixteen (16) to thirty-four(34) and states that the trees
shall be six (6) feet tall Austrian pines with a caliper of 1-1/2 to 1-3/4 inches. The proposal
also includes a drip irrigation system to installed at the time of planting and that the
installation of the trees and irrigation system shall be on or before May 1, 1996. Staff
concurs that the proposal of the evergreen buffer does meet the intent of Condition of
Approval number four (4) in the resolution by the Board of County Commissioners for the
West Hill-n-Park Final Plat approval on August 30, 1995. Department of Planning Services'
staff recommends approval of the proposed evergreen landscape buffer, as described in the
February 26, 1996 improvements agreement submittal.
2. Parks in 3rd & 4th filings - The proposal has made some changes pertaining to the parks
located in the Third and Fourth filings of West Hill-n-Park. The parks playground
equipment and landscaping shall be installed on or before May 1, 1996. Staff recommends
that all construction of the parks in the Third and Fourth filings be completed prior to release
of any building permits in the Hill-n-Park Fourth Filing.
a. Playground Eauioment - The proposal has included slides and sandboxes in the two
larger parks in addition to the previously proposed swings, benches, and picnic tables to
be included in the parks. Staff concurs that this proposal meets the requirements of
Condition of Approval number five (5) in the resolution by the Board of County
Commissioners for the West Hill-n-Park Final Plat approval on August 30, 1995.
Department of Planning Services' staff recommends approval of the proposed
playground equipment , as described in the February 26, 1996 improvements
agreement submittal.
b. Planting Plan - The proposal includes a planting plan showing the common names and
locations of the plantings. The proposal indicates that the selection of grass species

has not been changed from the previous proposal. Staff has concerns that the grass
selection and maintenance is not suitable for a park. The grass mixture proposed is a
low impact, bunch type grass that will not survive the potential high impact of a
children play area. Department of Planning Services' staff recommends denial of this
portion of the On-site improvements agreement. Staff recommends that the applicant
submit an appropriate planting plan including information on the proposed maintenance
of the turf areas of the park for Staff review.
Department of Planning Services' staff feels that the above comments are in compliance with
the Board of County Commissioner's resolution for the West Hill-n-Park Fourth filing Final Plat,
approved August 30, 1995.
