HEARING CERTIFICATION DOCKET NO. 98-72 RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT#1201 FOR A DAIRY AND AGRICULTURAL SERVICE ESTABLISHMENT FOR A LIVESTOCK CONFINEMENT OPERATION FOR 6,000 HEAD OF CATTLE IN THE A(AGRICULTURAL) ZONE DISTRICT - MORWAI DAIRY, LLC, c/o JOHN AND ELLEN MOSER A public hearing was conducted on December 16, 1998, at 10:00 a.m., with the following present: Commissioner Constance L. Harbert, Chair Commissioner W. H. Webster, Pro-Tern - EXCUSED Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Julie Chester Health Department representative, Trevor Jiricek Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated November 20, 1998, and duly published November 25, 1998, in the Fort Lupton Press, a public hearing was conducted to consider the request of Morwai Dairy, LLC, % John and Ellen Moser for a Dairy and Agricultural Service Establishment for a Livestock Confinement Operation for 6,000 head of cattle in the A (Agricultural) Zone District. Lee Morrison,Assistant County Attorney, made this a matter of record. Julie Chester, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Chester gave a brief description of the location of the establishment, and stated the application materials are consistent with the Comprehensive Plan and the A (Agricultural) Zone District. She stated the area is very rural and described the surrounding uses. Ms. Chester stated the land is prime farmground if irrigated, and explained the applicants own much of the surrounding agricultural land which will be farmed for feedstuffs and to support waste management. John Moser, applicant, stated the are proposing to have 3,000 milking cows with an additional 3,000 support animals. Bill Wailes, LLC partner, stated the facility will not be able to expand beyond 3,000 milking cows which will be milked three time a day. In response to Commissioners Hall and Baxter, Mr. Wailes stated the facility will receive water from the Central Weld County Water District, and will use both solid and liquid manure applications on farmland. Responding to Commissioner Hall, Mr. Wailes stated the applicant agrees with the Conditions of Approval and Development Standards. Tom Haren, Envirostock, Inc., stated the applicant is very organized, has studied their options, and their application is very thorough. Mr. Haren explained Kaiser-Francis Oil Company, Patina Oil and Gas Corporation, and the applicant are working on an agreement regarding the relocation of flowlines and modification of wellheads; however, it is not yet complete. 982444 CC. Pk- PL1276 HEARING CERTIFICATION - MORWAI DAIRY, LLC, % JOHN AND ELLEN MOSER (USR#1201) PAGE 2 Rebecca Welborn, attorney for Kaiser-Francis Oil Company, stated her client has concern with getting a completed agreement once building begins on the site. She requested approval of the Special Review Permit be postponed until the agreement is finalized. Commissioner Hall clarified there is a Condition of Approval requiring the applicant to enter into the agreement prior to recording the plat. In response to Commissioner Baxter, Ms. Welborn stated she will not be aware of problems until terms of the agreement are reviewed. Mr. Moser stated he has no intention of preventing the oil companies from accessing their wells. Commissioner Kirkmeyer moved to approve the request of Morwai Dairy, LLC, % John and Ellen Moser for a Site Specific Development Plan and Special Review Permit #1201 for a Dairy and Agricultural Service Establishment for a Livestock Confinement Operation for 6,000 head of cattle in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Hall, and it carried unanimously. This Certification was approved on the 21st day of December, 1998.
