The Weld County Council met in regular session in full conformity with the Weld County
Home Rule Charter at the Weld County Centennial Center, 915 10th St., Greeley, CO,
Tuesday, December 16, 1997, 6:30 p.m..
ROLL CALL: The meeting was called to order by President Pam Malcom. Vice
President Judy Curtis, Councilman Ralph Campbell, Councilman Dan Oster, and
Councilman Al Roberts were present, constituting a quorum of the members. Also
present Virginia Foos, Shirley Smith, Jamie Malcom and the Council secretary, Bev
Thomas.
APPROVAL OF MINUTES: Councilman Dan Oster made a motion to approve the
November 18, 1997 meeting minutes. Vice President Judy Curtis seconded the motion
and it was approved unanimously.
ADDITIONS TO THE AGENDA: Councilman Al Roberts added a citizen's concern to
New Business.
APPOINTMENTS: Councilman Al Roberts and Councilman Dan Oster will attend the
Elected Officials Meeting, January 12, 1998. Vice President Judy Curtis will participate
in the January 20, 1998 KFKA "Coffee Break." Councilman Al Roberts will be the
backup participant.
CORRESPONDENCE: The Council reviewed the correspondence. Council members
discussed the Council's budget status as of December 8, 1997 and the Council's 1998
approved budget.
COORDINATOR REPORTS:
Buildings Leased by Weld County
In response to a citizen's request Councilman Roberts reported on the buildings leased
by Weld County as of June, 1997. The Health Department Building is leased for
$113,000. Per year including base rentals, custodial and utilities. Three office suites in
the old Greeley High School (The Greeley Building) are leased for $43,368 per year
including base rentals, custodial and utilities.

BFI Land Fill Problem in Erie Area
President Pam Malcom reported talking with Trevor Jiricek of Weld County
Environmental Services regarding Weld County's responsibilities in regulating the trash
at the BFI land fill in the Erie area. She learned that trash had to be covered within 24
hours with dirt, foam, plastic, or other covering to keep the trash in place. However, if
the wind is sustained at 40 mph with gusts up to 50 mph, the facility must cease
operations and cover. The Town of Erie has contracted with the Weld County Health
Department to monitor and take complaints about the landfill, and Mr. Jiricek has had
no citizen complaints on record about blowing trash.
Councilman Ralph Campbell suggested that if blowing trash is observed it should be
documented with photographs and possibly with facts about the wind rates
corresponding to the photographs. Councilman Roberts said that he would continue to
check on coverage and blowing trash at the landfill.
Councilman Dan Oster questioned the high mph of wind rates stated in the regulation
Mr. Jiricek quoted to President Malcom. President Malcom said that she would verify
what regulations Mr. Jiricek was quoting. Mrs. Malcom noted that the BFI has been
approved for use for 20 years, and the nearby landfill has been approved for expansion.
The future of trash and trash disposal in Weld County was discussed.
Sherwood Village Project and Repealing MUD
Councilman Ralph Campbell reported that Weld County government was asked by
certain individuals to expand the MUD to include their property. These same individuals
are now wanting to do away with the MUD. He said that this fact had influenced the
extent of his information-gathering about repealing the MUD.
Councilman Campbell also reported that Weld County personnel had spent a lot of time
negotiating with the developers of Sherwood Village and the project had already been
down sized from its original projected size.
Councilman Roberts corrected Councilman Campbell's report about Sherwood Village
because Mr. Roberts felt that Mr. Campbell's report was a description of Long View
Estates. Councilman Ralph Campbell said that he would check again and clarify this
issue.
Councilman Campbell pointed out action being taken by Weld County citizens in the Del
Camino MUD area and the Commissioners. He summarized these actions as
documented in the November 24, 1997 Commissioners' minutes and the
Commissioners' December 15, 1997 work session notes. Mr. Campbell stated that the
County's planning process is working with citizens who are expressing their concerns.
Councilman Campbell felt that the County Council should not be involved in this

process when constructive dialogue is occurring between citizens and the appropriate
County personnel.
Recorded Exemptions for Farms
Councilman Ralph Campbell told about a situation in the Hudson area in which five
acres of farm land had been put up for sale by a farmer with no notice given to the
neighbors. Mr. Campbell questioned how five acres of farm land could be sold without
a County hearing being held. He thought that neighbors should be notified in all such
cases.
Council members discussed many possible variations in the implementation of recorded
exemptions. Councilman Campbell requested that the recorded exemption hearing
process be explained at the January, 1998 Weld County Council meeting. The Council
agreed to request a speaker from Weld County Planning and Zoning regarding
recorded exemptions for farms. Councilman Campbell will contact Monica-Daniels Mika
about a speaker.
Virginia Foos suggested that an attorney or a farm real estate agent also be at the
meeting.
Weld County's "Returned" Vehicle Parts
Councilman Dan Oster gave a report to the Council summarizing his initial research into
the arrangement whereby County vehicles are maintained by a private firm.
Councilman Oster reported that T-Com had contracted to do Weld County's
maintenance work for the past sixteen years. T-Com uses the County's building and the
County's equipment. T-Com's arrangement is that its contract is to do the labor only so
there is no up-charge to the County on the parts that are used.
Councilman Oster stated that he was impressed with the way the company operates
and Pete Baker who is in charge of the Greeley operation. Mr. Oster plans to continue
to gather information on the maintenance contract.
UNFINISHED BUSINESS:
Health Department Abstinence-Based Education Grant
President Pam Malcom said this topic would be carried forward to the next meeting as
she had been unable to discuss it with Mr. Pickle.
Receiving Minutes of the Weld County Finance Corporation
Councilman Al Roberts suggested that the Council request to receive a copy of the
minutes of the Weld County Finance Corporation when its meetings occur. The
relationship of this request to the Council's August 29, 1997 letter to the Commissioners

was noted. It was decided that Vice President Judy Curtis will make a telephone call to
Commissioner Baxter to follow up on the August 29, 1997 Council letter to the Weld
County Commissioners. In addition to the items mentioned in the letter, she will request
minutes of the Weld County Finance Corporation. Councilman Campbell spoke about
fostering a cordial relationship with the Commissioners in the best interest of Weld
County.
NEW BUSINESS:
Payment of the Bills
Councilman Ralph Campbell made a motion to pay the following bills:

Mileage for Vice President Judy Curtis $23.22
Mileage for Councilman Dan Oster $ 7.56
Mileage for Councilman Al Roberts $14.04
Councilman Dan Oster seconded the motion and it carried unanimously.
January 1998 Council Meeting Time and Place
Councilman Campbell made a motion that the January, 1998 Council meeting be held
on the third Tuesday of January (January 20, 1998) at 6:30 pm in the first floor meeting
room in Weld County's Centennial Center. Councilman Oster seconded the motion and
it carried unanimously.
Times and Locations of 1998 Council Meetings
The Council discussed the times and locations of its 1998 Council meetings. It was
decided that the following members would be responsible for the topics and speakers
of Council meetings at the proposed locations on the proposed dates.
Councilman Al Roberts: Erie April 21, 1998 (alternative- Firestone)
Councilman Dan Oster: Severance May 19, 1998
Vice President Judy Curtis: Nunn June 16, 1998
Vice President Judy Curtis: Galeton July 21, 1998
President Pam Malcom: Milliken August 18, 1998
Councilman Ralph Campbell Hudson September 15, 1998
Council secretary Bev Thomas will contact the proposed towns and confirm a meeting
schedule based on these suggestions. A resolution regarding the times and locations
of the 1998 Council meetings will be prepared based on the confirmed schedule.
Colorado Revised Statutes on CD Rom
The availability of Colorado Revised Statutes on CD Rom to the Weld County Council
was discussed. Council secretary Bev Thomas was instructed to find out if Colorado
Revised Statutes on CD Rom are available in the Centennial Center or at the Weld

County Library. Also, will Weld County personnel research and print out a document for
the Weld County Council?
Beet Dump Problem
Councilman Al Roberts reported he had been contacted about violation of a special use
permit for a beet dump across from a citizen's home. Councilman Roberts has
contacted County personnel about the violation and he will monitor the problem-
resolution.
Secretarial Research Requests
Councilman Campbell requested a copy of the revised land and resource management
plan for the Pawnee National Grasslands. Vice President Judy Curtis already has a
copy and Bev Thomas will get a copy of the document for Councilman Campbell and

PUBLIC COMMENT:
Social Services Concerns
Virginia Foos and Shirley Smith shared their concerns about problems with the Social
Services Grievance Board. Council members discussed the citizens' concerns and the
possibility of holding a public meeting on the topic. President Pam Malcom said that
the Council would have to research whether this matter was within the jurisdiction of the
Weld County Council according to the Home Rule Charter. President Malcom said that
she would check where the State and the County intermesh in social services. Vice
President Judy Curtis and Councilman Dan Oster will ask legal advise about the
jurisdiction. The Council requested that Mrs. Foos provide the Council with the
Colorado Legislative Bill number that provides for Social Services Grievance Boards.

County, Colorado, to report to the people the events that have shaped the
previous quarter. This report summarizes the activities of the Weld County
Council during the fourth quarter of the calendar year 1997.
October 21, 1997 Council Meeting - Weld County Centennial Center
• Councilman Dan Oster reported that a weed ordinance to control weeds that
create blind intersections on County Roads was not an option. By state law it is
the responsibility of the County to keep down the weeds on property that it has
right-of-way to or owns. Other alternatives (giving an incentive to
farmers/landowners to keep the weeds down or working with the West Greeley
Soil Conservation Board to come up with a solution) were discussed.
• Vice President Judy Curtis reported that Weld County Health Department
personnel would be checking on the paunch being disbursed on private land in
the Briggsdale area to verify that it is in compliance with the County nuisance
regulation against flies and odor.
• President Pam Malcom gave a report about the land fill problems in the Erie
area. She said that it was the responsibility of the landfill owner to turn in water
samples to the State of Colorado on a regular basis. The problem of illegal
dumping of trash in Weld County was also discussed.
• The Council adopted Resolution 115 RE: Conflict of Interest -Trevor Jiricek, Jeff
Stoll, and Laurie Exby.
• Citizens expressed their concerns on the following topics:
High density module housing in south west Weld County
The density impact on traffic in the area and on prime agricultural land
Proper use of Weld County's zoning laws
The need for information about how to repeal the MUD in south west Weld County
The impact of Sherwood Village on the agricultural community
The need to protect open space in Weld County
The lack of representation from south west Weld County on Weld County's
Planning Commission
The need for information about how to add another slot to the Planning Commission
to represent south west Weld County
The impact of growth on Greeley's odor complaints
The number of vagrants using the Poudre Trail and the money being spent on the trail
The possibility of a new correction facility in Weld County
The possibility of the City of Greeley's police force helping to man the Weld County jail.
November 18, 1997
• Vice President Judy Curtis represented the Council as a participant on KFKA's
Coffee Break talk show.
November 18, 1997 Council Meeting - Weld County Centennial Center
• President Pam Malcom agreed to discuss with Weld County Health Department
Director the possibility of sending a letter to the state health department from the
Council President, or from individual Council members, in support of the
abstinence-based education program grant that the Health Department hopes to
receive.

• Councilman Ralph Campbell reported positive resolution to a constituent's
problem moving a modular on to his property. Councilman Campbell was
impressed with the great help received from Weld County's Planning Department
in resolving the problem.
• Councilman Dan Oster gave a report about the Weld County CSU Cooperative
Extension Service. He urged the Council to have a representative at the
Extension Office's Advisory Board meeting every two months.
• In response to a citizen's request the Council decided that Councilman Dan
Oster would check on the returned vehicle parts policy of the company that
contracts with Weld County for vehicle maintenance.
• The Council closed a months-long investigation by adopting Resolution 116
(Conflict of Interest - Officers Weld County Finance Corporation: Don Warden,
President; Pat Persichino, Vice President; and Bruce Barker, Secretary) and
Resolution 117 (Legality of the Weld County Finance Corporation.)
• Sharon Hopper expressed her shock that Resolutions 116 and 117 were
adopted by the Council. She felt that it was not clear what the Council had done
regarding citizens' concerns about the Weld County Finance Corporation. She
requested the Council hold its meetings at 7:30 p.m. so citizens would have
greater opportunity to attend the meetings.
• Councilman Ralph Campbell pointed out that Resolutions 116 and 117 were
designed to follow a logical sequence based on Colorado Revised Statutes and
the Weld County Home Rule Charter. He said that the resolutions included
quotations from those documents.

in the County. The times and locations of the 1998 Council meetings would be
finalized at the January 1998 meeting after meeting places had been reserved.
• Councilman Al Roberts reported he had been contacted about violation of a

Roberts has contacted County personnel about the violation and he will monitor
the problem-resolution.

jurisdiction and get legal advise about it.
During the fourth quarter of 1997, Council members have researched answers to
questions and concerns brought to their attention by citizens of Weld County. In that
process Council members have talked periodically with the Commissioners and various
Elected Officials and Department Heads.
This report is not meant to be an exclusive enumeration of the activities entered into by
the Council. It is, however, an attempt to communicate with the voters regarding its
activities. The County Council believes that the Weld County Home Rule Charter
continues to be a viable tool for the citizens of Weld County.
