THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST
BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 28.9
of the Weld County Zoning Ordinance, as amended.
2. The request is in conformance with Section 28.13 of the Weld County Zoning Ordinance, as
amended as follows:
A. The proposed P.U.D. Final Plan, 1st Filing is consistent with the Weld County
Comprehensive Plan. The attached conditions of approval shall make the development
compatible with current and future development in the area, and shall be compatible with
the future development as permitted by the existing P.U.D. District and plans of affected
municipalities. The City of Longmont, Town of Mead and the Tri-Area Planning
Commission have all reviewed this request.
B. The P.U.D. plan shall maintain compliance with the existing zoning on the subject
property. Any development occurring on the subject property shall require the review and
approval of a Site Plan Review, which will be subject to all applicable standards, including
Ordinance 191 when in effect. The Utility Coordinating Advisory Committee reviewed
and conditionally approved the P.U.D. utility plan at the October 24, 1996 meeting. the
concerns of the Utility Coordinating Advisory Committee are addressed in the Conditions
of Approval.
C. The uses, buildings, and structures shall be compatible with the existing and future
development of the surrounding areas as permitted by the existing zoning and Site Plan
Review requirements.

D. The proposed P.U.D. Final Plan, 1st Filing conforms with the performance standards
in Section 35.3 of the Weld County Zoning Ordinance, as amended.
E. The proposed P.U.D. Final Plan, 1st Filing will be in compliance with the Weld County
Zoning Ordinance, Section 50, Overlay Districts. The site is not located within any of the
Overlay Districts.
This recommendation is based, in part, upon a review of the application materials submitted by
the applicant, other relevant information regarding this request, and responses from referral
entities.
The Department of Planning Services' staff recommendation for approval is conditional upon the
following:
1. Prior to recording the P.U.D. Final Plan, 1st Filing plat:
A. The Board of County Commissioners shall review and approve the subdivision
agreements for off -site and on -site improvements and the form of collateral for the 1st
Filing of the Vista Commercial Center P.U.D. The security for the agreement shall be
tendered and accepted by the Board of County Commissioners for the subdivision
improvements agreement.
B. The applicant shall submit evidence to the Department of Planning Services that the
proposed fire protection system will meet the standards of the Mountain View Fire
Protection District.
C. The P.U.D. Final Plan, 1st Filing shall be amended to comply with the conditions of
approval by the Weld County Utility Advisory Committee in the October 24, 1996 meeting.
The conditions of approval are:
(1) A fifteen (15) foot perimeter utility easement shall be placed on the plat with
the exception to the south section that runs parallel to the landfill.
(2) A fifteen (15) foot utility easement shall be placed on the plat on the west
portion of the south property line.
(3) The applicant shall have the option of a ten (10) foot utility easement to be
placed on the plat of outlot areas showing a five (5) foot utility easement or a
fifteen (15) foot utility easement shall be placed on the plat within the outlot areas.
(4) A fifteen (15) foot utility easement shall be placed on the plat on both sides of
the internal road systems.
(5) The applicant shall have the option on the north property line of an additional
ten (10) foot utility easement to be placed on the property line or a fifteen (15) foot
utility easement shall be placed within the greenbelt area.

D. The applicant shall submit evidence to the Department of Planning Services that
agreements for service provision have been made with water and sewer providers.
E. The applicant shall submit a signed copy of an improvements, maintenance and repair
agreement with the City of Longmont. The agreement shall address the eastern access
of this P.U.D. plan from State Highway 119. This agreement shall not be required if Weld
County accepts the eastern access for maintenance.
F. The submitted dimensions of the proposed signage and setbacks shall be amended to
remain in compliance with Section 42.3 of the Weld County Zoning Ordinance, as
amended.
2. The following notes shall be placed on the P.U.D. Final Plan, 1st Filing plat prior to recording:
A. The uses permitted within the P.U.D. Final Plan, 1st Filing for the Vista Commercial
Center, include 38 lots for I-1 and C-3 uses which comply with the P.U.D. zone district
requirements and as described in the application materials.
B. Approval of this plan may create a vested property right pursuant to Section 90 of the
Weld County Zoning Ordinance, as amended.
C. Left Hand Water District shall provide domestic water service to all uses within the
P.U.D. Zone District.
D. St. Vrain Sanitation District shall provide sewage disposal to all uses within the P.U.D.
Zone District.
E. Installation of all utilities shall comply with Section 10, Design Standards, of the Weld
County Subdivision Ordinance, as amended.
F. All uses within the P.U.D. Final Plan, 1st Filing shall comply with the requirements of
the Mountain View Fire Protection District.
G. Access to the development shall be from a primary access on WCR 3.5, and an
existing secondary access on WCR 5.
H. All uses within the P.U.D. Final Plan, 1st Filing shall maintain compliance at all times
with the Department of Army, Corps of Engineers requirements and standards.
I. Street signs and lot identification shall be in place prior to the release of building
permits.
J. Exterior illumination of structures and lots shall be restricted as follows:
(1) Sources of light shall be shielded so that beams of light will not shine directly
onto adjacent properties.

(2) Neither the direct or reflected light from any light source may create a traffic
hazard to operators of motor vehicles on public or private streets.
K. All liquid and solid wastes shall be stored and removed for final disposal in a manner
that protects against surface and groundwater contamination.
L. No permanent disposal of wastes shall be permitted at this site.
M. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions.
N. Fugitive dust shall be controlled on this site.
O. Landscaping, including but not limited to trees, shrubs, fencing, and entry signs or
walls will not be allowed within the 180 foot right-of-way of State Highway 119.
P. The uses within the P.U.D. Final Plan, 1st Filing shall maintain compliance at all times
with the Colorado Division of Water Resources requirements and standards.
Q. Uses in the P.U.D. District involving outdoor storage of vehicles, equipment or
materials shall be screened from State Highway 119.
R. Any future filing of this development shall adhere to all applicable standards of
Ordinance 191 when in effect.
S. All development shall be subject to the requirements of the change of zone, as
approved April 1, 1992 by the Board of County Commissioners.
3. Prior to the issuance of each building permit, the Architectural Control Committee shall
provide a letter to the Department of Planning Services indicating its approval of the proposed
structure.
4. The applicant shall comply with the requirements listed in the memorandum from Don Carroll,
Department of Public Works dated October 11, 1996.
5. The applicant shall comply with all requirements and standards of the Colorado Department of
Transportation.
6. Prior to any proposed development of any lot within the 1st Filing of the Vista Commercial
Center, a Site Plan Review application must be submitted, reviewed, approved and all conditions
met for the proposed development, in accordance with Section 35.4 of the Weld County Zoning
Ordinance, as amended.
7. All signage and setbacks for the 1st Filing of the development shall remain in compliance with
Section 42.3 of the Weld County Zoning Ordinance, as amended.

To Whom It May Concern,
As Community Managers of Long View, situated at the Northwest corner of Hwy. 119
and Weld County Road 3 1/2, we have some concerns about the proposed Commercial
Center that is being planned directly across the sweet from our Community.
Our first and main concern is in regards to the additional traffic at the intersection of Hwy.
119 and WCR 3 1/2. This is the only entrance to our Community and as you know the speed
limit along Hwy. 119 is 55 miles per hour. There has already been a serious traffic accident
at this intersection, and with increased traffic entering and exiting the commercial center, we
can foresee future problems. The safety of ow residents is our first and primary concern,
especially with several school buses entering our Community each day.
We are also concerned about the use of the commercial property. We understand the
zoning of the property would permit automobile repair shops and businesses like that to be
allowed. We are concerned about the noise, pollution and appearance of such businesses.
We also believe the size of the sign proposed - 40 feet long - is too large for this area.
The location along Hwy. 119 does not wan -ant a sign of that size, and would certainly
distract from the rural residential nature of the neighborhood.
Our last concern is about the future value of our resident's homes in our Community.
When fully developed, we will be a community of 401 homes. With commercial property
going in around us, we are very concerned as to the use of the property and the long term
affect it will have on the home values.

In response to your request and in accordance with Senate Bill 35 (1972) I visited this property
to review the plat. A Preliminary Geotechnical Engineering Report prepared by Terracon
(December 1995) was included in the submittal. My comments are summarized below.
1) Soil. Soil at the site consists of windblown sediment and residuum of the Pierre Shale. The
composition is largely clay with varying amounts of silt and sand.. Bedrock, which is described
as sandstone, is present at depths ranging from 1.5 to 13.5 feet below ground surface. In this
preliminary investigation, Terracon performed five swell/consolidation tests that indicate that the
subsurface material has low swell potential but some capacity for hydrocompaction. Under these
circumstances, Terracon's initial foundation recommendations of spread footings and straight shaft
piers are appropriate, but foundation type should be finalized only after soil from each building
envelope is analyzed. Five samples are too few to form a generalization concerning
swell/consolidation properties. These characteristics should also be considered a factor in road
design, as post -pavement settling or swell will add to maintenance costs.
The shallow bedrock will make excavation a bit more difficult where it is encountered, but the
weathered nature of the rock should somewhat reduce the problem.
2) Groundwater was present in eight of the 19 borings drilled, and possibly would have been
found in other borings if the depths had been extended. In fact, as the subsurface investigation
was performed in December, which is a dry time of year, it is almost certain that spring and
summer precipitation will cause groundwater levels to rise, as will lawn irrigation and reduced
evaporation due to paved areas.

Although the proposed site development is commercial/industrial and therefore, not likely to
include conventional basements, it is possible that some garden level offices will be planned. In
these cases, the builder should definitely consider foundation drains in the building design. Water
is the catalyst for soil expansion and consolidation, and therefore foundations should remain as
dry as possible. Pumps for dewatering should be available during construction, as noted in the
geotechnical report.
3) Grading. The area near the abandoned silo in the north -central part of the property is covered
with alluvial fill material that will need considerable grading and homogenization to form a
suitable construction subgrade. On a non -geologic note, future occupants may appreciate an
effort to retain the mature trees in this area. This is pretty shadeless landscape.
In summary, there are no geologic conditions that would prevent development of the site, but the
recommendations in the geotechnical report should be followed and groundwater mitigation
strategies should be planned. Please contact me if I can be of further assistance.

Notes:
Attached is the preliminary recommendation from our department. There were questions brought
up by staff regarding the sanitary sewer provisions and the public water. A note in the original
sketch plan suggested that the E2 of the site could be provided for (which is fine since we are
considering Phase 1), however, I cannot find any documentation regarding the water service.
If you have any documentation you can provide, I will go ahead and include it as such when we
go to the Planning Commission hearing. Otherwise, the recommendation should be pretty
understandable. If you should have any questions, I can be reached at the above telephone
number.

THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST
BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 28.9
of the Weld County Zoning Ordinance, as amended.
2. The request is in conformance with Section 28.13 of the Weld County Zoning Ordinance, as
amended as follows:
A. The proposed P.U.D. Final Plan, 1st Filing is consistent with the Weld County
Comprehensive Plan and is compatible with the future development as permitted by the
existing P.U.D. District and plans of affected municipalities. The City of Longmont, Town
of Mead and the Tri-Area Planning Commission have all reviewed this request.
B. The P.U.D. plan conforms to the existing zoning on the subject property. The Utility
Coordinating Advisory Committee reviewed and conditionally approved the P.U.D. utility
plan at the October 24, 1996 meeting. the concerns of the Utility Coordinating Advisory
Committee are addressed in the Conditions of Approval.
C. The uses, buildings, and structures shall be compatible with the existing and future
development of the surrounding areas as permitted by the existing zoning and Site Plan
Review requirements.
D. The proposed P.U.D. Final Plan, 1st Filing conforms with the performance standards
in Section 35.3 of the Weld County Zoning Ordinance, as amended.

E. The proposed P.U.D. Final Plan, 1st Filing will be in compliance with the Weld County
Zoning Ordinance, Section 50, Overlay Districts. The site is not located within any of the
Overlay Districts.
This recommendation is based, in part, upon a review of the application materials submitted by
the applicant, other relevant information regarding this request, and responses from referral
entities.
The Department of Planning Services' staff recommendation for approval is conditional upon the
following:
1. Prior to recording the P.U.D. Final Plan, 1st Filing plat:
A. The Board of County Commissioners shall review and approve the subdivision
agreements for off -site and on -site improvements and the form of collateral. The security
for the agreement shall be tendered and accepted by the Board of County
Commissioners for the subdivision improvements agreement.
B. The applicant shall submit evidence to the Department of Planning Services that the
proposed fire protection system will meet the standards of the Mountain View Fire
Protection District.
C. The P.U.D. Final Plan, 1st Filing shall be amended to comply with the conditions of
approval by the Weld County Utility Advisory Committee in the October 24, 1996 meeting.
The conditions of approval are:
(1) A fifteen (15) foot perimeter utility easement shall be placed on the plat with
the exception to the south section that runs parallel to the landfill.
(2) A fifteen (15) foot utility easement shall be placed on the plat on the west
portion of the south property line.
(3) The applicant shall have the option of a ten (10) foot utility easement to be
placed on the plat of outlot areas showing a five (5) foot utility easement or a
fifteen (15) foot utility easement shall be placed on the plat within the outlot areas.
(4) A fifteen (15) foot utility easement shall be placed on the plat on both sides of
the internal road systems.
(5) The applicant shall have the option on the north property line of an additional
ten (10) foot utility easement to be placed on the property line or a fifteen (15) foot
utility easement shall be placed within the greenbelt area.
D. The applicant shall submit evidence to the Department of Planning Services that
agreements for service provision have been made with water and sewer providers.

A. The uses permitted within the P.U.D. Final Plan, 1st Filing for the Vista Commercial
Center, include 38 lots for I-1 and C-3 uses which comply with the P.U.D. zone district
requirements and as described in the application materials.
B. Approval of this plan may create a vested property right pursuant to Section 90 of the
Weld County Zoning Ordinance, as amended.
C. Left Hand Water District shall provide domestic water service to all uses within the
P.U.D. Zone District.
D. St. Vrain Sanitation District shall provide sewage disposal to all uses within the P.U.D.
Zone District.
E. Installation of all utilities shall comply with Section 10, Design Standards, of the Weld
County Subdivision Ordinance, as amended.
F. All uses within the P.U.D. Final Plan, 1st Filing shall comply with the requirements of
the Mountain View Fire Protection District.
G. Access to the development shall be from a primary access on WCR 3.5, and an
existing secondary access on WCR 5.
H. All uses within the P.U.D. Final Plan, 1st Filing shall maintain compliance at all times
with the Department of Army, Corps of Engineers requirements and standards.
I. Street signs and lot identification shall be in place prior to the release of building
permits.
J. Exterior illumination of homes, yards, garages and driveways shall be restricted as
follows:
(1) Sources of light shall be shielded so that beams of light will not shine directly
onto adjacent properties.
(2) Neither the direct or reflected light from any light source may create a traffic
hazard to operators of motor vehicles on public or private streets.
K. All liquid and solid wastes shall be stored and removed for final disposal in a manner
that protects against surface and groundwater contamination.
L. No permanent disposal of wastes shall be permitted at this site.
M. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions.
N. Fugitive dust shall be controlled on this site.

O. Landscaping, including but not limited to trees, shrubs, fencing, and entry signs or
walls will not be allowed within the 100 foot right-of-way of State Highway 119.
P. The uses within the P.U.D. Final Plan, 1st Filing shall maintain compliance at all times
with the Colorado Division of Water Resources requirements and standards.
3. Prior to the issuance of each building permit, the Architectural Control Committee shall
provide a letter to the Department of Planning Services indicating its approval of the proposed
structure.
4. The applicant shall comply with the requirements listed in the memorandum from Don Carroll,
Department of Public Works dated October 11, 1996.
5. The applicant shall comply with all requirements and standards of the Colorado Department of
Transportation.
6. Prior to any proposed development of any lot within the 1st Filing of the Vista Commercial
Center, a Site Plan Review application must be submitted, reviewed, approved and all conditions
met for the proposed development.

I am writing this letter in regard to the utility locations for a PUD called Vista Commercial
Center, formerly known as Richardson PUD. Horizon Limited, the owner, and I met with
the Weld County Utility Board on October 24, 1996 and they requested that this
subdivision be congruent with Weld County Easement Ordinances. Ordinance 10.6.1 and
10.6.2 state that there shall be a 15 foot easement along all right-of-ways and boundary
lines as well as a 10 foot, 20 foot total, easement along all side and rear lot lines.
Horizon Limited wishes to build the infrastructure of this PUD only. The current plat
configuration only suggests the minimum lot size and the layout is intended to allow an
organization to buy one or more lots for their facilities. If we were to have utilities along
every lot line, and an organi7ation wanted two adjacent lots, a utility line could split the
property and may need to be relocated for optimum use of the site. We need to avoid this
situation.
Included are drawings of the site and of the `Utility Location Detail Section'. To the
north is US Highway 119, to the south is the city of Longmont landfill, to the east are two
properties already being served by utilities, then the St. Vrain River ,and finally to the west
is the second phase of Vista Commercial Center. Due to the isolation of Vista
Commercial Center there is no need for the continuance of any utility beyond this site.
Therefore, we would like all utilities to be placed in a 15 foot easement along the road
ROW with designated areas available to loop any utility. If this utility location does not
work with your engineered service, please provide the engineering calculations and
renderings so that we can allot easements to sustain congruent conveyance for the utility.
An example of the situation in question is, if an organi7ation was to buy lots 1, 2, and 15
of Block 2. According to current County ordinance these lots would be split by easements
which would need to be vacated, and any utility located on the border of these lots would
need to be relocated. As you can see, the placement of utilities along the front of each lot
would eliminate any confines due to utilities.

In the Subdivision Regulations, any lot (or lots) owners will have to go through an
approval process. At this time the 10 foot side and rear easements may be dedicated.
This would ultimately provide the 20 foot total easement required by the County.
I would like a letter from you on letter head stating that you 'can provide service to the
site in the designated easements along all rights -of -ways and boundary lines according to
the Utility Location Detail Section for Vista Commercial Center.' This would help us to
gain approval for this PUD and keep the properties use and availability intended by the
Owners.

Your application and related materials for the request described above are complete and in order at the present time. I have
scheduled a meeting with the Weld County Planning Commission for Tuesday, November 19, 1996, at 1:30 p.m. This
meeting will take place in the Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado. In addition, I have
scheduled a hearing for this request with the Weld County Utilities Advisory Committee for Thursday, October 24, 1996, at
10:00 a.m. This meeting will take place in the Weld County Administrative Offices, 1400 N. 17th Avenue, Greeley,

It is the policy of Weld County to refer an application of this nature to any town or municipality lying within three miles of the
property in question or if the property under consideration is located within the comprehensive planning area of a town or
municipality. Therefore, our office has forwarded a copy of the submitted materials to the Tri-Area Planning Commission,

The Vista Commercial Center is a new development for light commercial and industrial

indicated as Phase I, as it is the only portion to be constructed at this time

Dear Mr. Boyes:
We appreciate your response to receiving the calculations and comments from the fire
hydrant test done on State Highway 119 on September 10, 1996.
We have been aware, and concerned about the restricted capacity of the dead-end 16" line
since we began to help the developer move forward with this project.
We discussed with David Sample, of Left Hand Water District, a possible sequence of
events to get the water tank constructed and the main extension connected into the dead-
end line. It appears possible that the tank and line could be in service by the Fall of 1997.
If this is the case, this will likely coincide with the request for Certificate of Occupancies
on any new buildings in Vista Commercial Center.
I will appreciate your input to my immediate concern of what can be constructed in the
interim...what type, and how many square feet of development can occur in Vista
Commercial Center prior to this additional source of water supply. Obviously, this would
be based on the existing water supply and Left Hand Water District's ability to provide
fire protection capacities during a needed event.
Our primary concern is satisfying all of the requirements necessary to develop this
property. Elements of this concern are the meeting the requirements Mountain View Fire
Protection District will have in order to adequately serve any portion of the proposed
development, and making sure there is adequate fire protection so that the insurers for lot
developers will have their needs met as well.
