The Board of County Commissioners of Weld County, Colorado, met in regular
session in full conformity with the laws of the State of Colorado at the regular
place of meeting in the Weld County Centennial Center, Greeley, Colorado,
August 11, 1997, at the hour of 9:00 a.m.

The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:

Commissioner Webster moved to approve the minutes of the Board of County
Commissioners meeting of August 6, 1997, as printed. Commissioner
Kirkmeyer seconded the motion, and it carried unanimously.
Commissioner Harbert moved to approve the hearing*s conducted on July 14,
through August 5, 1997, as follows: 1) Board of Equalization Hearings.
Commissioner Kirkmeyer seconded the motion, which carried unanimously.
There were no additions to the agenda.
Commissioner Webster moved to approve the consent agenda as printed.
Commissioner Kirkmeyer seconded the motion, and it carried unanimously.
No public input was offered.

WARRANTS: Don Warden, Director of Finance and Administration, presented the following
warrants for approval by the Board:
All Funds $ 780,157.17
Commissioner Kirkmeyer moved to approve the warrants as presented by Mr.
Warden. Commissioner Webster seconded the motion, which carried
unanimously.
BUSINESS:
NEW: CONSIDER MEMORANDUM OF UNDERSTANDING FOR ONE -STOP
CAREER CENTER AND AUTHORIZE CHAIR TO SIGN: Walt Speckman,
Director of Human Services, stated this is the official agreement between the
Employment Services Division and the Governor's Office regarding the One -
Stop Career Center. Mr. Speckman stated Weld County has been providing this
service for a number of years and these funds will be used to enhance the
current employment and training system for employers and job seekers, as well
as increase services and information to school districts and youth and develop
resources for individuals to access workforce development information.
Commissioner Kirkmeyer moved to approve said memorandum and authorize
the Chair to sign. Seconded by Commissioner Harbert, the motion carried
unanimously.
CONSIDER ROAD IMPROVEMENT AGREEMENT FOR WELD COUNTY
ROAD 15 AND AUTHORIZE CHAIR TO SIGN - OWENS BROTHERS
CONCRETE COMPANY: Drew Scheltinga, County Engineer, stated the Weld
County Road 15 project will be completed in two phases. The first phase is for
paving Road 15 one-half mile south of the mining operation, which will complete
the paving in front of all the involved homes. The second phase will begin after
the mining operation reaches a total of 75 trucks per day, and will include the
remainder of Road 15 to the intersection with Weld County Road 74. Mr.
Scheltinga further explained Owens Brothers Concrete Company will pay
twenty-six percent (26%) of the cost, or $49,000, while Weld County will pay
$139,000. Responding to questions from Commissioners Harbert and
Kirkmeyer, Mr. Scheltinga stated Owens Brothers will track the number of trucks
through its billing system. He also responded the project would be appropriate
for the County either to pave or contract out, and he indicated that decision will
be made when the work is scheduled. Responding to Commissioner Kirkmeyer,
he noted the project will not commence until the mining operation commences.
Commissioner Kirkmeyer moved to approve said agreement and authorize the
Chair to sign. The motion, which was seconded by Commissioner Webster,
carried unanimously.

CONSIDER INTERGOVERNMENTAL AGREEMENT FOR JOINT STATE -
COUNTY PUBLICATION OF BALLOT INFORMATION AND AUTHORIZE
CHAIR TO SIGN: Bruce Barker, County Attorney, explained this agreement
lists Weld County's requirements on page three. Kathryn Seiler, Clerk and
Recorder's Office, stated this will allow for the concurrent publication of the
State's "Blue Book" and Weld County's TABOR notice requirements prior to the
November 1997 election. Commissioner Webster moved to approve said
agreement and authorize the Chair to sign. Seconded by Commissioner
Kirkmeyer, the motion carried unanimously.
CONSIDER REQUEST FROM VEGETATION MANAGEMENT SPECIALIST
TO ENTER UPON CERTAIN LANDS: Commissioner Webster moved to
approve said request. The motion, which was seconded by Commissioner
Harbert, carried unanimously.
CONSIDER RESOLUTION RE: UPDATE LIST OF ARBITRATORS FOR
PROPERTY VALUATION APPEALS: Mr. Barker stated this draft resolution
is to update the list of arbitrators used for property valuation appeals for those
taxpayers wishing to appeal the decision of the Board of Equalization in this
manner. Commissioner Harbert moved to approve the draft resolution. The
motion, which was seconded by Commissioner Kirkmeyer, carried unanimously.
CONSIDER RESOLUTION RE: DECLARATION OF DISASTER EMERGENCY
AND AUTHORIZE CHAIR TO SIGN ANY NECESSARY DOCUMENTS: Mr.
Barker indicated Ed Herring, Office of Emergency Management, worked with
staff from the State regarding the wording of said resolution, which will allow
Weld County Department of Public Works and private property owners to apply
for disaster assistance funds due to the recent flooding. Commissioner Webster
moved to approve said draft resolution. The motion was seconded by
Commissioner Kirkmeyer and carried unanimously.
RESOLUTIONS AND
ORDINANCES: The resolutions were presented and signed as listed on the consent agenda.
There were no ordinances.
Let the minutes reflect that the above and foregoing actions were attested to
and respectfully submitted by the Acting Clerk to the Board.
