This site plan review is approved with the attached conditions:
1. Prior to recording the Site Plan Review plat, the applicant shall address the following to the
Department of Planning Services' satisfaction:
a. The applicant shall submit a detailed Landscape Plan, for approval by the Department of
Planning Services,which shall include the following information:
1) A landscape maintenance schedule which specifically states who will perform
maintenance and that maintenance is on-going and shall not end upon final
acceptance by the Department of Planning Services. (Planning)
2) A fencing plan must be submitted to the Department of Planning Services and shall
include the location of the fence and gate behind the landscaping. The fencing shall
be painted green or brown to blend with the landscaping. All outside storage must
be screened from all adjacent properties and public rights-of-way. (Planning)
3) The landscaping and screening plan must meet the intent of the landscaping
regulations of the Mixed Use Development Plan, Ordinance 191. (Please refer to
Section 2.6, pages 21-30 of the Mixed Use Development Plan, Ordinance 191
regarding landscaping regulations.) (Planning)
4) The applicant shall enter into an Improvements Agreement according to policy
regarding Collateral for Improvements and post adequate collateral for onsite
improvements requirements. (Planning Department)
b. The applicant shall submit evidence of approval to the Department of Planning Services
from the Environmental Protection Services Division of the Weld County Health
Department of a waste handling plan . The plan shall include at a minimum,the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated)
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed(including
the facility name, address, and telephone number)

1) A typical cross section or note describing depth of base and asphalt or full depth or-

Subdivision Ordinance regarding Geometric Standards and road structures to S

3) Sufficient space shall be provided in loading/service areas to accommodate the

4) All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act,30-20-101,C.R.S.,as amended)shall be stored and removed for final
disposal in a manner that protects against surface and groundwater contamination.

6) Waste materials shall be handled, stored, and disposed in a manner that controls

15) Landscaping materials as indicated in the approved landscape plan shall be
maintained at all times. Dead or disease plant materials shall be replaced with

17) The site shall maintain compliance with the Weld County Planned Unit

18) No parking or staging of vehicles outside of the delineated parking areas is allowed.

19) The commercial lot is to be utilized by Dan's Garage or a similar approved use. If
any other commercial use is proposed on this lot, a public sewer system may be

20) Access shall be limited to one access point with no open access throughout the cul-

21) The mobile home shall maintain compliance with Section 43.3 of the Weld County
Zoning Ordinance at all times. (Planning)
d. The applicant shall identify, on the plat, overflow employee parking, designated areas for '
vehicles to be repaired, and a circulation pattern. The plan shall be submitted for approval , 4
to the Weld County Public Works Department. A copy of the approved plan shall be
submitted to the Department of Planning Services. (Public Works)
e. The applicant shall supply documentation on how the storm water drainage will be handled, N.,./V-

h. All proposed lighting shall be delineated on the plat and shall maintain compliance with
Section 23.2.1.21.6 of the Weld County Zoning Ordinance, as amended. (Planning)
The applicant shall amend the plat to show the location of the trash collection area on the
site. If the proposed location is inside the commercial building, this information shall be
given as an additional note on the plat and the location of the trash dumpster on trash pickup
day shall be shown on the plat. If the proposed location is outside of the commercial
building,the trash dumpster shall be screened from all adjacent properties and public rights-

2. Prior to the release o`-building permits:
a. In conjunction with the requirements for the Final Nat of Hunt-Wiedeman PUD, all street
signs and lot identification shall be in place. (Planning)
b. Access shall be granted from a paved approach off the cul-de-sac. The driveway shall be
a minimum of 24 feet wide to accommodate two-way traffic. Customer/visitor parking
adjacent to the office area shall be paved and striped. The approach to the overhead doors

c. A Certificate of Compliance(enclosed) shall be submitted to the Department of Planning
Services.
3. A Site Plan Review Plat shall be prepared after the Site Plan Review application is approved. The
plat shall be submitted to the planner and be ready for recording at the Weld County Clerk and
Recorder's Office within 30 days of approval. The shall meet all requirements of Section 23.2.1.22
and 23.2.1.23 of the Weld County Zoning Ordinance. The plat shall be no larger than 24" X 36".
4. Prior to the release of the Certificate of Occupancy:
a. A final inspection of the occupancy will be required by a member of the LaSalle Fire
Protection District.
b. The applicant shall have in place, all paving,parking and utilities. (Planning)

Concerning the proposal submitted by Dan's Garage do Daniel and Debra Baker. I have the following
recommendations.
The total area of the garage exceeds 3,000 square feet therefore an automatic fire extinguishing system is
required throughout the building. I have talked with a representative of Central Weld Water District and they will
be unable to supply the necessary water flow for this system. The Water District has plans to install a large
diameter water line to the subdivision in the near future but they could not give me an exact date when they
would install the line. In an effort to work with Mr. Baker I have explored some options since it will have to be a
dry sprinkler system until the water line is enlarged. The most favorable option would be to have Mr. Baker
install his sprinkler system with an exterior Siamese connection which we could hook our fire trucks into until the
Central Weld Water District line is installed. At the time when the water is available Mr. Baker will be required
to tie into the line and make his sprinkler system a wet system. Additionally, because of the size of the building,
Mr. Baker will be required to put a one hour separation wall at the southeast end of the building. This wall would
separate the two southeast bays of the building from the rest of the building. 1 have enclosed a diagram of the
building with the separation wall indicated with an orange line. This will be a one hour wall constructed per UBC
guidelines and all cutting and welding will be performed in this area of the building. I have discussed this option
with Mr. Baker and Mr. Dave Sprague and they have agreed that this is a workable option. Along with the
sprinkler system there needs to be at least four 20# ABC and one 10# ABC extinguisher placed in the building. I
would ask that upon completion of the building that Mr. Baker contact me and I will meet with him to place the
extinguishers in the proper locations.
Exit signs will be placed on the four doors which exit from the garage area. I have enclosed a copy of the Fire
Code Requirements concerning these signs. I have also enclosed a copy of the Uniform Fire Code page which
addresses flammable and combustible liquids and sources of ignition in repair garages. I would ask that these
requirements be complied with.

ARTICLE 29 - REPAIR GARAGES
(cal SECTION 2901 —SCOPE
Garages used for service or repair of motor vehicles and classified as Group S,Division 3,or Group
H, Division 4 Occupancies shall be in accordance with Article 29.
SECTION 2902- PERMITS
For permits to use a structure as a place of business for the purpose of servicing or repairing motor
vehicles, see Section 105, Permit r.3.
SECTION 2903 - FLAMMABLE AND COMBUSTIBLE LIQUIDS
2903.1 General. Storage, use and handling of flammable or combustible liquids shall be in ac-
cordance with Article 79 and Section 2903.
2903.2 Dispensing inside of Buildings. When flammable or combustible liquids are used or dis-
pensed in a repair garage,electrical and fuel-burning equipment shall comply with Sections 5202.6,
5202.7.2 and 7901.4.
For operations involving dispensing of fuel into the fuel tanks of motor vehicles,see Article 52.
2903.3 Storage and Use in Buildings with Basements or Pits. When Class I liquids are stored or
used within a building having a basement or pit into which flammable vapors could travel, the
basement or pit shall be provided with ventilation designed to prevent the accumulation of
flammable vapors therein.
2903.4 Storage and Handling of Liquids Drained from Vehicles.
2903.4.1 Motor vehicle fuel. Motor vehicle fuel shall not be drained in Group S, Division 3
Occupancies. Liquids drained from motor vehicle fuel tanks in Group H,Division 4 Occupancies
shall be stored and handled as required for Class I liquids in accordance with Article 79.
2903.4.2 Lubricating oil. Lubricating oil which has been drained from motor vehicles in Group
S,Division 3 or Group H,Division 4 Occupancies shall be stored and handled as required for Class
III-B liquids in accordance with Article 79.
2903.4.3 Mixed liquids. Containers and tanks containing a mixture of fuel and lubricating oil
shall be installed in accordance with the requirements of Article 79 for Class I liquids.
2903.5 Storage. Stored liquids shall be kept in containers or tanks complying with Section 7902.
Tank drainage lines terminating inside a building shall be equipped with a nonremovable-type
cap, such as a hinged cap.
2903.6 Spill Control. Spill control shall be provided in accordance with Section 7901.8.
2903.7 Oily Waste Materials. Oily rags and similar materials shall be stored in metal,
metal-lined, or other approved containers equipped with tightfitting covers.
SECTION 2904 -SOURCES OF IGNITION
2904.1 General. Sources of ignition shall not be within 18 inches (457.2 mm) of the floor.
Smoking and open flames shall be prohibited in areas used for servicing internal combustion en-
gines.
{q 2904.2 Welding. Welding operations shall be conducted only in Group H. Division 4
Occupancies, and shall be in accordance with Article 49.

The 1997 Uniform Building Code classifies a repair garage as a Group H, Division 4 Occupancy.
Under this classification:
1. The building should be kept back a minimum of 20 feet from property lines to
prevent fire-resistive construction on exterior walls.
2. Depending on the type of construction and allowable area increases found in the UBC, the total
area of the repair garage may be limited to 5,100 square feet.
3. Occupancy separations may be required between areas with different uses within the repair
facility.
4. If the total area of the repair garage exceeds 15,000 square feet, smoke and heat venting is
required.
5. If the total area of the repair garage exceeds 3,000 square feet, an automatic fire-extinguishing
system is required throughout the building.
6. Floors shall be of noncombustible, liquid-tight construction.
7. An engineered foundation and an "open hole" inspection by an engineer is required. Structural
engineering is required.
8. Wiring shall conform to Article 511 in the 1999 National Electrical Code and other
appropriate sections.
9. Before any work is started, a building permit application, plans, and documents need to be
submitted and the building permit issued.

Environmental Health Services has reviewed this proposal for a truck and tractor repair shop. The
following conditions are recommended to be part of any approval:
All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-101, C.R.S., as amended) shall be stored and removed for final
disposal in a manner that protects against surface and groundwater contamination.
2j No permanent disposal of wastes shall be permitted at this site.
- Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
✓4) Fugitive dust shall be controlled on this site.
/5) The maximum permissible noise level shall not exceed the commercial limit of 60 db(A),
as measured according to 25-12-102, Colorado Revised Statutes.

An individual sewage disposal system is required for the proposed repair shop and shall
be installed according to the Weld County Individual Sewage Disposal Regulations. The
septic system is required to be designed by a Colorado Registered Professional Engineer

11) Prior to recording the plat, the applicant shall submit a waste handling plan to the
Environmental Health Serves Division of the Weld County Department of Public
Health and Environment. The plan shall include at a minimum, the following:

Weld County Public Works Department has reviewed this proposal. This project falls primarily under the purview
of the Weld County Site Plan Review, Planned Unit Development, and Urban Development Standards. Our
comments and requirements are as follows:
COMMENTS:
Lot 1, Block 2 of Hunt-Wiedeman PUD, the 4.94-acre parcel, is considered a commercial use area. Item 2.14 of
the parking requirements states all parking and loading areas shall be paved and striped
REQUIREMENTS:
Parking and Loading Areas: Access shall be granted from a paved approach off the cul-de-sac. The driveway
shall be a minimum of 24 feet wide to accommodate two-way traffic. Customer/visitor parking adjacent to the office
area shall be paved and striped. The approach to the overhead doors shall also be paved.
Additional Parking: The applicant shall identify overflow employee parking, designated areas for vehicles to be
repaired, and a circulation pattern.
Access: Access shall be limited to one access point with no open access throughout the cul-de-sac.

3. PURCHASE PRICE AND TERMS. The purchase price shall be S 55.000.00 , payable in U.S. dollars by Buyer as

7. NOT ASSIGNABLE. This contract shall not be assignable by Buyer without Seller's prior written consent. Except as so restricted, this
contract shall inure to the benefit of and be binding upon the heirs, personal representatives, successors and assigns of the parties.
8. EVIDENCE OF TITLE. Seller shall furnish to Buyer, et Seller's expense, either a current commitment for owner's title insurance policy in an
amount equal to the purchase price or at Sellers choice, an abstract of title certified to a current date, on or before June 25. 1999

17. CONDITION OF AND DAMAGE TO PROPERTY. Except as otherwise provided in this contract, the Property and Inclusions shall be
delivered in the condition existing as of the date of this contract, ordinary wear and tear excepted. In the event the Property shall be damaged by fire
or other casualty prior to time of closing, in an amount of not more than ten percent of the total purchase price, Seller shall be obligated to
repair the same before the date of closing. In the event such damage is not repaired within said time or if the damages exceed such sum, this
contract may be terminated at the option of Buyer. Should Buyer elect to carry out this contract despite such damage, Buyer shall be entitled to
credit for all the insurance proceeds resulting from such damage to the Property and Inclusions, not exceeding, however, the total purchase price.
Should any Inclusion(s) or service(s) fail or be damaged between the date of this contract and the date of closing or the date of
possession, whichever shall be earlier, then Seller shall be liable for the repair or replacement of such Inclusion(s) or service(s) with a unit of
similar size, age and quality, or an equivalent credit, less any insurance proceeds received by Buyer covering such repair or replacement. The risk of
loss for any damage to growing crops, by fire or other casualty, shall be borne by the party entitled to the growing crops. if any, as provided in Section
2 and such party shall be entitled to such insurance proceeds or benefits for the growing crops, if any.
18. TIME OF ESSENCE/REMEDIES.Time is of the essence hereof. If any note or check received as earnest money hereunder or any other
payment due hereunder is not paid, honored or tendered when due, or if any other obligation hereunder is not performed or waived as herein provided,
there shall be the following remedies:
(a) IF BUYER IS IN DEFAULT: (Check one box only.)
®(1) Specific Performance. Seller may elect to treat this contract as cancelled, in which case all payments and things of value received
hereunder shall be forfeited and retained on behalf of Seller, and Seller may recover such damages as may be proper, or Seller may elect to
treat this contract as being in full force and effect and Seller shall have the right to specific performance or damages, or both.
❑(2) Ugddated Damages All payments and things of value received hereunder shall be forfeited by Buyer and retained on behalf of Seller
and both parties shall thereafter be released from all obligations hereunder. It is agreed that such payments and things of value are LIQUIDATED
DAMAGES and (except as provided in subsection (c)) are SELLER'S SOLE AND ONLY REMEDY for Buyer's failure to perform the obligations
of this contract. Seller expressly waives the remedies of specific performance and additional damages.
(b) IF SELLER IS IN DEFAULT: Buyer may elect to treat this contract as cancelled, in which case all payments and things of value received
hereunder shall be returned and Buyer may recover such damages as may be proper, or Buyer may elect to treat this contract as being in
full force and effect and Buyer shall have the right to specific performance or damages, or both.
(c) COSTS AND EXPENSES. Anything to the contrary herein notwithstanding, in the event of any arbitration or litigation arising out of this
contract, the arbitrator or court shall award to the prevailing party all reasonable costs and expenses, including attorney fees.
19. EARNEST MONEY DISPUTE. Notwithstanding any termination of this contract, Buyer and Seller agree that, in the event of any
controversy regarding the earnest money and things of value held by broker or closing agent, unless mutual written instructions are received by the holder
of the earnest money and things of value, broker or closing agent shall not be required to take any action but may await any proceeding, or at broker's
or closing agent's option and sole discretion, may interplead all patties and deposit any moneys or things of value into a court of competent
jurisdiction and shall recover court costs and reasonable attorney fees.
20. ALTERNATIVE DISPUTE RESOLUTION:MEDIATION. If a dispute arises relating to this contract, and is not resolved, the
parties and broker(s) involved in such dispute (Disputants) shall first proceed in good faith to submit the matter to mediation. The Disputants will
jay appoint an acceptable mediator and will share equally in the cost of such mediation. In the event the entire dispute is not resolved within
thirty (30) calendar days from the date written notice requuesting mediation is sent by one Disputant to the other(s), the mediation, unless otherwise
agreed, shall terminate. This section shall not alter any date in this contract, unless otherwise agreed.
21. ADDITIONAL PROVISIONS: (The language of these additional provisions has not been approved by the Colorado Real Estate Commission).
A. This contract is expressly contingent upon the completion of the Hunt—Wiedeman
P.U.D. within the time frame of this contract.
22. RECOMMENDATION OF LEGAL COUNSEL, By signing this document, Buyer and Seller acknowledge that the Selling Company
or the Listing Company has advised that this document has important legal consequences and has recommended the examination of title and consultation
with legal and tax or other counsel before signing this contract.
23. TERMINATION.In the event this contract is terminated, all payments and things of value received hereunder shall be returned
and the parties shall be relieved of all obligations hereunder, subject to Section 19.
