The feedlot is located at 21560 Weld County Road 76, Weld County. The complaint alleged that the feedlot was discharge manure contaminated waste water into Lone Tree Creek in violation of the Confined Animal Feeding Operation Control Regulations ((CAFO Regulations)(5 CCR 1002-81)). During my visit to the facility I observed the active discharge with you. We both observed, and you acknowledged,that the discharge originated in a tailwater pond that contained manure contaminated water as the result of a recent storm event. The water flowed from the pond through a series of culverts to the north side of Weld County Road 76, then west along Weld County Road 76 approximately 1/4 mile, then into Lone Tree Creek. We discussed that this discharge is a violation of Section 81.3 of the CAFO Regulations. You also indicated that your lagoons are not routinely de-watered following storm events. Section 81.3(C)(1)(a) of the CAFO Regulations requires that "...whenever 50% of the design runoff storage capacity is exceeded by accumulated runoff, sediment, manure, or process-generated wastewater, the retention structure shall be dewatered to a level that restores the full runoff storage capacity and the dewatering process shall be completed within a 15-day period." These are both violations of the CAFO Regulations and Section 47 of the Weld County Zoning Ordinance (WCZO). We acknowledge that you agreed to immediately cease the discharge and make operational changes to prevent future discharges. However, the fact that we received a complaint and that the complaint has been verified by our Department, triggers the violation process in Section 47 of the WCZO. Section 47 requires that you submit a plan and time line for correction for the deficiencies on the property. 99B8 Dave Morgan September 22, 1999 Page 2 As required by Section 47, you are hereby advised that you have 30 days from receipt of this notice to respond with a plan for correction for the aforementioned violations and submittal of a comprehensive manure and waste water management plan that complies with the CAFO Regulations. The plan for correction shall also consist of a detailed time line to correct the violation. Failure to respond may result in civil, criminal, or administrative penalties as deemed appropriate by the Water Quality Control Division of the Colorado Department of Public Health and Environment, in accordance with C.R.S. 25-8-601, and appropriate action in accordance with the WCZO.
