6:30 p.m.
ROLL CALL: The meeting was called to order by President Judy Curtis. Vice
President Dan Oster, Councilman Ralph Campbell, Councilwoman Pam Malcom, and
Councilman Al Roberts were present, constituting a quorum of the members. Also
present: David Malcom, Ginny Shaw, John Folsom, Gene Brantner, John Cooke,
Dwaine Kurtz, Sharon Hopper, Doris Elder, J. D. Eastin, Frank Stewart, Ruth Stewart,
Chuck Carlson, and the Council secretary, Bev Thomas.
APPROVAL OF MINUTES: Councilman Ralph Campbell made a motion to approve
the September 15, 1998 meeting minutes with the following corrections: delete the
mileage payment to President Judy Curtis and insert "present at the Hudson meeting" in
the sentence regarding the majority of citizens encouraging the Council to reconsider
and raise the salaries that had been set at the August Weld County Council meeting.
Councilman Dan Oster seconded the motion and the September minutes were
approved as corrected.
APPOINTMENTS: Council members signed up to attend the October 29 Town/County
meeting hosted by the County Commissioners. Councilman Roberts will attend the
November 9, 1998 elected officials meeting.
ADDITIONS TO THE AGENDA: President Judy Curtis recognized the citizens who
wanted to speak to the Council.
PUBLIC COMMENT:
Elected Officials' Salaries
Gene Brantner, Dwaine Kurtz, John Eastin, David Malcom, Chuck Carlson, George
Hall, and Frank Stewart spoke to the Council about the salaries of Weld County elected
officials. Each speaker gave reasons either why the Sheriffs salary or other salaries of
Weld elected officials should be increased.
Weld County Road Grid System and 125 Access
Mr. John Folsom spoke to the Council about his concerns regarding the County's road
grid system and possible additional accesses to 125. Mr. Folsom said that he had
investigated his concerns with Weld County Planning Services, Weld County

Commissioners, and CDOT (Colorado Department of Transportation) and he was
unable to find any inter communication between the parties on these issues. Mr.
Folsom requested a program of communication between the agencies to make the grid
system complete and to plan for additional accesses to travel east and west across 125.
Former Weld County Commissioner Chuck Carlson said that Mr. Folsom needed to go
to CDOT with his concerns as the County Commissioners have no control over
Interstate highway access.
Concerns Regarding Processing Election Petitions
Sharon Hopper asked the Council to check whether there was a conflict-of-interest in
certain Weld County Commissioners carrying petitions for candidates for the Weld
County Council. In her perusal of Weld County Council petitions Mrs. Hopper noted
several apparent flaws in petitions that had been accepted by the Weld County Clerk/
Recorder. Mrs. Hopper asked the Council to look into her concerns about the
Clerk/Recorder's handling of the Council petitions.
Question Regarding Money Lost by Weld County
Mrs. Hopper asked the Council to find out if the Weld County Finance Corporation
invested the $4.5 million that was lost by Weld County approximately ten years ago.
Concerns Regarding Development in the MUD
Ginny Shaw expressed her concern regarding development in the MUD that does not
conform to the standards outlined in the County's policy for development. Ms. Shaw
compared sections of the MUD standards with pictures she had taken of a business in
the MUD. She stated that the business started without Weld County knowing about it
and the Planning Department is now taking referrals about this business. Ms. Shaw
expressed concern that this project would not go before the Weld County Planning
Commission or the Weld County Board of Commissioners. She noted the importance
of the Planning Department's decision about this case because this decision will be a
potential model for future development. Ms. Shaw asked the Council what recourse
citizens have to prevent this from happening in the future.
ADOPTION OF THIRD QUARTER REPORT TO THE PEOPLE: Councilman Ralph
Campbell made a motion to delete from the proposed Report to the People the first four
paragraphs from the August 18 meeting summary and put in its place: "At the August
18, 1998 meeting the Council discussed and set salaries for the elected officials of
Weld County." Councilman Dan Oster seconded the motion and it carried unanimously.

Councilman Ralph Campbell made a motion to adopt the Third Quarter Report to the
People as amended. Councilwoman Pam Malcom seconded the motion and it carried
unanimously.
CORRESPONDENCE: The Council reviewed the correspondence and received copies
of an Air Touch Cellular memo.
Elected Officials Salaries
Councilwoman Pam Malcom said that contrary to her earlier decision to not participate
in salary setting for the Weld County Sheriff she would now participate in the discussion
and voting. She said that constituents had advised her that there was not a conflict of
interest in her participation since she would not receive any personal gain from setting
the Sheriffs salary.
The Council reviewed the public comment and the various criteria for setting the
salaries of elected officials of Weld County.
Councilman Ralph Campbell made a motion to rescind the motion of August 18, 1998
setting the Weld County Sheriffs salary at $50,000. The motion died for lack of a
second.
President Judy Curtis made a motion to set the Weld County Sheriffs salary at
$65,000. for the years 1999, 2000, 2001, and 2002. Councilwoman Pam Malcom
seconded the motion. Vice President Oster, Councilman Campbell and Councilman
Roberts voted no. President Judy Curtis and Councilwoman Pam Malcom voted yes
and the motion failed.
Councilwoman Pam Malcom made a motion that the salaries of the Weld County
Assessor, Clerk Recorder, Coroner, and Treasurer be raised $10,000 to $56,000 for the
years 1999, 2000, 2001, and 2002. The County Commissioners' salaries would be set
at $56,000 for the years 2001 and 2002. Councilman Ralph Campbell seconded the
motion and asked for a roll call vote. President Judy Curtis, Councilman Ralph
Campbell and Councilwoman Pam Malcom voted yes. Councilman Dan Oster and
Councilman Al Roberts voted no and the motion carried.
Councilwoman Pam Malcom made a motion that the Weld County Sheriffs salary be
set at $64,000. for the years 1999, 2000, 2001, and 2002. Councilman Ralph Campbell
seconded the motion. Councilwoman Pam Malcom called for the question and for a roll
call vote. The motion carried with President Judy Curtis, Councilman Ralph Campbell,
Councilwoman Pam Malcom voting yes. Councilman Dan Oster and Councilman Al
Roberts voted no.

COORDINATOR REPORTS:
Concerns Regarding Weld County Council Election Petitions
Councilman Roberts reported that he had been asked, before tonight's meeting, by
citizens to look into the processing of the Weld County Council's candidates' petitions.
Councilman Roberts reported he had started to gather information about processing
irregularities.
The citizens had also asked whether the Council would investigate the possible conflict
of interest in certain Weld County Commissioners circulating petitions for Weld County
Council candidates.
Councilman Dan Oster made a motion that the Weld County Council send a letter to
County Attorney Bruce Barker requesting a written opinion regarding the legality of
Weld County Commissioners circulating petitions for candidates for the Weld County
Council. President Judy Curtis seconded the motion. The motion carried with a
unanimous vote of the Council members present. Councilman Ralph Campbell had
been excused from the meeting at 9:40 p.m. due to a conflicting appointment.
The Council asked Councilman Roberts to prepare a coordinator's report for the
Council's November meeting regarding these concerns.
UNFINISHED BUSINESS:
Payment of the Bills
Councilwoman Pam Malcom made a motion to pay the following bills:
Mileage for President Judy Curtis $23.22
Mileage for Councilman Ralph Campbell $ 11.88
Mileage for Vice President Dan Oster $ 7.56
Mileage for Councilman Al Roberts $29.16
Invoice for Legal Notice $ 4.50
Vice President Oster seconded the motion and it carried unanimously.
ADJOURNMENT: The meeting was adjourned at 10:10 p.m..
