HomeMy WebLinkAbout980173.tiff BEFORE THE WELD COUNTY, COLORADO, PLANNING COMMISSION RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS Moved by Arlan Marrs that the following resolution,with the addition of the Roping Arena along with Conditions of Approval 5 through 7 and Development Standards 10 through 14, with subsequent renumbering, and changes to Development Standard Number 12, be introduced for passage by the Weld County Planning Commission. Be it resolved by the Weld County Planning Commission that the application for: CASE NUMBER: USR-1167 PLANNER : Shani L. Eastin NAME: Brian and Lisa Wallace ADDRESS: 15501 Weld County Road 13, Platteville, CO 80651 REQUEST: A Site Specific Development Plan and Special Review Permit for a Commercial Use (Sports Marketing Business) in the A(Agricultural)Zone District. LEGAL DESCRIPTION: Lot A of RE-1888, part of the NE4 of Section 13, T3N, R68W of the 6th P.M., Weld County, Colorado LOCATION: West of and adjacent to WCR 13;Approximately '' mile north of WCR 32 be recommended favorably to the Board of County Commissioners for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Planning Commission that the applicant has shown compliance with Sections 24.3 of the Weld County Zoning Ordinance, as amended, as follows: a. Section 24.3.1.1 -- This proposal is consistent with the Weld County Comprehensive Plan which allows for commercial and industrial uses to locate in the Agricultural Zone District when the impact to surrounding properties is minimal, and where adequate services and infrastructure are available. b. Section 24.3.1.2 -- This proposal is consistent with the intent of the A (Agricultural) Zone District in that no prime productive farm ground is being taken out of production. c. Section 24.3.1.3 --The proposal will be compatible with the existing surrounding land uses which are rural residential acreages, pasture land and agricultural uses. d. Section 24.3.1.4 -- The proposed use will be compatible with future development of the surrounding area as permitted by the A (Agricultural) Zone District and with the future development as projected by the Comprehensive Plan or Master Plan of affected municipalities. The subject property lies within three miles of the Town of Mead. Their comments are attached and incorporated into the Conditions of Approval and Development Standards. e. Section 24.3.1.5—The proposal is not located within the Flood Hazard Overlay District Area identified by FEMA. • f. Section 24.3.1.7 — The Design Standards (Section 24.5 of the Weld County Zoning Ordinance, Operation Standards (Section 24.6 of the Weld County Zoning Ordinance), Conditions of Approval and Development Standards ensure that there are adequate provisions for the protection of health, safety, and welfare of the inhabitants of the neighborhood and county. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Planning Commission's recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review Plat prior to recording the plat. The completed plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners.(Planning) 2. The applicant shall attempt to address the concerns of the Mountain View Fire Protection District as stated in their referral letter dated September 15, 1997. (Planning) 3. The existing septic system being currently used for the residence is adequate for up to 8 (eight) employees. In the event the employee number increases to more than eight, the system must be enlarged in accordance with the Weld County I.S.D.S. Regulations.(Health Dept.) 4. Prior to recording the plat the applicant shall meet with the Public Works Department and discuss the site distance and maintenance issues as stated in a referral from Don Carroll, Project Administrator, dated September 9, 1997. A copy of the meeting and any agreements shall be submitted to the Department of Planning Services. (Public Works) 5. In the event the roping arena is located within 200 feet of the existing residence,the restrooms in the residence would be considered adequate. If the restrooms in the residence are used for patrons of the roping arena, an engineer must evaluate the septic systems ability to handle the proposed additional hydraulic load. In the event the system is not adequate, it must be enlarged in accordance with the Weld County I.S.D.S. regulations. (Health Dept.) 6. The applicant shall remove,handle,and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. The Site Specific Development Plan and Special Use Permit is for a Commercial Use (Sports Marketing Business) in the a (Agricultural) Zone District, as indicated in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon.(Planning) 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance, as amended.(Planning) 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. (Health Dept.) 4. No permanent disposal of wastes shall be permitted at this site. (Health Dept.) 5. Waste materials shall be handled,stored,and disposed in a manner that controls fugitive dust, blowing debris and other potential nuisance conditions.(Health Dept.) 6. Fugitive dust shall be controlled on this site. (Health Dept.) 7. The maximum permissible noise level shall not exceed the commercial limit of 60 db(a) as measured according to 25-12-102, Colorado Revised Statutes. (Health Dept.) 8. The facility shall utilize the existing public water supply. (Health Dept.) 9. Restroom facilities in the on-site residence shall be available to employees of the Sports Marketing Company.(Health Dept.) 10. The riding arena shall be provided with a restroom which is served by a septic system if the arena is located more than 200 feet from the residence. A vault system shall be acceptable. (Health Dept.) 11. The facility shall comply with the Confined Animal Feeding Operation Control Regulations (5CCR 1002-81) and all applicable portions of the Weld County Zoning Ordinance. (Health Dept.) 12. The maximum number of people using the arena shall not exceed 25 contestants or 100 people at any given time. (Planning) 13. Hours of operation for the arena shall be from 6:00 am to 10:00 pm. (Planning) 14. The public address system shall not be used after operating hours. (Planning) 15. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance, as amended.(Planning) 16. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance, as amended.(Planning) 17. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County regulations.(Planning) 980073 18. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services.(Planning) 19. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners.(Planning) 9800'7' Hello
