HomeMy WebLinkAbout982143.tiff BEFORE THE WELD COUNTY, COLORADO, PLANNING COMMISSION RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS Moved by Fred Walker that the following resolution be introduced for passage by the Weld County Planning Commission. Be it resolved by the Weld County Planning Commission that the application for: CASE: Ordinance 191-C APPLICANT: Gerald and Kathryn Hamlin PLANNER: Scott Ballstadt REQUEST: Amendment to the Mixed Use Development Structural Land Use Map 2.1 LEGAL DESCRIPTION: Lot B of RE-1140, being part of the E2 NW4 and the NW4 NW4 of Section 36, T3N, R68W of the 6th P.M., Weld County, Colorado. LOCATION: South of and adjacent to Weld County Road 28; approximately '/ mile west of Weld County Road 13. be recommended favorably to the Board of County Commissioners for the following reasons: Section 2.E.1 -The existing Comprehensive Plan is in need of revision as proposed. At the time of revision of the MUD Plan public sewer was not available to service the subject property. Public sewer service can currently be made available to the subject site from the St. Vrain Sanitation District. The MUD area was recognized in 1987 in the Weld County Comprehensive Plan as a future urban development corridor within Weld County. In February of 1997, the MUD area was re-evaluated by County staff and consultants to formulate the MUD Ordinance(Ordinance 191). Ordinance 191 is intended to guide and implement planned land use changes in the MUD area. The subject property is approximately 1 mile east of 1-25, south of and adjacent to Weld County Road 28. The surrounding area has experienced recent growth which has occurred partially through the County and also through the Town of Mead. Inclusion of this property within the MUD area will ensure that proper measures are taken to impose urban-type standards on development as it occurs. Staff understands from the application materials that the applicant is proposing to preserve approximately 30% of the 118 acre site for open space. This area, adjacent to the St. Vrain River, is to be designated as Limiting Site Factors on Structural Land Use Map 2.1. Section 2.E.2-The proposed amendment will be consistent with existing and future goals, policies and needs of the County. MUD.Goal 1 - To plan and to manage growth within the II-25 Mixed Use Development area and Urban Development Nodes so as to balance relevant fiscal, environmental, aesthetic, and economic components of the area. The current policy statements and regulations concerning the 1-25 MUD area require environmentally and aesthetically pleasing designs. All development in the MUD area is required to address and pay its proportionate share of the impacts created in the community. Future application proposals will be required to describe, in detail, the impacts of any proposed development of the subject property. MUD.Goal 2-To assure a well-integrated, balanced, transportation system which meets the public need with maximum efficiency, comfort, safety and economy. 982143 RESOLUTION, Ordinance 191-C Gerald and Kathryn Hamlin Page 2 The subject property is currently accessed from Weld County Road 28. The potential development of residential units in this area will undoubtedly require infrastructure improvements. The Weld County Public Works Department indicated in a referral response dated April 27, 1998 that upon future development of this property,Weld County Road 28 would be extended as a two-lane Collector status road, requiring additional right-of-way. Any future development proposals on the site will be required to meet the urban-type design standards established by the MUD Ordinance, as well as address conditions of approval as required by the Weld County Public Works Department and the Department of Planning Services. MUD.Goal 3-To provide efficient and cost-effective delivery of adequate public facilities and services which assure health, safety, and general welfare of the present and future residents of Weld County and the area. The proposal can be served in the future by a public sanitation district(St. Vrain Sanitation) and public water is also available to the property (Little Thompson Water District). All potential future developments will be required to connect to these systems. Fire protection in the area is provided by Mountain View Fire Protection District. Future development applications will be sent to the District for review. The current population size of the area makes providing private recreational facilities somewhat difficult at this time, However, these facilities will be addressed at such time in the future that residential development necessitates the development of these facilities. MUD.Goal 4 -To maintain and improve the existing natural state of the environment. The addition of the proposed application into the MUD area will not adversely influence the existing natural environmental resources in the area. Through the proposed inclusion the applicant will be required to adhere to an expanded level of environmental standards. MUD.Goal 5-The coordination of other municipal, county, regional, and state growth policies and programs which include this area should be evaluated in order to minimize discrepancies, promote a better understanding of growth dynamics in the area, avoid duplication of services and to provide economies of scale. The MUD area, in general, is developing at an accelerated rate. The growing population base will encourage and necessitate increased levels of service. Through the referral of development application materials, surrounding communities will have the opportunity to encourage a coordinated growth approach to handle impacts to the area. MUD.Goal 6-To assure that new development occurs in such a manner as to maintain an attractive working and living environment. Through future development applications, any proposed development will be required to adequately satisfy all goals and policies designed to ensure that an attractive and compatible working and living environment exists in the MUD area. MUD.Goal 7-All new development in the Mixed Use Development area should pay its own way. Through future development applications, any proposed development is required to address and pay its proportionate share of the impacts created in the community. Future applications will address this through improvements agreements and other appropriate mechanisms. RESOLUTION, Ordinance 191-C Gerald and Kathryn Hamlin Page 3 The Planning Commission recommends the following condition of approval be addressed prior to the Structural Land Use Map 2.1 amendment: 1. The applicant shall undertake the process to amend USR-639, J-Bar-B, Inc. Bailey Pit, so that this USR will not be located on any portion of the subject property. Motion seconded by Christie Nicklas.
