Environmental Protection Services has reviewed this proposal. The application materials
indicate the applicant will use the permitted septic system at the applicants' residence which is
about 50 feet from the accessory structure. The following conditions are recommended to be
part of any approval:
1) All liquid and solid wastes shall be stored and removed for final disposal in a manner
that protects against surface and groundwater contamination.
2) No permanent disposal of wastes shall be permitted at this site.
3) Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions.
4) The maximum permissible noise level shall not exceed the residential limit of 55 db(A)
as measured according to 25-12-102, Colorado Revised Statutes.
5) The facility shall utilize the existing public water supply. (City of Greeley)
6) There shall be no employees.

PLANNING COMMISSION FUNCTION:
Review the proposal and determine compliance with the City of Greeley
Comprehensive Plan and make a recommendation to the Weld County Planning
Commission.
PROJECT OVERVIEW AND BACKGROUND:
The request is for a 40-foot-by-60-foot (2,400-square-foot) accessory structure.
Existing on the site is a single-family home with an attached garage and a shed. The
oversized accessory structure has already been constructed and is intended to be used
for office use and housing equipment in connection with the applicant's backhoe
service (Miller's Backhoe Service Inc.). The applicant has indicated that he is the
only employee and all of the work is done off site. The site is approximately 2.92
acres and is zoned Agricultural.
The property is located outside the Mid-Range Expected Service Area (MRESA) and
on the northern edge of the City's Long-Range Expected Growth Area (LREGA) but
within the three-mile area of influence. By virtue of Section 19-7 of the City Charter
and the Weld County Policy of referring land-use proposals for review and comment
to appropriate jurisdictions, the proposal is within the purview of the Greeley
Comprehensive Plan.
It is the practice of the City of Greeley Planning Commission to review Weld County
requests principally for conformance with the City's Comprehensive Plan policies.
Specific design issues are addressed only to the degree necessary to ensure consistency
with the City's Comprehensive Plan and Development Code.

ANALYSIS:
The applicable City Comprehensive Plan policies which address the proposed use for
this property include:
Comprehensive Plan Policy 4.3
All development is encouraged to promote compatibility among neighboring land uses
of differing intensity and character. These efforts, where practical and appropriate,
should include complementary landscaping, building massing, material selection, and
site design.
Staff Comment: The area is predominantly farmland and large-lot rural
acreage. It is the staff's opinion that the proposed size and
use of the accessory building would be compatible with the
area as long as there is no outdoor storage associated with
the backhoe service business.

Commercial development is encouraged to be developed in clusters near arterial
intersections.
Staff Comment: This location is approximately 500 feet south of Weld
County Road 64 and approximately 3/4 mile east of Weld
County Road 27. As urban development moves this
direction, the site is not a good location for future
commercial operations. The applicant has indicated that he
owns Miller's liackhoe Service and is self-employed with
no employees. His hours of operation are from 8:00 a.m.
to 5:00 p.m., and there will not be outside storage.
For development within the city limits, the Greeley Development Code states that an
accessory structure shall be subordinate to and customarily found with the principal
use of the land and shall not exceed sixty percent (60%) of the main floor area or
height of the principal building, except in the H-A Zone. In this case, the main floor
area of the principal building is approximately 1,900 square feet, resulting in a limit
of 1,140 square feet for the accessory building. The applicant is requesting approval
of a 2,400-square-foot building.
According to the City of Greeley maps, the site appears to be located in the floodplain
and in an area of ecological significance. The applicant is required to obtain a Flood
Hazard Development Permit through Weld County. The staff recommends that to the
extent possible, the applicant be sensitive to wildlife habitat, unique plant
communities, and natural features on the site.
The property is located on the northern edge of Greeley's Long-Range Expected
Growth Area, indicating that it will be at least 20 years before the City limits reach
the site.
The predominant land uses in this area of the county are agricultural and related
agricultural USC5. Given that there are numerous barns and outbuildings located in this
area, it is the staff's opinion that the accessory building is compatible with the
neighboring land uses.

ADMINISTRATIVE REVIEW TEAM COMMENTS:
The Administrative Review Team members informally reviewed this proposal at its
meeting on November 4, 1998, and noted that the domestic water source for the site is
City of Greeley. If water service is needed for the office use in the accessory
building, a separate water tap would be required.
PLANNING STAFF RECOMMENDATION:
The Planning staff recommends to the City of Greeley Planning Commission that a
recommendation be forwarded to the Weld County Planning Commission that the Use
by Special Review permit for a 2,400-square-foot accessory building be approved with
the following conditions:
1. If water service is needed in the accessory building. a separate water tap shall be
required.
2. There shall be no outdoor storage relating to the backhoe service.
