RE: APPROVE AMENDMENT TO INTERGOVERNMENTAL AGREEMENT FOR THE
PAVING AND/OR REPAVING OF MAIN STREET IN THE TOWN OF GROVER,
COLORADO, AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Amendment to the
Intergovernmental Agreement for the Paving and/or Repaving of Main Street in the Town of
Grover, Colorado, between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Department of Public Works, and the
Town of Grover, with terms and conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Amendment to the Intergovernmental Agreement for the
Paving and/or Repaving of Main Street in the Town of Grover, Colorado, between the County of
Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,
on behalf of the Department of Public Works, and the Town of Grover be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 6th day of May, A.D., 1998.

AMENDMENT TO INTERGOVERNMENTAL AGREEMENT FOR THE PAVING
AND/OR REPAVING OF MAIN STREET IN THE TOWN OF GROVER. COLORADO
THIS AMENDMENT TO INTERGOVERNMENTAL AGREEMENT is made and
entered into this 4th day of May, 1998, by and between the Town of Grover, Colorado, by and
through its Town Council, hereinafter referred to as "Town,"with offices located at 313 Chatoga,
Box 57, Grover, Colorado 80729, and the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, Colorado, hereinafter referred to as
"County", with offices located at 915 Tenth Street, Greeley, Colorado 80631.
WITNESSETH:
WHEREAS, on August 4, 1997, Town and County entered into an Intergovernmental
Agreement for the Paving and\or Repaving of Main Street in Grover, Colorado, with said paving
and\or repaving to be performed by County and the cost thereof to be paid by Town as stated said
Intergovernmental Agreement, and
WHEREAS, such Agreements are authorized by C.R.S. § 29-1-203 and Colorado
Constitution Article XIV, § 18(2)(1), and
WHEREAS, the parties now desire to amend said Intergovernmental Agreement to reflect
changes to the work contemplated therein to be performed by County and for payment of the cost
of said changes to be paid by Town.
NOW, THEREFORE, in consideration of the mutual promises and covenants set forth
herein, the parties hereto agree to amend their Intergovernmental Agreement for the Paving
and\or Repaving of Main Street in Grover, Colorado, as follows:
1. Add the following Paragraph to the Intergovernmental Agreement:
9. ADDITIONAL ITEMS.
Town has received a grant from the State of Colorado for to partially pay for
items and work in addition to those stated in Paragraph 2., above. The additional
items and work include the following:
a. The construction and installation of a bike path, to be located on the north
side of Main Street, and to consist of a four foot wide, two inch thick strip
of asphalt paving, to extend for the entire length of Main Street
(approximately one mile). Said construction and installation shall be
performed by County at approximately the same time as the work
contemplated in Paragraph 2., above. Estimated costs: $6,500.

b. The striping of the bike path and the school crosswalk. Said striping shall
be performed by County at approximately the same time as the work
contemplated in Paragraph 2., above. Estimated costs: $200.
c. The creation of 14 road signs, to be metal and in compliance with the
Manual on Uniform traffic control Devices in size. Said signs shall
include wooden 4" x 4" posts. Said creation of signs shall be performed
by County at approximately the same time as the work contemplated in
Paragraph 2., above. Town shall provide County with the language for
said signs at the time of the signature herein. Town shall install the signs
after delivery by County, at its sole cost. Estimated costs: $3,700.
The entire costs of the additional items and work set forth above in this Paragraph
9. shall be paid by Town within thirty days after receiving billing from County.
The costs are estimated as set forth above. If the costs are more than as estimated
above, Town shall be responsible to pay the entire costs, including the overage. If
the costs are less than as estimated above, County shall bill only the actual costs
incurred. Town's promise to pay the costs of the additional items and work set
forth in this Paragraph 9., shall be in addition to those payments set forth in
Paragraph 3., of the Intergovernmental Agreement.
2. All of the remaining Paragraphs set forth in the Intergovernmental
Agreement shall remain the same.
IN WITNESS WHEREOF, the parties hereto have signed this Agreement this 4th day of
May, 1998.
