RESOLUTION RE: GRANT MOBILE HOME PERMIT#2092 -ANNA MARIE TAYLOR WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 15th day of July, 1998, considered the request of Anna Marie Taylor, P.O. Box 597, 13210 Sable Boulevard, Brighton, Colorado 80601, for a mobile home to be used as a second accessory to the farm, and WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: East 1/2 of Section 18, Township 2 North, Range 62 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard the testimony, finds that said request should be granted subject to the following conditions: 1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home on the property. 2. Prior to occupying the mobile home, it shall be connected to an approved septic system and a legal water supply. 3. The mobile home shall meet the minimum setback and offset requirements for the A (Agricultural) Zone District. 4. The noncommercial junkyard located on the property consisting of derelict vehicles and other miscellaneous items must be removed from the property or stored within an area that is not visible to any adjacent properties and public rights-of-way. An option for the derelict vehicles would be to obtain current license plates and have them in running condition. 5. There are currently two unpermitted mobile homes on site. One will be used as the accessory to the farm under this permit. the second unpermitted mobile home must be removed from the property or the appropriate zoning and building permits must be obtained. 7. Evidence shall be submitted by the applicant or property owner by the first of each year for review and acceptance by the Department of Planning Services verifying the mobile home occupant(s) is principally employed at or engaged in the farming peration on the subject property. the evidence shall consist of tax records, emplyoment agreements or other documentation as determined suitable by the Department of Planning Services. Failure to submit he required documentation may result in cessation of the allowance of the mobile home for temporary accessory farm use. 8. All construction or improvements occurring in the flood plain as delineated on FEMA Community Panel Map FP080266-0925C, dated September 28, 1982, shall comply with the Flood Hazard Overlay District requirements of Section 26 of the Weld County Zoning Ordinance. 9. The mobile home shall not be occupied until such time as the applicant has complied with Conditions 1 through 8, as stated above. It is the opinion of the Department of Planning Services'staff that the applicant has shown compliance with Section 43.2.3 of the Weld County Zoning Ordinance, as follows: a. Section 43.2.3.1.1-The mobile home will be occupied by persons principally employed at or engaged in the operation of the use where the mobile home is located. Accessory farm use of the mobile home shall be established and revalidated on an annual basis. b. Section 43.2.3.1.2-The mobile home is necessary for the effective and economic operation of the use and/or protection of the agricultural use. The applicant has indicated that the mobile home is needed for a worker, principally employed on the turf farm. c. Section 43.2.3.1.3-The mobile home will not be used as an income source by the applicant for rental to persons who are not principally employed upon the lot. This proposed mobile home will only be used for the employee of the turf farm. d. Section 43.2.3.1.4-Adequate water and sewage disposal facilities are available to the mobile home. The mobile home will be served by a private well for the water supply and the existing septic system is permitted by permit#SE-9700086. If at all possible, these homes should be placed outside of this area to avoid potential loss of life or property. SOIL LIMITATIONS **************** Given the ambiguity of the application, we are assuming that the mobile homes will be built close to the existing home on WCR 22 . If there is need for new septic systems, then construction on the Valent sand soils will encounter severe limitations because of poor filter materials . Septic systems will encounter moderate limitations from flooding and slow percolation if placed on the Colombo loam.
