RE: Remington Place Minor Subdivision
To Whom It May Concern:
Following are the answers to the Minor Subdivision Change of Zone Questionaire and our
response to the comments offered to us by the Department of Planning Services staff concerning
compliance with the Weld County Comprehensive Plan.
1. "How is the proposed rezoning consistent with the policies of the Weld County
Comprehensive Plan?"
YES. Utilities are readily available, a paved road fronts the property, the property
is already small with a concrete ditch dividing it, making it hard to farm feasibility,
it is surrounded by small farms of alfalfa and grass hay and irrigated grass pasture, if
any property fits the criteria for Estate Zoning and a Minor Subdivision this does.
2. "How will the uses allowed by the proposed rezoning be compatible with the surrounding
land uses?"
The surrounding community is already largely made up of small farms of 5 acres
and larger, therefore this proposed development should coexist well with the
present surrounding land use. The building envelope concept that is being
proposed will only disrupt the haying or grazing in a very small area where the
buildings are actually built, therefore having little effect upon the agricultural use
of this land or the surrounding lands.
3. "Will the property use a septic system or public sewer system?"
The property will use a septic sewer system and, as shown in the attached
Preliminary Subsurface and Percolation Investigation for Remington Place
Minor Subdivision, Weld County, Colorado done by Foundation and Soils
Engineering, Inc., the soils are suitable for a standard absorption sewage disposal
system.
4. "Who will provide adequate water, including fire protection, to the property?"
North Weld County Water District will provide adequate water, including fire
protection, to the property, as confirmed by three letters from Don Posselt
manager of the North Weld County Water District, hereby attached.
5. "Does the property have soils with moderate or severe limitations for construction?"
Very moderate, Roger Vigil and the engineers at Foundation& Soils Engineering
have stated that we will need engineered foundations and a subdrain system if
basements are a part of the construction. See attached Preliminary Subsurface
and Percolation Investigation for Remington Place Minor Subdivision, Weld
County, Colorado by Foundation and Soils Engineering, Inc..
6. "Is the road and/or highway facilities providing access to the property(ies) adequate to
meet the requirements of the proposed zone district?"
YES. WCR15, a paved north/south road going north off of State Highway 14,
which is also paved, runs along the east boundary of the property.
7. "Is there a sand, gravel, or other mineral resource on or under this property?" NO
See the attached Geologic and Mineral Evaluation for the Proposed Remington
Place Minor Subdivision, Weld County, Colorado.
8. "Is the change of zone area located in a Flood Hazard Overlay District?" NO
9. "Is the change of zone area located in a Geologic Hazard Overlay District?" NO
10. "Is the change of zone area located in the AP (Airport) Overlay District?" NO
The following is our response to the comments forwarded to us by the Department of Planning
Services staff concerning compliance with the Weld County Comprehensive Plan.
Preservation of Prime Farmland
A.Goal 1 - response: The proposed development site is currently in a grass legume crop that can
be hayed or grazed. I believe this is the best crop for this land because of the small size of the
fields. The total property is 29.48 acres that is cut in two by a concrete irrigation lateral. I have
tried and had a very hard time finding someone to raise a row crop on these small fields.
The surrounding community is already largely made up of small farms of 5 acres and larger,
therefore this proposed development should coexist well with the present surrounding land use
while having little effect upon the agricultural use of this land or the surrounding lands.
A.Goal 4 - response: The building envelope concept that is being proposed will only disrupt the
haying or grazing in a very small area where the buildings are actually built with only a small
amount of additional infrastructure needed.
Compatibility
R.Policy 5 - response: In agreement with the letter from the Colorado Department of Natural
Resources, I believe the development on this site is so limited that there will be little or no impact
on the Water Supply and Storage Company Ditch(WSSCD). There will probably be less use of
irrigation water than there currently is, therefore possibly having less runoff than there is at the
present time. As previously stated, the surrounding community is already largely made up of
small farms of 5 acres and larger, therefore this proposed development should coexist well with
the present adjoining land use while having little effect upon the agricultural use of this land or the
surrounding lands.
A.Policy 7 -response: The covenants that are currently being put together for the proposed
development will require continued haying and/or grazing of the land as well as good stewardship
and could easily incorporate Weld County's example. I believe that anyone that will agree to
comply with these covenants will have a complete understanding of"right to farm".
Public Facilities and Services
R.Goal 2 -response: We have no objections to Poudre Fire Authority's recommendation of one
or possibly two fire hydrants, and welcome any suggestions they may have to make the
development as safe as possible. North Weld County Water District (NWCWD) has indicated
that the water lines adjoining the property are adequate to operate the necessary fire hydrants.
P.Goal 2 - response: From the very beginning we have talked about how a covered bus stop and
the mailbox cluster would fit into the landscape of the entryway.
Open Space
O.Goal 4 and O.Goal 6 - response: The .3 acre open space can very easily be increased to an
open space of about I acre that would cover the area from the north end of the cul-de-sac to
WCR15 south to the previously suggested open space. It is planned to landscape all community
open space area as soon as possible after the approval of this proposed development with large
rock or small boulders, grassy areas and numerous deciduous and conifer trees. We plan to move
some of the Blue Spruce trees that are on the property to this area. A homeowners association
will be organized for the purpose of maintaining this open space landscaping and the internal road.
We are currently making the decision whether we want a rock or brick wall or a white fence type
entry gate in which we plan to coordinate a covered bus stop and a community mail box cluster.
Transportation
T.Goal 3 and T.Policy 4.3 - response We plan to abandon one of the farm access roads that is
now used. We have drawn into the plan a 60' right of way for the internal road and a turn around
cul-de sac with a 60' radius. We felt this was adequate, but if we find that it isn't we could
expand it with little affect on the rest of the development. We want very good hard surface roads.
We will definitely build them to at least the standards that is required by the Weld County
Subdivision Ordinance and Weld County Public Works Department specifications.
We feel we have addressed all the concerns that arose in the Sketch Plan application. We were
aware of the possible need for engineered foundations and leech fields and feel drainage and any
other effect upon the WSSCD will very minor to nonexistent. We feel because of the size and
location of this site that it is a perfect candidate for a Minor Subdivision.

Remington Place Minor Subdivision
To the best of my knowledge and ability I have made a best effort attempt to contact
and obtain information about any possible mineral lease on the property being
considered. This is what I have found.
The last mineral lease of record that I could find was with Wilbanks and Associates,
Inc., 1860 Lincolnb Street, Denver, Colorado, 80295. This lease expired in November
of 1994.
I have talked to Lyle Coe of Wilbanks and Associatiates by telephone several times.
Each time he has told me that they have no mineral lease on this property and they
don't know if anyone else does. They may have assigned the lease, but even if they
did it has long expired. He told me each time that he would send me a letter stating
this but he has never done it.
