RE: APPROVE AGREEMENT CONCERNING IMPROVEMENTS TO WELD COUNTY ROAD 7
AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement Concerning Improvements
to Weld County Road 7 between the County of Weld, State of Colorado, by and through the Board
of County Commissioners of Weld County, on behalf of the Public Works Department, and George
and Judith Ruff, 3888 Weld County Road 7, Erie, Colorado 80516, with terms and conditions being
as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Agreement Concerning Improvements to Weld County Road 7 between
the County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Public Works Department, and George and Judith Ruff, 3888 Weld
County Road 7, Erie, Colorado 80516 be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 19th day of June, A.D., 1995.

AGREEMENT
CONCERNING IMPROVEMENTS TO COUNTY ROAD #7 BETWEEN
GEORGE H. RUFF AND JUDITH H. RUFF AND WELD COUNTY, COLORADO
THIS AGREEMENT is made this /9-$ day of June,1995 by and
betweeN GEORGE H. RUFF AND JUDITH H. RUFF, whose address is 3888
WCR 7, Erie, CO 80516, hereinafter referred to as "Owners," and
the County of Weld, a body corporate and politic of the State of
Colorado, by and through its Board of County Commissioners,
hereinafter referred to as "County."
WITNESSETH:
WHEREAS, County finds it necessary to rebuild and improve
County Road #7, which is Weld County Project No.f50;6, and
WHEREAS, Owners own the following described property:
A part of the North 1/2 of the Northwest 1/4 of Section
15, Township 1 North, Range 68 West of the 6th Principal
Meridian, Weld County, Colorado.
,and
WHEREAS, County needs additional right-of-way in order to
complete the said project, and
WHEREAS, Owners wish to cooperate with County in said road
improvement.
NOW, THEREFORE, the parties herein agree as follows:
1. Owners agree to sell and County agrees to purchase the
right-of-way shown and/or described on Exhibit A,
attached hereto and hereinafter referred to herein as the
"Right -of -Way" for the sum of --14 1000Q -a dollars.
2. Owners agree to grant the Right -of -Way to County by Deed
of Dedication, in the form attached hereto as Exhibit B,
free and clear of all encumbrances, closing to be held on
or before August 15, 1995, at a place to be mutually
determined by the parties hereto.
3. County agrees to pay the costs of title insurance and
recording fees, if necessary as determined by County.
4. The parties hereby agree that neither has made or
authorized any agreement with respect to the subject
matter of this instrument other than expressly set forth
herein, and no oral representation, promise,or
consideration different from the terms herein contained
shall be binding on either party, or its agents or
employees, hereto. This Agreement embodies all
agreements between the parties hereto and there are no
promises, terms, conditions, or obligations referring to

the subject matter whereof other than as contained
herein.
5. Although the date of the transfer of the Right -of -Way
shall be the date of the delivery of the deed, it is
expressly agreed by the parties hereto that upon
execution of this Agreement by County and Owners, County,
its contractors, agents, employees, and all others deemed
necessary by County shall have the irrevocable right to
possess and use all of the Right -of -Way for the purpose
of construction, widening, and improvement of a portion
of said County Road 7.
6. General taxes for the year 1995 for the Right -of -Way
shall be apportioned to the date of delivery of the deed
based on the most recent levy and the most recent
assessment. Owner represent and warrants that all
general taxes levied prior to such year have been paid in
full by owner.
7. The County acknowledges and agrees that the right-of-way
conveyed by this agreement shall not be deemed to violate
the Weld County Subdivision Ordinance dated August 10,
1993 regarding any change of the boundary and/or size of
the existing, recorded exemption owned by the Owner,
designated RE -856.
IT IS MUTUALLY AGREED that the terms and conditions of this
Agreement shall extend to and be binding upon the heirs, executors,
administrators, successors,and assigns of the respective parties
hereto.
IN WITNESS WHEREOF, the parties have set their hands on the
day and year first above written.

A parcel of land being part of the Northwest Quarter (NW1/4) of Section Fifteen (15),
Township One North (T.1N.), Range Sixty-eight West (R.68W.) of the Sixth Principal
Meridian (6th P.M.), County of Weld, State of Colorado and being more particularly
described as follows:
BEGINNING at the Section Corner common to Sections 9/10/15/16-T.1N.-R.68W. with the
Quarter Corner common to Sections 15/16-T.1N.-R.68W. to bear South 00°03'00" East a
distance of 2643.08 feet with all other bearings contained herein relative thereto:
#1: THENCE South 44°57'04"East a distance of 42.50 feet to the point of intersection
of the Southerly Right -Of -Way (ROW) line of Weld County Road (WCR) #10 and
the Easterly ROW line of WCR #7. Said point being the TRUE POINT OF
BEGINNING:
#2: THENCE South 89°51'08"East along the Southerly ROW line of said WCR #10 a
distance of 66.58 feet to a point of a cusp with a curve which is concave to the
Southeast;
#3: THENCE along the Arc of said curve a distance of 29.79 feet, whose Radius is 20.00

Ruff Right -of -Way Acquisition
Dear Bruce;
As we discussed on the telephone yesterday, the Ruffs have signed
one of the new, revised Right -of -Way Agreements relative to the
project referenced above. During our most recent negotiations, the
Ruffs decided to forego the concept of obtaining a revised Rural
Exemption and decided to settle with the County on solely monetary
terms. Please note the new paragraph number 7 -within the enclosed
agreement discussing their existing Rural Exemption parcel. Also,
the Ruffs objected to the warranty clause in the agreement and that
was eliminated.
Note that the value requested by the Ruffs for this acquisition is
$8,000.00. Both I and the Ruffs had done some research into the
value of small -acreage building sites in Southwest Boulder County.
Generally, we looked at sites between 1/2 acre and 5 acres, and
found that such sites were becoming rare and can command a value
between $40,000.00 and $60,000.00 per building site. Attached to
this letter are several data sheets regarding existing sales of
small acreage home sites. I also inquired with the Weld County
Accessors Office and found similar information. The overall
acquisition is for .317 acres. Utilizing a mean of $50,000.00 for
a building site and the fact that the Ruff site consists of 2.19
acres, the resulting value per acre is approximately $22,800.00.
The Ruffs requested that we consider the value of their building
site at $25,000.00 per acre which is at the high end of the market
but still within general reason. The $25,000.00 per acre figure
would generate a value of this acquisition of approximately
$8,000.00 as requested by the Ruffs.

Upon your review and approval of the modifications to the enclosed
agreement, please present this contract to the Board of County
Commissioners for their review and approval. At this time, the
construction crews and the Ruffs are awaiting the County's
acceptance of this contract before beginning work on the Ruff
property. It is hoped that, provided the County will accept this
agreement, it can be signed by Monday, June 19, to allow
construction to commence.
I have included the original and one copy of the agreement as
signed by the Ruffs. Provided these are signed by the County,
please forward to me the copy including original signature of the
County for transmittal to the Ruffs.

A parcel of land being part of the Northwest Quarter (NW1/4) of Section Fifteen (15),
Township One North (T.IN.), Range Sixty-eight West (R.68W.) of the Sixth Principal
Meridian (6th P.M.), County of Weld, State of Colorado and being more particularly
described as follows:
BEGINNING at the Section Corner common to Sections 9/10/15/16-1'.1N.-R.68W, with the
Quarter Corner common to Sections 15/16-T.1N.-R.68W. to bear South 00°13'47" West a
distance of 2643.16 feet with all other bearings contained herein relative thereto:
