HomeMy WebLinkAbout952238.tiffHEARING CERTIFICATION DOCKET NO. 95-66 RE: CHANGE OF ZONE #496 FROM A (AGRICULTURAL) TO PUD (PLANNED UNIT DEVELOPMENT) FOR RESIDENTIAL AND OPEN SPACE USES - MEADOW VALE FARMS, INC., CIO BRUCE HENDEE, BHA DESIGN A public hearing was conducted on October 25, 1995, at 10:00 a.m., with the following present: Commissioner Dale K. Hall, Chairman Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Todd Hodges The following business was transacted: I hereby certify that pursuant to a notice dated October 2, 1995, and duly published October 5, 1995, in the North Weld Herald, a public hearing was conducted to consider the request of Meadow Vale Farms, Inc., Go Bruce Hendee, BHA Design, for a Change of Zone #496 from A (Agricultural) to PUD (Planned Unit Development) for residential and open space uses. Lee Morrison, Assistant County Attorney, made this a matter of record. Todd Hodges, Planning Department representative, presented a brief summary of the proposal and recommended the following amendments: add Condition of Approval #1f to read "A cross section of Weld County Road 5.5 showing the depth of asphalt base shall be shown on the plat as referenced in the memo from Don Carroll dated July 20, 1995."; correct the second sentence of Condition of Approval #2f to read "The internal road system is subject to review by the Public Works and Planning Departments and approval by the Board of County Commissioners."; add Condition of Approval #4 to read "The realignment portion of Weld County Road 5.5 shall be included in the PUD Change of Zone and the Change of Zone plat amended to show the inclusion." He also noted the following Conditions of Approval should be renumbered consecutively. Mr. Hodges then entered the favorable recommendation of the Planning Commission into the record as written, with said amendments. He responded to the Board's questions and further clarified said changes. Mr. Hodges confirmed this proposal fits well with the proposed Comprehensive Plan and Subdivision Regulations and clarified any changes must fit the new plans and regulations. Commissioner Kirkmeyer suggested a Condition of Approval be added requiring such. Mr. Hodges also confirmed the St. Vrain School District recommended approval based on the applicant designating ten acres to be donated to the district. Bruce Hendee, BHA Design, represented the applicant and stated the Olivers have owned this property since the 1920s, and the subject site consists of 155 acres. He also explained the proposal will provide public access along the St. Vrain River and affirmed the donation of the school site. Mr. Hendee noted the Olivers have been very involved with the school district and are very excited about this donation. Responding to questions from the Board, Mr. Hendee stated one access is proposed by the elementary school site and one off of Weld County Road 5.5. He stated an opportunity to connect to other neighborhoods in the future will also be provided and designated as a future turn around on the plat. Commissioner Harbert suggested said connection be designated as a "future connecting road" on the plat. Responding to further questions, Mr. Hendee confirmed the PUD will consist of 89 residential lots, and Commissioner Kirkmeyer noted Condition of Approval #2a should be changed to state "89" rather than "96". Mr. Hendee also confirmed the proposal will conform with the proposed MUD Regulations and agreed with all other changes as recommended by staff. No public testimony was offered concerning this matter. Responding to further questions from the Board and after consulting with Mr. Morrison, Mr. Hodges suggested the following be added as Condition of Approval #6: "That any future application shall be reviewed under any adopted changes to the Weld County Comprehensive Plan, Weld County Subdivision Ordinance, and the MUD Overlay Design Standards and Regulations." He clarified said Condition of Approval should be a note placed on the plat prior to recording. Mr. Hodges also confirmed the 952238 PL1010 RE: HEARING CERTIFICATION - MEADOW VALE FARMS, INC. PAGE 2 public access to the St. Vrain River should be discussed at the final plat stage and such a Condition of Approval is not necessary at this stage. Commissioner Harbert then moved to approve the request of Meadow Vale Farms, Inc., do Bruce Hendee, BHA Design, for Change of Zone #496 from A (Agricultural) to PUD (Planned Unit Development) for residential and open space uses, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record and amended as followed: Addition of Conditions of Approval #1f, #4, and #6, corrections to Conditions of Approval #2a and #2f, renumbering of Condition of Approval #4 to #5. Concerning the future connecting road, Mr. Hodges confirmed a Condition of Approval exists which requires the applicant show a right-of-way through to the property line. The motion was seconded by Commissioner Webster, and it carried unanimously. This Certification was approved on the 30th day of October, 1995.
