HomeMy WebLinkAbout972629.tiffHEARING CERTIFICATION DOCKET NO. 97-62 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SECOND AMENDED SPECIAL REVIEW PERMIT #1002 TO ALLOW EXPANSION OF THE SITE FROM 10 ACRES TO 25 ACRES, TO INCREASE THE NATURAL GAS PROCESSING CAPACITY, AND TO CONSTRUCT A SHOP ON AN EXISTING NATURAL GAS PROCESSING AND COMPRESSION FACILITY IN THE A (AGRICULTURAL) ZONE DISTRICT - NORTH AMERICAN RESOURCES COMPANY A public hearing was conducted on December 10, 1997, at 10:00 a.m., with the following present: Commissioner George E. Baxter, Chair Commissioner Constance L. Harbert, Pro-Tem Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer - EXCUSED Commissioner W. H. Webster - EXCUSED Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Gloria Dunn Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated November 14, 1997, and duly published November 26, 1997, in the Platteville Herald, a public hearing was conducted to consider the request of North American Resources Company to allow expansion of the site from 10 acres to 25 acres, to increase the natural gas processing capacity, and to construct a shop on an existing natural gas processing and compression facility in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Gloria Dunn, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Dunn stated the site has three accesses on Weld County Road 22; however, the Public Works Department requested the west access be restricted to a secondary or emergency access. She also stated the Road Maintenance Agreement from 1993, for Weld County Road 22, remains in force. Ms. Dunn stated Planning Commission voted for approval of the expansion, with the Conditions of Approval and Development Standards as presented. William Crews, representative for the applicant, stated the applicant is in full agreement with the Conditions of Approval and Development Standards. Mr. Crews requested the Board consider changing Condition #2 to allow the applicant to begin the permit process and work at the site before the final plat is recorded since time and weather conditions are crucial to the production of the site. Mr. Crews stated concerns regarding the lab facility, wastewater management plan, and dust 972629 dam: OL PL0905 HEARING CERTIFICATION - NORTH AMERICAN RESOURCES (USR #1002) PAGE 2 abatement plan have been addressed and sent to the Health Department, and added the septic permit has been applied for, but is still being processed. Responding to Chair Baxter, Ms. Dunn explained any of the necessary permits can be applied for; however, they will not be issued until the plat is ready for recording. No public testimony was offered concerning this matter. Commissioner Harbert moved to approve the request of North American Resources Company for a Site Specific Development Plan and Second Amended Special Review Permit #1002 to allow expansion of the site from 10 acres to 25 acres, to increase the natural gas processing capacity, and to construct a shop on an existing natural gas processing and compression facility in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Hall, and it carried unanimously. This Certification was approved on the 15th day of December, 1997.
