HomeMy WebLinkAbout950119.tiffRESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1690 - FREEHLING AND FRANK WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1690, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1690 was submitted by Ronald D. and Elaine Freehling, 5165 Osceola Street, Denver, Colorado 80212, and Kelly and Kim Frank, 1820 East 75th Avenue, Denver, Colorado 80229, for property which is located in part of the SW 1/4 of Section 5, Township 3 North, Range 68 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 15.567 acres and 15 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1690 submitted by Ronald D. and Elaine Freehling and Kelly and Kim Frank be, and hereby is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic systems shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. The ISDS permits shall be finalized and approved by an Environmental Protection Specialist within one (1) year of the application date. 3. Prior to recording the plat, the applicant shall: a. Provide evidence to the Department of Planning Services of the granting of a 30 -foot -wide access easement from Leonard and Geraldine Hergenreter to the applicants for the benefit of Lots A and B, located immediately east of each lot, and being an extension of the existing 30 -foot -wide "access and utility" easement which extends from Weld County Road 36 north to the southeast corner of Lot A. Said access easement shall be shown on the plat. Show on the plat a 60 -foot -wide easement east of the center of the Supply Ditch for the maintenance of said ditch. Said easement shall be dedicated on the plat for the use as shown using the language set forth in Section 11.7.12.5 of the Weld County Subdivision Ordinance. 4. A note shall be placed on the plat stating, "No fence shall be constructed adjacent to the Supply Ditch which restricts access to the ditch easement." 5. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 6. Prior to recording the plat, the applicants shall submit to the Department of Planning Services evidence of the provision of irrigation water to Lots A and B in amounts sufficient to maintain landscaping on said lots. Any agreement, grant, appropriation, or other such evidence of the provision of water shall run with the land. The parcel of land under consideration is described as part of the SW4 of Section 5, T3N, R68W of the 6th P.M., Weld County, Colorado. The property is located north of Weld County Road 36 and east of Weld County Road 3, within the Mead Urban Growth Boundary. No dwelling exists on either proposed recorded exemption lot. This parcel does not adjoin any public road directly but, rather, is accessed by a thirty-foot wide recorded easement which travels north of Weld County Road 36 along the east boundary of the property for a distance of approximately 533 feet. The applicants wish to continue use of this access road for both proposed Lot A and Lot B. The application materials indicate that the proposed homesites would be served by Little Thompson Water District and individual septic systems. The Weld County Health and Public Works Departments have no conflict with this request. The subject property is Lot B of RE -975, which was approved by the Board of County Commissioners in 1987. The approval of RE -975 divided a 35.574 acre parcel, more or less, into 30.567 and 5.007 acres, more or less. Lot A of RE -975 lies along the southwest boundary of the subject site and contains a residence. The applicants are now requesting to to further subdivide the property into two parcels of 15.567 and 15 acres, more or less. The Department of Planning Services' staff recommends denial of this recorded exemption based upon noncompliance with the agricultural goal and policies as stated in the Weld County Comprehensive Plan as well as lack of efficient and orderly development. The 30.567 acre parcel is planted in grass hay at the present time. According to the Soil Survey of Weld County, Colorado, approximately two-thirds of the site is identified as prime farmland (Weld loam and 950119 I III Wiley -Colby complex, 1-3 percent slopes), if irrigated with an adequate supply of water. A portion of the area is identified as Farmland of Statewide Importance. This request, if approved, would allow the addition of two dwellings, intensifying the density of uses at this location, and result in the removal of agricultural land from production. The Comprehensive Plan promotes preserving the agricultural use of prime agricultural ground. Staff also has concerns regarding the piecemeal development that is occurring in this area of the County. This is the third request to subdivide the southwest quarter of Section 5. RE -36, approved in 1973 by the Board of County Commissioners, divided five acres from the remainder of the quartersection; this five -acre parcel is located adjacent to and south of the subject property and east of the Supply Ditch. A residence exists on this neighboring parcel. The resubdivision of farm parcels results in areas that are not economical to maintain as agricultural units. The land use then often takes on an urban -type nature with increased residential density, which is in direct conflict with surrounding agricultural areas. It is the opinion of staff that to further subdivide a parcel which is land -locked does not represent orderly development. Access to the existing parcel is by way of a private road over 500 feet in length. Approval of this recorded exemption would necessitate the extension of the easement another 500 feet from the county road to provide access to the "north" lot. It is staffs opinion that the proposal compounds a land use conflict that already exists. The Department of Planning Services' staff requests that the Board consider the level of development that is taking place in this area, the potential for continued subdivision and deny this recorded exemption request. We do have some additional capacity available in our existing 4" line located along WCR 3. Therefore, we will commit to provide service to a single 5/8" X 3/4" standard residential water tap with the following conditions: 1. In August of 1993 the Little Thompson Board implemented a "system impact" fee of $1000 per lot for all lots to be added to the system. 2. All improvements to District facilities required to provide service will be the financial responsibility of the developer in accordance with the District Rules and Regulations. All improvements must conform to District Specifications. 3. You will need to do a main line extension from the intersection of WCR 3 and WCR 36 East to a point where your service would be to your lot. You would be responsible for the line extension as well as for the design and installation of the line. Little Thompson Water District does have limited funds available for cost sharing on water line upgrades in the District. The Board reviews each candidate for cost sharing and determines if it is in the interest of the District to participate it the funding of line upgrades. The Company's main purpose is to supply irrigation water to our stockholders. When any plan is sent to the Board for review, they review the location of the plan and the direct and indirect impact on the ditch in that area. The Company requires a recorded 60 foot easement from the center of the ditch for maintenance purposes, for a total of 120 foot easement. No fences are allowed, which would deny access by our ditchriders to the ditch. Any crossing, above, below or through the ditch with an utility line, bridge or other structure requires a license agreement with the Company. The license fee for each crossing is $1000.00, with the licensee paying for all reasonable legal and engineering fees.
