Legal Description of Property: Part of the SE4 of Section 20, T4N, R64W of the 6th P.M., Weld County, Colorado Location: West of and adjacent to WCR 53 and approximately 1/4 mile south of WCR 54 1/4 (Sandy Knoll Blvd.) Zone District: A (Agricultural) Proposed Use: In 1977 a Conditional Use Permit (CUP-29) was approved for the existing church facility. This request will be an expansion to the existing use to the western portion of the property. Total Number of Acres: 1 .1 acre, more or less Access: Is existing onto WCR 53, which is paved. Comments: The Weld County Planning Commission recommends that the Board of County Commissioners conditionaV approve this request. The Planning Commission feels that this request is consistent with the Comprehensive Plan. This request lies within the Urban Growth Boundary Area of the Town of Kersey. The Town of Kersey states that this proposal is consistent with their Comprehensive Plan. Box 158 Kersey, CO 80644 REQUEST: A Site Specific Development Plan and Special Use Permit for an expansion of a church facility in the A (Agricultural) zone district. LEGAL DESCRIPTION: Part of the SE4 of Section 20, T4N, R64W of the 6th P.M., Weld County, Colorado. LOCATION: West of and adjacent to Weld County Road 53 and approximately 1/4 mile south of Weld County road 54 1/4 (Sandy Knoll Blvd). THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: A. This proposal is consistent with the Weld County Comprehensive Plan. The Comprehensive Plan encourages that such uses be located within the agricultural zone district and is provided for as a Use by Special Review. The subject site is located in the Urban Growth Boundary area of the Town of Kersey. B. The proposed use will be compatible with future development of the surrounding area and with future development. C. The site is not located within any overlay districts. D. The conditions of approval and development standards will ensure adequate provision for the protection of the health, safety, and welfare of the inhabitants of the neighborhood and County. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. 960202 USR-1099, Kersey Community Church Page 2 The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. The existing septic system is adequate for the proposed addition. It was previously designed for a congregation of 200 people. In the event the congregation becomes larger than 200 people, the septic system must be enlarged in accordance with County and State Regulations. 960202 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS Kersey Community Church USR-1099 1. The Site Specific Development Plan and Special Review Permit is for an expansion of a church facility in the A(Agricultural) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 4. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 5. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 6. There shall be no trees, structures, parking, vehicular traffic, etc. upon the existing septic system. 7. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure that the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 8. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 9. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. The Department of Planning Services' staff has considered the Kersey Community Church' s proposal to install up to two modular units on their property for Sunday School classrooms and has determined that more information is needed. Specifically, please meet with the Board and determine exactly what size the units will be and their exact placement. We will also need a plot plan or diagram showing the location of the proposed units. When the additional information has been received, the staff will meet and will be able to determine if an amendment to the Special Review permit will be required. We need more Sunday School Classrooms to facilitate those who come each Sunday as we now have two in tie sanctuary, another class in a home near the church and others in two small an area. 2. We need to enlarge the fellowship hall area because at present we cannot accomodate our needs for fellwwship, banquets, showers, receptions, youth activities if they are in attendance of one hundred. 5. We are endeavoring to go into a family hour on Sunday Evenings with sessions from little children through adults but we do not have enough area to do this. 4. At the present we are using the overflow area where the Sunday School opening excercise is. During the winter mon the from Sent. through May we use the overflow room for morning worship and this means that we h6ve to more benches around (pews) around for these two sessions. 4. We need a Sunday School office and a larger pastor 's study. 5. We are endeavoring to stay with the growth of our community. 6. We also would like permission on the possible lengthening of our uresent sanctuary facility of 40 ft . to the west , at a later date. This would give us about one hundred more seat— ing capacity. The purpose of these units would be for. Sunday School classrooms. We want to build an additional unit in 2-4 years (?) which would include a bigger sanctuary and Sunday School rooms.
