HomeMy WebLinkAbout660208.tiffENGINEERING SERVICES AGREEMENT THIS AGREEMENT is entered into as of the /i/o( day of lez7.4 t4'.', 1961,_, by MINER AND MINER, CONSULTING ENGINEERS, INC., of Greeley, Colorado, a Colorado Corporation, hereinafter called the "Engineer," and the CITY OF GREELIY, COLORADO, and the BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO, and the WELD COUNTY MUNICIPAL AIRPORT BOARD, their duly appointed and acting representative, hereinafter called the "Owner." WHEREAS, the Owner desires to retain the services of a Consulting Engineer, and WHEREAS, the Engineer represents that he has sufficient experienced personnel and equipment to perform, and the Owner desires the Engineer to perform, the engineering services herein described. NOW, THEREFORE, in consideration of the mutual undertakings herein contained, the Owner and the Engineer agree as follows: ARTICLE I SERVICES The Engineer shall provide the following services in conjunction with the renovation of the Weld County Municipal Airport lighting system, to -wit: 1. Assist with preparation of application for Federal Aviation Agency (FAA) funds. 2. Prepare construction plans and specifications for bidding pur- poses. 3. Meet with FAA officials and Weld County Municipal Airport Board members to obtain final approval of plans and specifications. 660208 -2- 4. Assist in advertising for bids, obtaining bids, analysis of bids, and in awarding contracts. 5. Provide field staking layout of facilities to be constructed. 6. Provide consultation, advice, and periodic inspection during construction. 7. Review estimates of progress and final payments to contractors. 8. make final inspection and approval of completed construction. 9. Prepare as -built plans and furnish necessary copies to FAA and Weld County municipal Airport Board. ARTICLE I1 COMPENSATION The Owner shall pay the Engineer for services performed hereunder as follows; 1. For all services described in Paragraphs 1, 2, 3, 4, 5, and 9 of Article I, above, the lump -sum fee of $1,040, to be paid in ac- cordance with the following schedule; $700 upon approval of completed plans and specifications $200 upon award of construction contract $140 upon submittal of as -built plans 2. For all services described in Paragraphs 6, 7, and 8 of Article I, above, the hourly rate of $15.00 per hour, which fee shall be paid monthly as billed , and which fee is estimated to be approximately $360. -3 - ARTICLE IIi GENERAL CONDITIONS 1. The Engineer warrants that he possesses License No. 4453 issued to him by the State of Colorado on the 1st day of January 1966. 2. in the event that the scope of work to be performed by the Engineer is substantially changed by the Owner or by mutual agreement between the Owner and the Engineer, or if redesign is required by the Owner after approval of plans and specifications, the Engineer shall re- ceive additional compensation for the additional services requirea. Payment to the Engineer by the Owner shall be the actual payroll costs plus actual expenses eer for the additional services. This Agreement shall become effective upon signing by both parties and shall remain in effect until completion of the services provided herein, provided, however, that this Agreement may be terminated at any time during the term hereof by either party giving 30 days written notice to the other of its intention to terminate. Upon such termina- tion, the Owner shall pay the Engineer for such services as may have been performed prior to such termination. 4. The Engineer warrants that he maintains the following insurance, and can furnish the Owner certificates of insurance, if requested. a. torkmen's Compensation Insurance covering all of our employees who shall perform any of the services on this project. b. Public Liability and Property Damage Liability. Bodily injury or death is $100,000 for one person and $300,000 for each acci- dent. Property damage is $100,000 for each accident and $100,000 aggregate. -4 - IN WITNESS WHEREOF, the parties have caused this Agreement to be duly executed on the day and year last above written.
