RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST LORENZO P. CAMACHO, JR./RAMONA AND LUCIO BENAVIDEZ
FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Lorenzo P. Camacho, Jr./Ramona and Lucio Benavidez, VI #9600049, are
allegedly in violation of the Weld County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of June, 1996, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Lorenzo P. Camacho, Jr./Ramona and Lucio Benavidez, property owners,
were not present or represented at said hearing, although all parties were notified of said hearing
by Department of Planning Services staff, and
WHEREAS,the Board of County Commissioners deems it advisable to delay referral of said
violation to the Weld County Attorney's Office for a period of sixty (60) days to allow adequate time
for the property owners to bring the subject property into compliance and for an inspection of the
property by the Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to proceed with legal action against the above
named individuals without further Board action if the subject property is not brought into compliance
within sixty (60) days.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that if said violation still exists on August 11, 1996, the Weld County Attorney
be, and hereby is, authorized to proceed with legal action against Lorenzo P. Camacho,
Jr./Ramona and Lucio Benavidez to remedy the violation of the Weld County Zoning Ordinance,
and any other persons occupying the properties, any persons claiming an interest in the properties,
and any persons acting in active concert with the identified parties.

place in the County Commissioners' Hearing Room, first floor, Weld County Centennial Center,
915 Tenth Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the
violation.

The uses on the above described property are being considered as a zoning violation of Section 31.2,
31.3 and 31.3.9 of the Weld County Zoning Ordinance. This is not a use allowed by right in the
Agricultural zone district.
The violation can be corrected by removing the non-commercial junkyard from the property. The non-
commercial junkyard consists of derelict vehicles, car parts and pieces, and other miscellaneous items.
The shed located on the property can no longer be used for temporary or overnight housing.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have 30(Thirty)
days from April 17, 1996 to correct this zoning violation.Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.

HIS DAD AND BROTHER WHO HAVE MEDICAL CONDITIONS . I TOLD HIM
I WOULD TRY TO FIND OUT WHAT OTHER OPTIONS HE MAY HAVE .
THERE HAS BEEN SOME PROGRESS IN CLEANING UP THE PROPERTY,
HOWEVER SEVERAL DERELICT VEHICLES, APPLIANCES AND USED
FURNITURE REMAINS ON THE PROPERTY. TO BRING THE PROPERTY

WELD COUNTY ZONING ORDINANCE. THE PROPERTY IS IN VIOLATI
OF SECTIONS 31.2 AND 31.3.9 OF THE WELD COUNTY ZONING
ORDINANCE AND SECTION 20.13 OF THE WELD COUNTY BUILDING C
ORDINANCE. THERE IS A NON-COMMERCIAL JUNKYARD LOCATED ON
THE PROPERTY CONSISTING OF A BUS, SEVERAL DERELICT VEHICL
PIECES AND PARTS OF VEHICLES AND OTHER MISCELLANEOUS ITEM
THERE IS ALSO SOMEONE LIVING IN A SHED TOWARD THE BACK OF
THE PROPERTY. I SPOKE TO THE PERSON LIVING IN THE SHED A
THE TIME OF INSPECTION. HE INDICATED TO ME THAT THERE AR
NO BATHROOM FACILITIES IN THE SHED AND THAT HE USES THE
BATHROOM IN HIS PARENTS HOME, LOCATED ON THE PROPERTY.
I TOLD HIM THAT I WOULD BE CONTACTING THE HEALTH DEPARTME
ABOUT THIS ALSO. TO BRING THE PROPERTY INTO COMPLIANCE,
THE NON-COMMERCIAL JUNKYARD MUST BE REMOVED FROM THE
PROPERTY OR BE TOTALLY SCREENED FROM ALL ADJACENT PROPERT
AND PUBLIC RIGHTS OF WAY. IF SCREENING IS TO BE INSTALLE
A DETAILED SCREENING PLAN MUST BE SUBMITTED TO AND APPROV
BY THE DEPARTMENT OF PLANNING SERVICES STAFF PRIOR TO
INSTALLATION. ALSO, THE SHED CANNOT BE USED AS A RESIDEN
IN ITS CURRENT CONDITION. THERE IS ALREADY A PRINCIPLE
DWELLING ON THE PROPERTY AND THIS WOULD BE CONSIDERED A
SECOND DWELLING. THEREFORE, THE SHED MAY NOT BE ABLE TO
