We have reviewed the revised application concerning the Faith Tabernacle Church. We have
also reviewed your preliminary Special Review Permit Administrative Review documents that
you provided to me on July 19, 1999. After reviewing these documents it appears that our
original recommendation, dated March 4, 1999, is adequate. However,we have the following
comments:
• After reviewing the submitted drawings we recommend that an additional Condition of
Approval be added that states "A primary and secondary septic system envelope shall be
designated for the septic system that will serve the Parsonage. The primary envelope
should be designated for the initial system, while the secondary envelope should be
preserved in the event the initial septic system should fail. The location of the envelopes
must be approved by the Health Department."
• The condition that we recommended in my memo dated June 21, 1999, should be
included as a Development Standard rather than a Condition of Approval.
As a final comment, we would like to stress that the Church should consider the possibility that
the City of Greeley Sewer may be available to them sometime in the future. As a result, we
would recommend that they consider this while they are designing any structures on the site.
They may want to construct the appropriate sewer lines and build in this option prior to
constructing the structures.

Our staff recently reviewed the draft Land Use Application Summary Sheet for the Faith
Tabernacle Church(USR-1217). As you are aware our Department has previously submitted a
recommendation for this proposed use. We have overlooked one significant item that should've
been a part of our recommendation. As a result, we recommend that the following language be
added as Condition of Approval 2.g of the Special Review Permit:
Any structure that will be served a septic system, and have a design hydraulic flow of
greater than 3,000 gallons (according to the Weld County ISDS Regulations), must
receive approval of the Colorado Department of Public Health and Environment in
accordance with the Regulations for the Site Application Process (5 CCR 1002-22).
The facility should contact Tom Bennet(303-692-3574) at the Colorado Department of Public
Health and Environment if they want to begin this process.

Environmental Protection Services has reviewed this application for an USR. As you know, this
application is for a church and associated structures. The application materials indicate that water will
be provided by the City of Greeley and that sewer will be provided by septic systems. We would prefer
that uses such as this one be served by sanitary sewer service. However, we have discussed the
availability of sewer service with the City of Greeley. According to Doris Biehl at the City, the nearest
sewer line is approximately one (1) mile away. Thus, it doesn't appear to be reasonable to require
sanitary sewer service.
We have divided our recommendations into Conditions of Approval and Development Standards.
Our recommended Conditions of Approval are as follows:
1) A primary and secondary septic system envelope shall be designated for the septic system that will
serve the proposed Family Life Center. The primary envelope should be designated for the initial
system, while the secondary envelope should be preserved in the event the initial septic system
should fail. The location of the envelopes must be approved by the Health Department.
2) A secondary septic system envelope shall be designated for the septic system intended to serve the
Sanctuary. This envelope should be preserved in the event the initial septic system should fail.
The location of the envelope must be approved by the Health Department.
Our recommended Development Standards are as follows:
1) Unless approved in accordance with the Regulations promulgated pursuant to the Solid Waste Act,
30-20-100.5, C.R.S., as amended, no permanent disposal of wastes shall be permitted at this site.
2) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
3) Fugitive dust shall be controlled on this site.
4) The maximum permissible noise level shall not exceed the residential limit of 55 db (A) as
measured according to 25-12-102, Colorado Revised Statutes.

5) Adequate toilet and hand washing facilities shall be provided for the public and employees.
6) The septic system for the sanctuary is designed for 300 persons per day. In the event the
congregation or visitors to the sanctuary exceed 300 on any given day, the facility shall
appropriately increase the design capacity of the septic system that serves that structure. The
capacity shall be increased in accordance with the Weld County I.S.D.S. Regulations.
7) An engineer designed septic system shall be installed in the future for the Family Life Center
Building according to the Weld County I.S.D.S. Regulations.
8) The facility shall utilize the City of Greeley water.

As we discussed today, it is our understanding that your Department will be requesting a
continuance for this application at its scheduled Planning Commission. Given this, we have a
couple of issues that we would prefer be addressed prior to our Department issuing a
recommendation. They are as follows:
1) There does not appear to be an area designated for the proposed septic system that will serve
the proposed Family Life Center. A primary and secondary septic system envelope should be
designated for the septic system that will serve this structure. The primary envelope should be
designated for the initial system,while the secondary envelope would be preserved in the event
the initial septic system should fail. The location of the envelopes should be shown on the plat.
2) The map provided in the application materials appears to show that there is adequate room for
the septic system that will serve the sanctuary. However,it also appears that the remaining area
surrounding the sanctuary will be developed as parking lots, etc. A secondary septic system

envelope should be preserved in the event the initial septic system should fail. The location
of this envelope should be shown on the plat.

Dear Rev. Perdew:
Please refer to our letter of December 9, 1998, in which the Water and Sewer Department confirmed
that water service would be provided for the new church facility at 71"Avenue and 28th Street. In
that letter it was also stated that the acquisition of water service was contingent upon review and
approval of plans for construction, an agreement for water service outside the city limits, and
payment of all fees prior to commencing development.
On June 23, Kaylun Watson of Faith Tabernacle Church telephoned to request a letter for the Weld
County Department of Planning Services outlining progress made toward completion of the City's
review process. This letter serves as a status report and will outline the issues yet to be completed.
Prior to the release of the building permit for the proposed sanctuary building, the following items
regarding water tap/service issues shall be resolved:
1. An Outside of City Water Agreement shall be signed by officials of the church. The basic
agreement will include a provision about when annexation must occur,payment of fees, and
compliance with all the rules, regulations and ordinances of the City of Greeley.
2. A site plan showing proposed water taps for domestic use, fire sprinkling lines, and fire
hydrants shall be submitted, reviewed, and subsequently approved by the Director of Water
and Sewer.
3. It is understood that payment of all applicable fees for plant investment fees, meters, and the
installation of taps on the water distribution system is required in advance. The fees due shall
be those fees required by current City ordinances and rate resolutions enacted by the Water
and Sewer Board of the City of Greeley.

Dear Ms. Watson:
The City of Greeley does have adequate water supplies to serve your new facility; however, there are
several issues which will need to be addressed before you proceed with your development.
As you know, the City Council at its August 4, 1998, meeting considered your proposal to utilize City
water service without annexing to the City of Greeley. The City Council approved your request for
water service contingent upon an agreement with the City of Greeley regarding the future annexation
of your property and development to City standards. Water service is dependent on City review and
approval of plans and construction. This principle was reinforced on October 6, 1998, when the City
Council approved Joint Resolution No. 66 which contains guiding principles for outside services.
Enclosed are copies of the minutes of the City Council proceedings and the Joint Resolution. •

Rick Brady stated that this Council may take the position to bind themselves to not exercise the
condemnation process to acquire open space lands but it could not bind future Councils. A
resolution stating Council's position would be suggested.
Mr. Wiest added that it is not possible to cover in the ordinance every possible method of land
acquisition and there may be methods available in the future that are unknown at this time. He
also noted that condemnation is desired by the seller in some situations since land being purchased
under the threat of condemnation can be an opportunity for the seller under tax laws.
Councilmember Anderson noted that she would like to alleviate the fear of condemnation that the
Open Space Committee encountered from landowners. She asked that Council go on record
through a resolution to state its intent.
Noting that two opportunities would be given for public input on August 18 and September 1,
1998, Councilmember Wanes moved, seconded by Councilmember Amaya, to introduce the
ordinance and schedule the public hearing and final reading for August 18, 1998, and it carried:

27. CONSIDERATION OF A JOINT RESOLUTION OF THE GREELEY CITY COUNCIL AND
GREELEY WATER AND SEWER BOARD FOR THE ESTABLISHMENT OF A WATER BANK
TO PROVIDE COMPETITIVELY PRICED RAW WATER TO INDUSTRIAL USERS IDENTIFIED
AND SELECTED BY CITY COUNCIL
Jon Monson, Water and Sewer Director, stated that the City desires to maintain a competitive
market to attract industries to the Greeley area which will provide desirable jobs and/or other
economic benefits to the city. Raw water is a significant component of the total development cost
and it is desirable to provide raw water to identified and selected industrial customers at a price
which will maintain a competitive market with other Northern front range cities. A water bank
could be established to purchase, acquire, hold and sell water to selected industrial users for water
not required to meet the City's existing level of drought protection.
Councilmember Selders asked if the bank would be funded with the existing Water and Sewer Fund
•
and whether there would be a requirement to always maintain the bank. Mr. Monson stated that
the bank would be funded with the existing Water and Sewer Fund and the bank would have the
ability to generate a return on this investment by renting the water.
Councilmember Anderson asked if this proposal would cause an increase in rates for water users.
Mr. Monson indicated that the water bank would not cause a rate increase.
Councilmember Anderson moved, seconded by Councilmember Slomer, to adopt the resolution,
and it carried: 7-0. (Resolution No. 52, 1998)
28. CONSIDERATION OF A REQUEST FOR WATER SERVICE TO PROPERTY OUTSIDE THE
CITY LOCATED AT 715i AVENUE AND 2B'" STREET
Jon Monson, reported that Faith Tabernacle Church has requested water service to a property
outside the city at the corner of 71st Avenue and 28th Street, the southern part of the old
Peterson-Alexander subdivision. Council policy is to consider such taps on a case by case basis.
The Director of Water and Sewer has no objection to providing water service to this property, but
urges Council to consult with Community Development regarding the comprehensive plan and the
effects of such development adjacent to the City limits.

Mr. Monson stated that if the request is approved, it would be standard to have an agreement to
require annexation when eligible. The applicant, however, has indicated a desire to delay
annexation as long as possible and at least for five years.
Councilmember Anderson stated that the effects of such development adjacent to the City limits
should be reviewed prior to Council's consideration.
Councilmember Selders asked about the reason for wanting to delay annexation. Mr. Monson
stated that the applicant indicated that development within the City would be financially prohibitive
during the same time in which the building is being built.
Danny Pordow, representing Faith Tabernacle, stated that the City has many more requirements
than the County which would be too costly for the church, and the neighbors to the north and east
also do not want to annex into the City, The church does have the water credits on record, since
1969, and would now like to have water service. A septic system is being planned, and the
church would like to construct the first phase of its facility.
Ms. Safarik stated that the effects of this development to the City has not been referred to the
Planning Commission for consideration although the technical issues of the proposal were reviewed
by the Administrative Review Team. From staff's perspective, it would appear that annexation
of this parcel may be possible although it may need to occur in phases. The land is clearly within
the City's long-range planning and influence area. It is possible to develop with a condition that
it be to City standards so that it is consistent with the uses along this corridor.
Mr. Perdew noted that a number of issues, including access points and turn lanes, would need to
be addressed up front if built to City standards, and the church could not afford to do so at this
time. It is felt that the County's standards are not inferior to the City's and the church desires to
build to County standards and utilize its water credits on record with the City.
Councilmember Selders asked about right-of-way dedication. Bill Sterling, Public Works Director,
stated that fifteen feet on both sides of the roadway would be needed for the right-of-way. If the
structure was built as planned, the church would then not conform to setback requirements. He
clarified that turn lanes would not be required at this time.
Mayor Nelson stated that there was some raw water dedication nearly 30 years ago and the
applicant is now asking for the benefit of water service. Council is compelled to ask that users of
City services comply with City standards. This property is along an entrance to the City, and the
City is asking that all customers be treated equally in that all meet the City's requirements
regarding building codes, rights-of-way, etc. He suggested that an outside service agreement be
considered with the requirement that annexation be completed when eligibility is met. The
agreement should come back before Council.
Councilmember Archibeque stated that he would favor granting the water service request provided
that an agreement can be reached with all of the City's departments involved, If the applicant is
not satisfied with the agreement, the applicant may return to Council on appeal.
Councilmember Selders moved to approve the request for water service contingent upon an
agreement reached between the applicant and city regarding annexation when possible and
development standards including right-of-way dedication, a traffic study prior to the second phase,
landscaping and parking. No turn lanes would be required and the septic system would be
permissible until it fails. Councilmember Slomer seconded the motion.

Mayor Nelson commented that he felt the action was a reasonable one considering that the
decision was made without adequate preparation.

Dear Kim:
Last fall, the Greeley City Council indicated the Faith Tabernacle church and site must
conform to City development standards to receive a water tap outside of the City limits.
In keeping with the spirit of the directive given by Council, on May 25, 1999, the Greeley
Planning Commission conditionally approved a plan for the development of the Faith
Tabernacle Church. Those conditions include:
1. Prior to the release of a building permit, the following shall occur:
A. A drainage plan meeting all City of Greeley criteria shall be submitted and
approved.
B. The applicant shall demonstrate to the City of Greeley the proposed Phase
I structures are set back at least 500 feet from surrounding oil and gas well
appurtenances.
C. The applicant shall submit a right-of-way dedication application to the
appropriate governing body(currently Weld County) for 10 feet of additional
right-of-way, a total of 60 feet from the centerline, adjacent to 71St Avenue
along the length of the entire site.
D. If construction is proposed from May 15 to September 15, a biologist's
report shall be submitted which indicates whether any burrowing owls exist
on the site. If the owls exist, a plan needs to be provided and approved by

the City of Greeley, demonstrating how the owls will be protected from
construction activity. Whenever construction is proposed, prairie dogs shall
be humanely euthanized.
E. In accord with Colorado law, the applicant shall address the needs of the
irrigation ditch which crosses this site.
F. A site plan is submitted to the City which illustrates compliance ability with
City requirements, which would be adhered to upon either annexation or
proposed construction of Phase II.
2. Prior to any Phase II development, the following shall occur:
A. A traffic study for Phase I and Phase II shall be completed, which indicates
where the appropriate access locations are.
B. A landscaping plan which shows conformance to City standards for Phases
I and II shall be submitted and approved.
C. Seventieth Avenue Court and associated easements shall either be vacated or
incorporated into the development of this site.
D. The location of the nearby oil and gas wells and appurtenances shall be
identified and 350-foot, 500-foot, and 1,000-foot radii shall be established
from all appurtenances. The development of Phase II shall comply with the
City of Greeley oil and gas regulations.
E. The applicant shall construct a sidewalk adjacent to the US Highway 34
Bypass frontage road, or in accord with City regulations, provide a bond for
the materials and labor to install the sidewalk.
Clearly there are several issues which remain to be resolved with this site, and the City and
County will have to continue to work closely together on this proposal to resolve conflicts
as they arise. While a normal course of action is for the City Planning Commission to
offer a recommendation to the Weld County Planning Commission, it seems that in this
particular situation, the City would have the opportunity to review water service to this site
if the conditions were not met by the development of this site. The City recognizes that
several issues regarding the development of this site requires coordination between the
developer, County, and City, and it may even be appropriate in this particular instance to
have the City sign off on the County building permit. From the City's perspective, the
conditions noted above are required.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Weld County Use By Special Review Standards. Our requirements are as follows:
1. Storm Water Retention. Items#24.5.1.5.1 and #24.5.1.5.2: A storm water retention facility shall
be provided and designed to retain the storm water runoff for a fully developed site. It should be
designed to release water at a quantity and rate not to exceed the quantity and rate of a five-year
storm falling on an undeveloped site. A storm water drainage plan will be required.
2. Urban Scale Development: The development is located in close proximity to a municipality
boundary and all internal streets shall be paved. All parking lots and loading areas shall also be
paved and striped. Curb, gutter and sidewalk usually accompany these developments.
3. Access: the applicant is indicating two access points onto WCR 29 (71st Avenue). Both accesses
shall require an adequate sized culvert and a stop sign. WCR 29 (71st Avenue) is designated as
a collector status road with an Average Daily Traffic Count of approximately 800 vehicles in a 24-
hour period.
The City of Greeley has identified WCR 29 (71st Avenue)as a minor arterial and has annexed within
one half mile of this location. The typical cross section reflecting the minor collector requires 90 feet
of right-of-way between intersections and 120 feet at the intersection. There is presently 60 feet of
right-of-way and an additional 15 feet should be reserved for future build out. Attached is the
detailed #S-5 from the City of Greeley to verify the typical cross section.
The south access is identified as US Highway 34 Bypass (Frontage Road). The applicant is
indicating a two-way entrance to this road. Please contact the CDOT to verify requirements for
improvements to this access points.
4. Traffic Impact Analysis Study: All significant developments shall be required to perform a traffic
Impact Analysis. All analysis information and reports shall be prepared and certified by a
professional engineer competent in traffic engineering.
5. Parking:The applicant is indicating 150-200 people will utilize the site. Weld County Public Works •
shall require at least half of the future parking lot be paved and striped to accommodate adequate
parking for Phase 1.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Weld County Use By Special Review Standards. Our requirements are as follows:
1. Storm Water Retention. Items #24.5.1.5.1 and 24.5.1.5.2: A storm water retention facility shall
be provided and designed to retain the storm water runoff for a fully developed site. It should be
designed to release water at a quantity and rate not to exceed the quantity and rate of a five-year
storm falling on an undeveloped site. A storm water drainage plan will be required.
2. Urban Scale Development: The development is located in close proximity to a municipality
boundary and all internal streets shall be paved. All parking lots and loading areas shall also be
paved and striped. Curb, gutter, and sidewalk usually accompany these developments.
3. Access: The applicant is indicating two access points onto WCR 29 (71st Avenue). Both accesses
shall require an adequate sized culvert and a stop sign. WCR 29 (71st Avenue) is designated as
a collector status road with an Average Daily Traffic County of approximately 800 vehicles in a 24-
hour period.
The City of Greeley has identified WCR 29 (71st Avenue) as a minor arterial and has annexed
within one half mile of this location. The typical cross section reflecting the minor collector requires
90 feet of right-of-way between intersections and 120 feet at the intersection. There is presently
60 feet of right-of-way and an additional 15 feet should be reserved for future build out. Attached
is the detailed #S-5 from the City of Greeley to verify the typical cross section.
The south access is identified as US Highway 34 Bypass (Frontage Road). The applicant is
indicating a one-way entrance this road. Please contact the CDOT to verify requirements for
improvements to this access point.
4. Traffic Impact Analysis Study: All significant developments shall be required to perform a Traffic
Impact Analysis. All analysis information and reports shall be prepared and certified by a
professional engineer competent in traffic engineering.
