RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS
Moved by Ron Sommer that the following resolution be introduced for passage the Weld County Planning
Commission. Be it resolved by the Weld County Planning Commission that the application for :

REQUEST: A Site Specific Development Plan and Special Use Permit for a private airstrip in the A
(Agricultural) zone district.
_LEGAL DESCRIPTION: Lot B of RE -966, located in the NE4 of Section 27, T5N, R67W
_of the 6th P.M., Weld County, Colorado.
LOCATION: South and adjacent to Weld County Road 54; west and adjacent to State Highway 257.
be recommended favorably to the Board of County Commissioners for the following reasons:
1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld
County Zoning Ordinance.
2. It is the opinion of the Planning Commission that the applicant has shown compliance with Section 24.3
of the Weld County Zoning Ordinance as follows:
This proposal is consistent with the Weld County Comprehensive Plan. This land use is located
within the Urban Growth Boundary area of the Johnstown and Milliken. The Urban Growth
Boundary area section provides for the County to encourage land -use development proposals
as long as they conform to the desires of affected municipalities. The town of Johnstown has
indicated that they find no conflicts with this proposal.
This proposal is consistent with the intent of the A (Agricultural) zone district and is provided for
as a Use by Special Review.
No overlay districts affect the site.
Special Review Permit Development Standards will provide adequate protection of the health,
safety, and welfare of the neighborhood and County.
This recommendation is based, in part, upon a review of the application materials submitted by the applicant,
_other relevant information regarding the request, and responses from referral entities.
The Planning Commission's recommendation for approval is conditional upon the following:
1. The attached Development Standards for the Special Review permit shall be adopted and placed on
the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of
-Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15
days of approval by the Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the
property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and
Recorder.

3. A runway safety -area measuring 120' wide and240' beyond each end of the runway shall be maintained
to ensure safe operations of aircraft.
4. Acc-ess from State Highway 257 -shall -not change in use.
5. Prior to recording of the plat:
a. The plat shall be amended to show the safety area surrounding the runway, as described above
in Condition of Approval 3.
b. The platshall be amended to show the -7_5' right-of-way measure from the center line of State
Highway -257 should expansion occur, -as indicated in the letter from Gloria Idler, dated April 26,
1995.
c. A copy of the amended plat shall be submitted to the Department of Planning Services for review
and -approval.

SPECIAL REVIEW PERMIT
DEVELOPMENT STANDARDS

1. The Site Specific Development Plan -and Special Review permit is for an a private -airstrip in -the A
(Agricultural)zone district as submitted in the application materials -on file in the Department ofPlanning
Servicesand subject to theDevelopment Standards -stated -hereon.
2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County
Zoning Ordinance.
3. All construction on the property shall be in accordance with the requirements of the Weld County
Building CodeOrdinance.
4. The property owner or operator shall -be responsible for complying with the Design Standards of
Section 24.5 of the Weld County Zoning Ordinance.
5. The property owner or operator shallibe responsible for -complying with the Operation Standards of
Section24.6-of the Weld County -Zoning Ordinance.
6. The site shall be maintained in compliance with the Federal Aviation Administration regulations.
7. Access from State Highway 257 shall not change from -existing use.
8. A runway safety area -measuring 120' wide and extending240' beyondoach end of the runway shall
be maintained to ensuresafe operations of aircralt.
9. No commercial use shall be associated with thissite without proper permits.
10. Personnel from the WeldCounty-Health Department and Weld -County Departmenthf Planning Services
shall begrantedaccess onto the property at -any reasonable time in order to ensure the activities carried
out on thepropertyxomply with the Development Standards stated -hereon and all Major changes from
the -plans or Development -Standards as shown or stated shall require the approval of anmendment
of the Permit by the WeldiountyPlanning Commission and the -Board of County Commissioners before
such changes from the plans or DevelopmentStandards are permitted.
11. The Special Review area shall be limited to the plansshown hereon and governed by the foregoing
Standards and all applicable Weld _County Regulations. Any other changes shall be filed in the office
of the Department of PlanningServices.
12. The property owner or operator shall be responsible for complying with all of the foregoing Development
Standards. Noncompliance with any of the foregoing Development Standards may be reason for
revocation of the Permit by the Board of County Commissioners.
