RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST EARL HOOD FOR VIOLATION OF THE WELD COUNTY ZONING
ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Earl Hood, VI#9800105, is allegedly in violation of the Weld County Zoning
Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of September, 1998, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Earl Hood was not present or represented at said hearing, although all
parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against the individual as
hereinabove named to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Earl Hood to remedy the violation of the Weld County Zoning Ordinance, and
any other persons occupying the properties, any persons claiming an interest in the properties,
and any persons acting in active concert with the identified parties.

CASE SUMMARY
July 15, 1998 Initial complaint received regarding a noncommercial junkyard consisting of derelict
vehicles, miscellaneous vehicle and engine parts, and miscellaneous debris.
July 8, 1998 Site inspection conducted by Sharyn Frazer, Zoning Compliance Officer. A
noncommercial junkyard does exist on the property.
July 8, 1998 Five day contact letter sent.
July 8, 1998 Printout from the SLIC system. The property owner has had three previous violations
in the past. The dates are August 28, 1984, March 2, 1988, and November 29, 1989.
Two were building code violations for lack of permits, and one was a zoning violation
for a noncommercial junkyard.
July 16, 1998 Progress inspection conducted. No progress has been made. The property is still in
violation.
July 16, 1998 Thirty day letter sent.
August 17, 1998 Progress inspection conducted. No progress has been made. The property is still in
violation.
August 19, 1998 Surrounding property owners telephone calls regarding status of the case.
August 19, 1998 Letter sent to Mr. Hood scheduling him to appear before the Board of County
Commissioners on September 8, 1998 at 10:00 a.m. One letter was sent regular mail
and a copy was sent certified since I have not been able to contact him in person or on
the telephone.
September 3, 1998 Pictures of the site were taken with the digital camera.
The noncommercial junkyard is still located on the property. This is a violation of Sections 31.2 and 31.3.9 of
the Weld County Zoning Ordinance.
The Department of Planning also recommends that the County Attorney be authorized to proceed with legal
action against any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties.
Copies of the violation materials are available at the Department of Planning Services' office or the Weld County
Attorneys Office.

The property referenced above remains in violation of the Weld County Zoning Ordinance. I have scheduled a
meeting with the Board of County Commissioners on September 8, 1998, at 10:00 a.m.to consider the violations
occurring on the property. This meeting will take place in the County Commissioners' Hearing Room, first floor,
Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners might have about
the violations.
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation, the action necessary to correct the violation, and that you
were given sufficient time to remedy the violation. If you have any questions concerning this matter, please call

The uses on the above described property are being considered as a zoning violation of Sections 31.2 and 31.3.9
of the Weld County Zoning Ordinance.
There is a noncommercial junkyard located on the property consisting of derelict vehicles, engine parts, tires,
drums and miscellaneous debris.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however, we
have no discretion in this matter if you fail to correct this violation. You have 30(thirty) days from July 16, 1998,
to correct this zoning violation. Failure to do so will result in this office scheduling the violation before the Board
of County Commissioners to consider whether to refer the violation to the County Attorney's Office for legal
action.
