By the Commission: Application No . 256 of the Board of County Commissioners of Weld County , Colorado , for the location of a public crossing was not seriously disputed by the respondent railroad company , the contention of the company being that if such crossing were to be allow- ed then the public crossing and the private crossing now in existence heretofore allowed by the Commission in Application No . 38 , Decision No . 255 , dated June 13 , 1919 , both near thereto , should be closed as Get forth in the pleadings of the yailroaa company . All of these locations are between the stations of Hudson and Tonville , and are all within a dis- tance of about one and one- eighth miles . It is very clear that the crossing supplied for by the Board of County Commissioners in Application No . 256 should be allowed . It is along a section line and public highway and is in the open country where a view of the railroad track may be had from either crossing for a long distance in both directions . The location is in the midst of homes and within a good irrigated farming section where the requirement for crossing railroad tracks is apparent . The establishment of the crossing wc uld clearly be of advantage to the farmers in marketing their crops , and it also appears that if it were so placed good tenents could be readily secured for ad jac •: nt land in the matter of raising beets , for the reason that it would remove danger or inconvenience in the matter of children attending school and residing in the vicinity who are now required to cross tracks and climb through fences in order to reach the school bus which can not now travel along the particular highway . Besides the evidence shows that the school bus can be operated at about 700 . 00 less per annum if the crossing is established . The fact that the adjacent lands may be cultivated to beets will add to their usefulness and value . It is plain th- . t the cross- ing should be allowed . In regard to Application No . 271 , it does n:) t appear from the evidence that there is any good and sufficient rea®on why the other public crossing or the private crossing now in existence and heretofore allowed by the Commission in A :: placation No . 38 , Decision No . 255 , dated June 13 , 1919 , should be closed . The only suggestion in this respect is the question of expense of maintenance and possible increase of danger . As to the expense of maintenance no evidence was offered . The Commission asked twice of wit- nesses for the respondent , who for ev . r;T reason should know as to the expense of main- tenance , but the question was both times evaded and no information given . Inasmuch as the county in such cases must es ablish and maintain the grading , the expense of main- tenance to the railroad must be very slight . The increased danger by reason of these crossings being close together w,:.s not made clear , the respondent relying on the alleged rule that crossings should be limited to a specific number per mile . In t'- is case the engineer may have a complete view in approaching the first , going in either direction , and there being no material grade the train operates practically on a level . The commission personally visited the territory affected , and from this and the evidence introduced has reached the conclusion herein expressed without hesitation . PPP 21.0 ORDER . IT IS THEREFORE ORDERED , That a public highway crossing at grade be , and the same is hereby , permitted to be opened and established across the right-of-way and track of the Chicago , Burlington & Quincy Railroad Company at a point where the main line of the said railroad intersects the section line between Sections 16 and 21 , in Township 1 North , Range 65 West , 6th principal Meridian , in Weld County , Colorado . IT IS FURTHER ORDERED , That the crossing at the point above described be con- 11 structed in accordance with plans and specifications prescribed in the Commission ' s order In Re Improvement of Grade Crossings in Colorado , 2 Colo . P. U . C . 128 . IT IS FURTHER ORDERED , That the Chicago , Burlington & Quincy Railroad shall open and establish the crossing and shall bear the expense necessary thereto , except that the County of Weld , Colorado , shall have performed the work of grading , including such drainage as is necessary for the establishment of proper approaches to said crossing . IT IS FURTHER ORDERED , That the public crossing and the private crossing now in existance and heretofore allowed by the Commission in Application No . 38 , Decision No . 255 , dated June 13 , 1919 , be , and remain , the same as at present . Halderman , Chairman: I did not sign the order and decision in the above entitled matter , and could not consistently do so , for the following reasons : Two public crossings at grade with a private crossing at grade , all within a dist- ance of one and one- eighth miles , over the line of a transcontinental railroad with frequent trains , many of them fast express trains , in violative of the principles that the state and national authorities , as well as the railroad carriers throu :r} out the country , have been , and are , so urgently insisting upon in the interest of the " safety first" movement . G./ While I was not present at the hearing in these particular cases in aeptember of this year , I did go upon the ground in June of 1919 when this matter was before the Commission and I am , therefore , familiar with the topography of the country . While the opening of the additional crossing as applied for in Application No . 256 will meet the convenience of some people , that would be true were there a crossing at grade at every half mile or less through- out the entire length of the railroad ; but , as I understand , the governing the controlling II principle in cases of this character is , that the convenience of the public must give way to the safety of the public whenever and wherever it is practically possible so to do . I would have been in favor of permitting the establishment of the crossing at grade as applied for in Application No . 256 provided the existing crossing , as described in Application No . 271 , were permitted to have been closed . The permitting of two crossings at grade , with a private crossing midway , in this western country where the density of population is by no means congested is , in my opinion not only contrary to the principle of safet y first in the interest of the public , but is unreasonable , unwarranted and unjustified from any point that it may be viewed . WHEREAS , It has been certified to the Board of County Commissioners of Weld County , by the Board of Directors of the Henrylyn District , that the sum of $151920`. 00 is required to be levied for the purpose of paying interest which will become due durinz. the year 1924 on the outstanding Bonds of said District , and that the sum of $351000 . 00 , is required ' t,o be levied for the purpose of paying the installment of principal which will become due during the year 1924 on the outstanding bonds of said District , and that the amount required to meet the maintenance , operating and current expense of said district , for the fiscal year cor:mencing on the first day of January 1924 , is 100 . 3 mills for each acre of land assessed in 1923 for the purposes of said District , according to the valuation placed thereon for District purposes , incl_udiii : the 15-;o which the Board of County Commissioners is required to add in making the levy for said expense to cover delinquencies ; and WHEREAS , the returns from the Assessors of Weld and Adams Counties , show the total assessment and valuation for the purposes of said District , of the real estate included in said District and assessable for the purposes of said District , to be $309510 . 00 ; NOW , TfEREFORE , BE IT RESOLVED , That 491 mills on the dollar of assessed valuation for irrigation district purposes is hereby fixed as the rate of levy necessary for interest which will become due during the year 1924 on the bonds of said District , and that a levy at said rate of 491 mills on the dollar of valuation , to raise the amount of money required to pay the interest which will become due during the year 1924 on the bonds of said District , be and the same is hereby made on all the assessable real estate included in said District , situated in said County of Weld. Straight offered the following resolution , and moved its adoption to-wit : - WHEREAS , many owners and holders of lands which are included in , and a part of , an irrigation district in Weld County , Colorado , have heretofore failed to pay taxes levied and assessed against their ' respective lands for irrigation district purposes , or 'for general County purposes , or for both ; and because of such failure , said lands have been sold at tax sale , and in some instances have been striken off of the County of Weld , and in other instances to the irrigation district of which the land so sold was a part ; and in some cases the owners of the land desire to obtain an assignment of tax sale certificates for the purpose of obtaining tax deeds or for assisting the owner of said premises , or the holders of encumbrances thereon ; and it is deemed advisable by this Board to adopt a procedure whereby as many lands as possible will be returned to the tax rolls with the least inconvenience to the officers of this County , and the persons in interest , resepectively. Fred W . Steele , County Treasurer of Weld County , appeared before the Board of County Commissioners of Weld County and represented that the tax rolls and tax warrant for 1923 have not been delivered to him , and that he is informed the County Assessor will not have the same ready for the delivery before the 18th day of February , 1924 , being approximately seven weeks later than the time provided by statute ; That , due to said delay , the County Treasurer will be unable to accept payment of taxes from any taxpayer prior to the 18th day of February , 1924 , nor within ten days of the time when the first half of all taxes will have become delinquent ; that with due dilia-ence , and making allowance for the time which will be necessary in getting out tax notices and making prepar- ations in the Treasurer ' s office for the collection of said taxes , and giving tax payers a reasonable time within which to pay the first half , it will be March 1 before the treasurer can reasonably expect to begin to receive collections . Straight moved the adoption of the following resolution: WHEREAS , the County Assessor by action of The Colorado Tax Commission and The State Board of Equalization , and the controversy over the 1923 assessment in Weld County , has been delayed in completing the tax rolls for the year 1923 , and has not yet delivered the tax rolls and tax warrant to the County Treasurer of Weld County , and it is improbable he will do so within ten days prior to March 1 , AND WHEREAS , cue to saic delay on delivery of tax rolls and tax warrant to him , the County Treasurer will have been delayed at least seven weeks in making collections of taxes and preparation necessary for collection thereof , and in giving notice to tax payers , and before collection of taxes can be practically begun , it will be March 1 , the date provided by statute when taxpayers shall pay interest on the first half of taxes , AND WHEREAS , thereby the County Treasurer has been unable to send out notices of taxes to the several thousand taxpayers in the county , and reasonable time should be given taxpayers after they receive notice within w _ich to make payment without interest being charged ; NOW , THEREFORE , BE IT RESOLVED , subject to approval hereof by The Colorado Tax Commiss- ion , that the County Treasurer of Weld County , Fred W . D . , 1924 , by and between the county of Boulder , a body politic and corporate , of the Rate of Colorado , and the County of Weld , a body politic and corporate , of the State of Colorado , WITNESSETH: THAT WHEREAS said Counties , acting thrugh their Board of Commissioners , have heretofore and on , to-wit , the 14th day of July , A . D . 1915 , entered into articles of agreement for the i ,,c ,f maintenance of the public road lying between said Counties , and have heretofore entered into j various other arrangements , understandings and agreements in respect to the maintenance of said / toad , and it is the desire of both Counties that all such arangements , understandings and agreements be abrogated from and after the date of this instrument , and that the future main- tenance of said road by said Counties be fixed and determined herein . NOW , THEREFORE , In consideration of the premises and the mutual covenants and agree- ments of the parties hereto , it is hereby covenanted and agreed by and between said parties as follows , to-wit : The County of Weld hereby agrees to maintain the said public road and bridges on the line between boulder and Weld Counties commencing at the North boundary of Boulder County and extendingfrom thence South to the center line of Section 13 , Township 2 North , Range 69 West of the 6th P . M.
