HomeMy WebLinkAbout990441.tiff RESOLUTION S/S RE: ACTION OF BOARD AT SHOW CAUSE HEARING CONCERNING VACATION OF CHANGE OF ZONE 0466 FOR A PLANNED UNIT DEVELOPMENT - PASQUALE VARRA WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on February 17, 1999, a Show Cause Hearing was conducted to consider vacation of Change of Zone#466 issued to Jack and Marjorie Edson, % Jake Edson, 11623 Quivas Circle, Westminster, Colorado 80234, and WHEREAS, Pasquale Varra, 2150 South 96th Street, Broomfield, Colorado 80020, is the current owner of the facility located on property described as part of the NW % NW '/ of Section 10, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, at said hearing the Board deemed it advisable to continue said matter to March 8, 1999, at 10:00 a.m., to allow adequate time for publishing a corrected notice, and WHEREAS, at said hearing of March 8, the applicant was present, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, Finds that said Change of Zone should be vacated for the following reason: 1. Failure to submit Final PUD Plan within three years or to obtain an extension thereon, per Section 28.15.5 of the Weld County Zoning Ordinance, which states: "Failure to submit a PUD Plan. If no PUD Plan application is submitted within three (3) years of the date of the approval of the PUD District, the Planning Commissioner shall require the landowner to appear before it and present evidence substantiating that the PUD project has not been abandoned and that the applicant possesses the willingness and ability to continue with the submittal of the PUD Plan. The Planning Commission may extend the date for the submittal of the PUD Plan application and shall annually require the applicant to demonstrate that the PUD has not been abandoned. If the Planning Commission determined that conditions or statements made supporting the original approval of the PUD Zone District have changed or that the landowner cannot implement the PUD Plan, the Planning Commissioner shall recommend to the Board of County Commissioners that the PUD District approval be revoked. Wendi Inloes Secretary MEMORANDUM TO: Weld County Planning Commission December 15, 1998 - ,r.y' x�: From: Scott Ballstadt, Planner l� SUBJECT: Z-466 Edson PUD/Clay Varra The following is a chronological list of correspondence between Mr. Varra, his staff and the Department of Planning Services: 11/10/98 Department of Planning Services letter to Mr. Varra informing him that Final Plan for Edson PUD has not been received or recorded. 11/10/98 Staff left voice message and message with Mr. Varra's office staff. 11/16/98 Staff left message with Peter at Midtown Materials that Mr. Varra had not returned messages- Peter indicated that the messages had been relayed to Mr. Varra. 11/17/98 Department of Plaftrning Services letter to Mr. Van-a informing him that staff would like to meet with him to establish a Planning Commission date and that such meeting shall be within seven days of letter date. 11/20/98 Mr. Varra called Scott Ballstadt, Planner II, and indicated that the Final Plan had been approved and recorded. Mr. Ballstadt requested evidence of such from Mr. Varra and it was indicated that such evidence would be submitted to the Department of Planning Services by Wednesday, 11./25/98. No such evidence has been submitted as of 12/15/98. 12/2/98 Staff left voice message and message with Peter at Midtown Materials that Planning Commission hearing would be at 1:30 pm on 12/15/98. Peter indicated that he would convey the message. 12/4/98 Department of Planning Services letter(certified return receipt received by . Dept.) to Mr. Varna informing him that Planning Commission would hear his case on 12/15/98 12/9/98 Lisa from Midtown Materials called and indicated that Mr. Varra cannot attend Planning Commission on 12/15/98 12/9/98 Scott Ballstadt retumed Lisa's call, informing her that the Planning Commission may continue the case or may decide to hear the case on 12/15/98. Lisa was informed that a representative should be present. 12/14/98 Mr. Varra left a voice message for Mr. Ballstadt that he could not attend, but he may possibly have a representative available. He did not leave a return phone number and indicated that he would call back in the afternoon. No call was received. The original owners (Mr. and Mrs. Jack Edson)were granted an extension to submit a Final Plan application which expired June 1, 1994. The Department of Planning Services had not received any further correspondence on the property until Mr. Varra inquired about his landscaping . business which is currently in operation. Planned Unit Development district Z-466 was approved for I-1 and C-3 uses by the Board of County Commissioners on June 1, 1992. .. LaVem Nelson, P.E., Nelson Engineers, submitted a letter received December 14, 1992 on behalf of Mr. and Mrs. Jack E. Edson requesting a 6 month extension for the submittal of a PUD Plan. P'` • • Z-466 Memo Page 2 Lanell Swanson, Current Planner, responded back to Mr. Nelson with a letter dated December 15, 1992. Ms. Swanson's letter informed Mr. Nelson that Section 28.15.5 provides one (1)year from the date of PUD District approval to submit a PUD Plan or the applicant would need to appear before the Planning Commission to substantiate that the project has not been abandoned. Section 28.15.5 has been amended since that time and now provides for three (3) years. LaVem Nelson, P.E., Nelson Engineers, submitted a letter dated May 5, 1993 on behalf of Mr. and Mrs. Jack E. Edson requesting an extension for tile submittal of a PUD Plan "...beyond June 1, 1993 to June 1, 1994, in order to further negotiate...water and sewer service..." • LaVem Nelson, P.E., Nelson Engineers,then submitted a letter dated June 7, 1993 on behalf of Mr. and Mrs. Jack E. Edson requesting an extension for the submittal of a PUD Plan. The Planning Commission heard the request on June 15, 1993. LaVerr.►tlelson explained that the extension would allow adequate time to negotiate and obtain water and sewer services jointly with an adjacent PUD. The Planning Commission approved the one (1) year extension until June 1, 1994. The Department of Planning Services' records do not indicate any further contact or extension requests since the June 15, 1993 Planning Commission. I returned your call in response to that letter on November 22, 1998. You had indicated that the Final Plan for Edson PUD had been approved and recorded and that you would submit such evidence to me by Wednesday, November 25, 1998. Since I did not receive such evidence I have scheduled this matter before the Weld County Planning Commission for Tuesday, December 15, 1998 at 1:30 p.m. As I stated in my previous letter, Section 28.15.5 of the Weld County Zoning Ordinance states, 'failure to submit a PUD Plans If no PUD Plan application is submitted within three (3) years of the date of the approval of the PUD District, the Planning Commission shall require the landowner to appear before it and present evidence substantiating that the PUD project has not been abandoned and that the applicant possesses the willingness and ability to continue with the submittal of the PUD Plan. The Planning Commission may extend the date for the submittal of the PUD Plan application and shall annually require the applicant to demonstrate that the PUD has not been abandoned. If the Planning Commission determined that conditions or statements made supporting the original approval of the PUD Zone District have changed or that the landowner cannot implement the PUD Plan, the Planning Commission shall recommend to the Board of County Commissioners that the PUD District approval be revoked. It will be your responsibility to demonstrate that the PUD project has not been abandoned and that you possess the ability to continue with the submittal of the PUD Plan. Additionally, you will need to provide the Department of Planning Services with a copy of the deed to the property which indicates your legal interest in the property. The Department's current records contain a copy of your contract to purchase the property dated March 26, 1998. You would then need to submit the PUD Plan application for review. Should the Planning Commission determine that bonditions or statements made supporting the original approval of the PUD pne District have changed or that you cannot implement the PUD Plan, the Planning Commission shall recommend to the Board of County Commissioners that the PUD District approval be revoked. If the Board agrees after a public hearing, the Board may revoke the PUD zone district and order the recorded PUD zone district reverted to the original zone district and you would need to begin the process with a new sketch plan application. r In either case, until this matter has been resolved, you shall cease all activities on the site which have not received appropriate Weld County land use approval. As I mentioned in my previous letter, the zoning and building code violations will need to be addressed. Your property is currently in violation of both the Weld County Building Code and Weld County Zoning Ordinance. The Weld County Building Inspection Department does not have record of building permits for the manufactured home being used as an office on site and the Weld County Health Department does not have record of a septic permit for such home. In addition to the zoning violations related tp the landscape supply buisness you are operating, the modular home also requires a Flood Hazard Development Permit in accordance with Section 26 of the Weld County Zoning Ordinance. It is the intention of this office to assist and cooperate with you without imposing undue hardships; however, we have no discretion in this matter if you fail to work towards bringing your property into compliance. The rezoning hearing occurred on June 1, 1992. The period of extension shall begin on the date of expiration of the existing approval period. Mr. and Mrs. Edson have stated that the referenced project has not been abandoned and that they 1 are pursuing plans to complete the project. Extension of water and sewer services to the site4have delayed development activity.
