RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION #1751 - CONGER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1751, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1751 was submitted by Vernon and
Florence Conger, 33177 Pikes Peak Drive, Greeley, Colorado 80631, for property which is
described as Lot B of RE #775, located in the NW% of Section 30, Township 8 North, Range 65
West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which
shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
150 acres and 3 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1751 submitted by
Vernon and Florence Conger be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home septic system. It
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
2. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.

Dear Commissioners:
This application for a recorded exemption in the A (Agricultural) Zone District is submitted by Vernon
and Florence Conger. The parcel of land is described as Lot B or RE -775, located in the NW4 of
Section 30, T8N, R65W of the 6th P.M., Weld County, Colorado. The property is located south of
and adjacent to Weld County Road 90 and east of and adjacent to Weld County Road 37. The
request is to divide a 153 acre parcel into two parcels of 150 and 3 acres, more or less.
RE -775 was approved by the Department of Planning Services' staff on August 6, 1985. The
applicants are now requesting to further subdivide Lot B or RE -775 into two lots of 150 and 3 acres,
more or less. The applicants have stated their application that the reason for the recorded
exemption is to provide a residence for a family member who assists in the farming and ranching
operations. Currently there are no improvements on the property.
North Weld County Water District is the proposed water source for both Lots A and B. Septic
Systems will provide sewage disposal on both proposed lots. Access to both proposed lots is
existing onto Weld County Road 37. The Weld County Health Department and Public Works
Department have both reviewed this request and have no conflict of interest.

The Department of Planning Services' staff recommends conditional approval of this request based
upon the following:
this proposal is in conformance with the Weld County Comprehensive Plan in that it enables
the property owner to provide a residence for direct members of the farm family and also for
workers employed at the farm;
this proposal is consistent with the existing surrounding land uses;
this proposal is consistent with the A (Agricultural) Zone District;
this proposal is consistent with orderly and efficient development;
provides for adequate provision for the protection of the health, safety, and welfare of the
inhabitants of the neighborhood and County;
this proposal is in compliance with the recorded exemption standards set forth in section 11.8
of the Weld County Subdivision Ordinance.

To create a 3.0- A. tract for a new residence for family member who assitts
in the farming & ranching operation of the Congers'.

RE -775 was filed August 14, 1985. Lot A of 14.14 A. will remain as is.
This+request is to file a Recorded Exemption to divide Lot B of RE -775
(160- A.) into two lots. Present use of this tract is dryland farming
and pasture.
3. Explain how the proposal is consistent with the Weld County Comprehensive
Plan and any adopted municipal plan, if applicable.
This proposal creates one new building site on the tract. The land is
not prime agricultural land. The site is located 2 miles East of Pierce
and does not affect any municipal plans or overlay districts.

houses located just under the ditch are objectionable because if the
ditch overflows it could either fill their cellar or erode or wash their
yard. If the applicants are going to build a house, it should be built
above the ditch, not just below it, because all areas below the ditch
are technically in some form of a flood plain, the flood coming from
the overflow of the ditch. The overflow can arise from various types
of obstruction, weeds, trash and other items getting in a ditch, and
the practical
operation lateral such as the Good Lateral does
occasionally have these overflows.
