Environmental Health Services has reviewed this proposal for an Agricultural Service Establishment. The
following conditions are recommended to be part of any approval:
1. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects
against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site.
3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site.
5. The maximum permissible noise level shall not exceed the commercial limit of 60 db(A), as measured
according to 25-12-102, Colorado Revised Statutes.
6. Adequate toilet facilities shall be provided for the public.
7. The facility shall utilize the existing public water supply (North Weld Water District).
8. The existing septic system that serves the apartment, office, and shop (#SP-970O140) shall be
reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation
of the system and an evaluation of the systems ability to handle the proposed hydraulic load. The
review shall be submitted to the E.H. Division of the W.C. Health Department. In the event the
system is inadequately sized or constructed, the system shall be brought into compliance with current
regulations.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Weld County Use by Special Review Standards. Our comments are as follows:
1. WCR 13 Access: Please send a referral to Larimer County as they have jurisdiction over all
maintenance and access points at this location.
2. Main Access and Circulation:The main access road is in good condition and well maintained and
consists of recycled asphalt base. The circulation pattern will accommodate truck and trailer
combinations. Adequate gravel has been placed through the circulation pattern.
3. Off-Site Parking: The applicant is indicating approximately ten parking slots which will
accommodate five to seven potential buyers a week and approximately four full time employees.
4. Storm Water Drainage: The proposed site is surrounded by the owners property. No new
structures or asphalt areas are proposed. Storm water drainage does not appear to be a factor.

DEPICTION: Very Low Density Single-family Residential.
RECOMMENDATION: Recommend approval of Site Specific Development Plan and Use
by Special Reyiew to Weld County Planning Services as presented.
DISCUSSION:
The Applicant, Ms. Michelle A. Eicchom, is requesting approval of a site specific development
plan and use by special review in order to continue the agriculture uses and establish both a light
industrial equipment dealership and a rental apartment on a forty-nine (49) acre parcel along
WCR 13.
As it can be seen from the enclosed map, this parcel is shown as very low density single-family
residential, and therefore the proposed low intensity and low density use appears to be! consistent
and compatible with Windsor's Land Use Plan.
As such, staff recommends approval of this proposal, as presented, and, since there is not any
subdivision taking place at this time, the dedication of any additional right-of-way does not seem
appropriate at this time.

Dear Mr. Eichhorn:
I his letter is to give you my opinion regarding the adequacy of the septic system
(recently installed under Permit #SP-9700140) for additional load from customers
visiting your farm shop where you will now offer small tractors for sale_
Whenthis system was installed the absorption bed measured 648 sq. ft. which was
greater than the required minimum of 564 sq- ft.
Your shop is not on the roadside and open to passer-by drop-in customers but: is
set well back on the property behind the main house, so more than likely visitation
will be restricted to calls more-or-less on an appointment basis. Your estimate is for
a maximum of 6 such customers per week.
Should all 6 come on one day and each use your restroom at a rate of 7 gallons
each, using the Weld County Individual Sewage Disposal System regulation, that would
require an additional 90 sq. ft. of bed over the original minimum of 564 sq- ft which
closely equates to the 648 sq. ft- installed.
In my opinion the system as now installed is adequate for the proposed potential
additional use_

We have reviewed the submitted material and have the following comments:
It is my understanding that the section of Larimer County Rd 901 (Weld County Road 13)that this property takes
access from is maintained by Larimer County. This section of road is functionally classified as a Minor
Collector in Larimer County. Our right-of-way(ROW)requirements for Minor Collectors is 100 ft of total ROW,
or 50 ft half ROW. Therefore,we would recommend that Weld County ask the applicant to dedicate the
necessary ROW to meet the 50 ft half ROW standard.
Since Larimer County is,responsible for the maintenance of this section of the county line road, it is my
understanding that Mike Bryant, Larimer County's Access and Utility Coordinator, will be responsible for
issuing the access permit for the proposed land use. Mike spoke to Weld County's Access Coordinator and our
understanding is that Weld County only allows one main access for a proposal like this. The applicant will need
to contact Mike to obtain an access permit for the main access prior to construction of the access. Mike can be
reached at(970)498-5709.
We are assuming that the other access shown on the plan, labeled"Alt. Access", is an existing access point for
the Larimer and Weld Canal and will also serve as a secondary access for the property.
