RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST GUADALUPE AND ROSE CHAVEZ FOR VIOLATION OF
THE WELD COUNTY BUILDING CODE ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Guadalupe and Rose Chavez, VI #9800068, are allegedly in violation of the
Weld County Building Code Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of July, 1998, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Guadalupe and Rose Chavez were not present or represented at said
hearing, although all parties were notified of said hearing by Department of Planning Services
staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
as hereinabove named to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to
proceed with legal action against Guadalupe and Rose Chavez to remedy the violation of the
Weld County Building Code Ordinance, and any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active concert with the
identified parties.

CASE SUMMARY
April 2, 1998 Initial complaint received from the Hudson Fire Department. Inspection revealed that
the south half of the building(auto repair with lube pit and overhead hoist) is burned
out. Bar trusses for the roof have collapsed. Need engineer to approve re-use of
structural steel post approximately 5" x 8". Two danger signs were posted.
April 30, 1998 Certified letter from Dave Sprague, Building Official, sent requesting immediate
vacation of the structure and entry areas secured. Options listed in the letter included
demolition or repair of the structure.
May 27, 1998 Inspection conducted. No work in progress.
July 1, 1998 Letter sent from Dave Sprague, Building Official, scheduling Mr. and Mrs. Chavez to
appear at the July 14, 1998, at 10:00 a.m., Board of County Commissioners Violation
Hearing.
The Department of Planning Services recommends that the County Attorney authorize legal action against any
other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting
in active concert with the identified parties.
Copies of the violation materials are available at the Department of Planning Services' office or the Weld County
Attorneys Office.

The property referenced above remains in violation of the Weld County Building Code Ordinance. I
have scheduled a meeting with the Board of County Commissioners on July 14, 1998, at 10:00 a.m. to
consider the violation occurring on the property. This meeting will take place in the County
Commissioners' Hearing Room, first floor, Weld County Centennial Center, 915 Tenth Street, Greeley,
Colorado. It is recommended that you or a representative be in attendance to answer any questions
the Board of County Commissioners might have about the violation.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation, the action necessary to
correct the violation, and that you were given sufficient time to remedy the violation. If you have any

Dear Guadalupe & Rose Chavez,
After inspecting the fire damaged steel building at 20857 WCR 12, Hudson, Colorado, April 2, 1998, it is has
been determined by the building official that the building is a dangerous structure as defined in the 1994 Uniform
Code for the Abatement of Dangerous Buildings Section 302.
As a result of the extensive fire damage, the building needs to be immediately vacated and secured against entry.
Two options are available. The building may be demolished and the resulting debris properly removed from the
property, or the building repaired and brought into a safe and structurally secure condition. Whichever option
is chosen, a building permit will be required before any work is commenced.
If the building is to be demolished, a letter from a qualified asbestos inspector stating that there is no asbestos
in the building will be needed at the time application is made for the demolition permit. If the structure is to be
repaired, a building permit is required prior to the commencement of work. Any structural members that are
to be reused in the fire damaged area will need to be inspected and approved by a structural engineer.
Building permits will need to be obtained no later than June 30, 1998. If the building is to be demolished, all
work must be completed within 60 days after the permit is issued. If the structure is to be repaired, all work
must be complete 180 days after the permit is issued.
If the required work is not completed within the time specified, the building official may order the work to be
done and charge the costs thereof against the property or its owner.

Any person having any record title or legal interest in the building may appeal from the notice and order or any
action of the building official to the board of appeals, provided the appeal is made in writing as provided in the
1994 Uniform Code for the Abatement of Dangerous Buildings and filed with the building official within 30 days
from the date of service of such notice and order; and that failure to appeal will constitute a waiver of all right
to administer hearing and determination of the matter.
