Home My WebLink About981224.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST GUADALUPE AND ROSE CHAVEZ FOR VIOLATION OF THE WELD COUNTY BUILDING CODE ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Guadalupe and Rose Chavez, VI #9800068, are allegedly in violation of the Weld County Building Code Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 14th day of July, 1998, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Guadalupe and Rose Chavez were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals as hereinabove named to correct said violation. As a result of the extensive fire damage, the building needs to be immediately vacated and secured against entry. Two options are available. The building may be demolished and the resulting debris properly removed from the property, or the building repaired and brought into a safe and structurally secure condition. Whichever option is chosen, a building permit will be required before any work is commenced. If the building is to be demolished, a letter from a qualified asbestos inspector stating that there is no asbestos in the building will be needed at the time application is made for the demolition permit. If the structure is to be repaired, a building permit is required prior to the commencement of work. Any structural members that are to be reused in the fire damaged area will need to be inspected and approved by a structural engineer. Building permits will need to be obtained no later than June 30, 1998. If the building is to be demolished, all work must be completed within 60 days after the permit is issued. If the structure is to be repaired, all work must be complete 180 days after the permit is issued. If the required work is not completed within the time specified, the building official may order the work to be done and charge the costs thereof against the property or its owner.
