TO THE PARTIES IN THIS MATTER AND ALL INTERESTED PERSONS, FIRMS OR
CORPORATIONS:
You are notified that the Union Pacific Railroad Company ("UPRR"), a Delaware
corporation, by and through its attorney, James P. Gatlin, will fully participate in this matter
and in any hearing.
In its Application, the City seeks to require UPRR to provide labor, at its sole cost
and expense, to install new "rubber panel" crossing surfaces for two new pedestrian
crossings on either side of the existing at-grade vehicular crossing at 13th Street. UPRR
objects to such a cost allocation.
The installation of these new pedestrian crossings is not a modification of the
existing vehicular crossing, and is of no benefit to UPRR. The sole cost and expense of
these new installations should therefore be borne by the City.
UPRR further reserves the right to object, and UPRR will intervene and participate
in any other matters herein as its interests 2may appear.
