HomeMy WebLinkAbout951651.tiffRESOLUTION RE: ACTION OF BOARD CONCERNING EXCLUSION OF PROPERTIES FROM AREA PROPOSED FOR INCLUSION IN TRI-AREA AMBULANCE DISTRICT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with nine requests for exclusion from the area proposed for inclusion in the Tri-Area Ambulance District, with said area proposed for inclusion being as follows: Sections 22, 23, 24, 25, 26, 34, 35, and 36, and the North 'A of Section 27, Township 2 North, Range 68 West of the 6th P.M., and Sections 1, 2, and 3, and the North 1/2 of Sections 10, 11, and 12, Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, the persons making the requests and the lands they are requesting exclusion for are described in the attached Exhibit "A", and WHEREAS, pursuant to the provisions of Section 32-1-203(3.5) and 32.1.401(3), C.R.S., the Board of County Commissioners held a public hearing on the 9th day of August, 1995, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing said requests, and WHEREAS, Robert Cole, Attorney, and Greg Engel, District Manager, were present to represent the Tri-Area Ambulance District; and Sandy Ingram and Earl and Barbara Sowers were present as petitioners for exclusion from the area proposed for inclusion, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the petitioners and all of the exhibits and evidence presented in this matter and, having been fully informed, determines that the nine requests shall be approved for the following reasons: 1. The Tri-Area Ambulance District would benefit more financially if the petitioners are charged out -of -district rates. 2. The District did not convince the Board that the proposed inclusion is in its best interests. 3. A large number of the calls are for the 1-25 Corridor. 5. Jurisdictional boundaries and problems with Mountain View Fire Protection District need to be clarified and resolved. 6. The mill levy indirectly pays for the service. 7. The District has not met its burden of proving that exclusion of the nine properties from the area proposed for inclusion is not -in the best interests of the District. We appreciate you scheduling a hearing for August 9, 1995, to consider certain matters related to the District's proposed inclusion election. As you know, the Tri-Area Ambulance District provides ambulance and emergency medical service, including advanced life support, to an area in southwestern Weld County surrounding the communities of Firestone, Frederick, and Dacono, and extending to Erie. The District's Board of Directors has proposed that approximately thirteen and one-half square miles along the District's western boundary, which is currently within the District's service area, be included within the District's boundaries. In order for this proposed inclusion to become effective, it must be approved by the electors within the area proposed for inclusion at the November 7, 1995 election. Although the state statutes are somewhat confusing on this matter, your county attorney and I believe that they afford property owners the opportunity to request the Board of County Commissioners remove their property from the proposed inclusion election. You have received timely requests that nine different properties ("Properties") be removed. You should remember that your decision to leave these Properties in the proposed inclusion election does not necessarily mean they will be included within the Tri-Area Ambulance District. The electors within the area proposed for inclusion must also approve the inclusion. The Properties whose owners have requested they be removed from the inclusion election are summarized on Attachment A to this letter. Included as Attachment B is a map showing the District's current boundary, the area proposed for inclusion, the Properties requested to be removed from the inclusion election, the District's service area boundary, and the municipal boundaries of Firestone, Frederick and Dacono. 951651 COLLINS AND COCKI EL, P.C. Board of County Commissioners Weld County August 4, 1995 Page 2 In considering these property owner's requests, you must consider whether it is in the best interest of the District that the Properties remain within the inclusion election area, and if you so find, you must deny their request to be removed. For many reasons, the District's board of directors believes that it is in the District's best interest that the Properties remain within the inclusion election area: 1. The Properties are currently within the District's service area and receiving DDistricts property , although they do not pay tax. 2. The proposed inclusion generally follows the extent of municipal annexations by Frederick and Dacono. 3. The boundaries of the proposed inclusion have been drawn along section lines and County roads so that jurisdictional and call responsibility, dispatching, and administrative boundaries are clearly and logically defined. Removing the Properties would create confusion as to service responsibility, which could delay dispatching and emergency response times. 4. Even though the area is currently within the District's service area pursuant to an agreement with Mountain View Fire Protection District, the agreement can be terminated upon 30 days notice, leaving any area outside of Tri-Area's boundaries without service or with service by another provider. 5. The area within the proposed inclusion represents the largest number of out -of -District calls within the District's service area, except for areas within the Town of Erie. Twenty percent of all of the District's calls are within the proposed inclusion. The District's ambulance calls increased from 1993 to 1994 by 22 percent, including within the area of the proposed inclusion. The District experienced a 45 percent increase in calls in this area from 1993 to 1995. 951651 COLIANS AND COCKREI., F.C. Board of County Commissioners Weld County August 4, 1995 Page 3 6. Residents within the proposed inclusion currently receive the benefit of the availability of District services not only to their residences, but also while traveling within the District. This service is currently subsidized by property owners located within the District's boundaries. 7. Even though the Properties involve a great deal of agricultural land, they have the highest potential for development in the near future, which will further increase the ambulance call volume. 8. If the Properties remain in the election area and the voters approve the inclusion, people within the included area will not pay twice for ambulance service. Property owners will contribute property taxes for the availability of ambulance service and, if they receive care from the District, will receive a service charge. The service charge, however, will be at the lower in -District rate than currently charged for out -of -District calls. The District currently charges $250 for advance life support service calls within its District boundaries, and $400 for similar calls outside its boundaries. 9. While the principal reasons for keeping the Properties within the inclusion election area are non -monetary, the financial impact on the Properties of the District's current 6.543 mill property tax levy is negligible. The total tax impact on all of the Properties based on their combined $130,670 assessed value is $854.97. Myself and District representatives will be available to discuss any questions you may have at your August 9, 1995, hearing. Enclosed with your letter is the notice for a hearing before the District Board of Directors on August 9. 1995. The notice informs owners of properties in the area proposed for inclusion that they- may submit statements to the Board of County Commissioners of Weld County requesting that their properties be excluded from inclusion. Landowners submitting such requests must do so no later than July 28. 1995. Enclosed are copies of all of such requests received recieved by the Board of County Commissioners by 5:00 p.m. July 28. 1995. As we discussed in our telephone conversation this morning. my review of Sections 32-1-403(3) and 32-1-203(3.5). C.R.S.. provides me with no definite direction regarding what the Board of County Commissioners is required to do with these requests for exclusion from inclusion. Section 32-1- 203(3.5). C.R.S.. clearly enables a board of county commissioners to exclude territory from a proposed special district prior to approval of the service plan. That subsection further states: "Any request for exclusion shall be acted upon before final action of the county commissioners under Section 32-1-205.- Section 32-1-205, C.R.S., requires that any approval of a service plan he done by resolution of the hoard of county commissioners. Section 32-1-207(2).C.R.S.. exempts a district from seeking prior approval by- a board of county commissioners for changes in the boundary of the special district. It is my understanding that the Tri-Area Ambulance District does not intend to ask this Board for any changes to its service plan. Given that Part 2 of Article I. Title 32, relates only to determinations made by a board of county commissioners relative to service plans, and the Tri- Area District does not seek to change its service plan, there does not appear to be any definite 951651 authority for the Board of County Commissioners of Weld County to make determinations as to whether certain properties should be excluded from the areas proposed for inclusion. The problem as 1 see it, however, is that section 32-1-401(3), C.R.S, implies that the Board of County Commissioners has the authority and duty to exclude certain areas from inclusion upon request by the property owners so affected. All of the persons who have submitted requests for exclusion are expecting the Board of County Commissioners to hold a hearing regarding their requests. In order to comply with the state statute and to accomodate the requesting property owners, the Board will hear their requests on Wednesday, August 9, 1995. at 9:00 a.m. The Board's hearing will take place in the First Floor Meeting Room, Weld Centennial Center, 915 10th Street, Greeley, Colorado. Each of the requesting landowners will be notified of the hearing and will be given the opportunity to present testimony or other evidence on the issue. You have represented to me that the Tri-Area District will accept and abide by the decision of the Board of County Commissioners relative to each property owner's request for exclusion. I respectfully request that the District provide me with additional explanatory information about the proposed inclusion. 1 will then see that the information is included in the Commissioner packets for the consideration at the hearing. Such information should include, but not be limited to, a map showing the proposed area for inclusion and a letter explaining why the District Board of Directors desires the inclusion. In my opinion, the burden of proof is on the District to prove that the desired exclusion from inclusion is not in the best interests of the District.
